The undersigned Official does hereby certify to Thurston County Title as follows:
1. That this is the duly appointed Community Development Director of The City of Yelm and is
authorized to make this certification.
2. That he is familiar with the plans and specifications submitted by: Prairie Run Association,
AWLP in connection with the construction of The Prairie Run Apartments located at 205

3. That the Property is in the R-14 High Density Residential Zoning District, YMC Chapter
17.18, as provided in the Zoning Ordinance or Code of the City of Yelm (hereinafter referred

constructed.
4. That all improvements and the use of the Property comply with all applicable provisions of the
Code and do not violate any current applicable zoning or occupancy ordinance, resolution or
regulation of Yelm, WA.
5. That no action or proceeding is pending before any Court or administrative agency with
respect to the Zoning of the Property or any improvements located thereon.

Description of Proposal: Construction of a 32 unit apartment complex.
Location of the Proposal: 205 Mountain View Road, west side of Mountain View Road,
approximately 600 feet North of Yelm Highway.

Threshold Determination: The City of Yelm as lead agency for this action has determined that
this proposal does not have a probable significant adverse impact on the environment. Therefore, an
environmental impact statement (EIS) will not be required under RCW 43.21 C.030(2)(c). This decision
was made after review of a completed environmental checklist and other information on file with the lead
agency. This information is available to the public on request.

submitted to Tami Merriman, Community Development Department, City of Yelm, 105 Yelm Ave. W., P.O. Box
479, Yelm, WA 98597, by 5:00 p.m., February 26, 2002.
You may appeal this determination to the Yelm City Council, at above address, by submitting a written appeal no
later than 5:00 p.m., March 5, 2002. You should be prepared to make specific factual objections. Contact Agnes
Bennick, City Clerk, to learn more about the procedures for SEPA appeals. This MDNS is not a permit and does
not by itself constitute project approval. The applicant must comply with all applicable requirements of the City of
Yelm prior to receiving construction permits which may include but are not limited to the City of Yelm
Comprehensive Plan, Zoning Title (17), Critical Areas Ordinance (14.08), Storm water Drainage Design and

This Mitigated Determination of Non Significance is based on the project as proposed and
impacts and mitigation reflected in the following:
• Environmental Checklist (dated November 23, 2001, Prepared by R.G. Vigil,
Architects)
• Traffic Impact Analysis (dated November 1, 2001, Prepared by The Transpo Group)
• Geotechnical Report (dated August 15, 2000, Prepared by Terra Associates)
• Environmental Site Assessment (dated February, 2001, Prepared by Shannon &
Wilson, Inc.)
And the following conditions:
1. The applicant shall contribute $750 per new PM peak hour trip generated by the
project. The Transportation Facility Charge (TFC) shall be based on 19.2 new trips.
2. OAPCA and City Demolition permits are required for the demolition of the existing
structures. Existing wells, septic tanks, and septic drainfields are to be abandoned
as per State, and County regulations.
3. The applicant shall enter into an agreement with the Yelm School District to mitigate
project impacts to the school district.

The Site Plan Review Committee has reviewed your Environmental Checklist
and supporting documents, and requests further information.
The project is a USDA funded project, providing low and median income housing.
How many units will be low income, and for how long?
There are a couple of items in the Limited Traffic Study that will need further
clarification.
The City of Yelm cannot accept the use of the City of Seattle report relating to
parking. The report is a proposed amendment, and if only proposed, it is not a
regulation of the City. City of Seattle multi-family housing is very different than
housing in Yelm, in regards to traffic, transit service, and location of facilities. If
you would like to use this study as a basis for a reduced Traffic Facility Charge,
the City of Yelm will need detailed analysis, and proof that the information in the
report applies to characteristics of the City of Yelm.
The City also cannot accept the information regarding the median income in the
Olympia area. The income levels for the City of Yelm are different than the City
of Olympia. Again, if you would like to use this information as a basis for a
reduced Traffic Facility Charge, you will need to provide detailed analysis, and
proof that the information is applicable to the City of Yelm.
Other than these items, the City is prepared to issue a Mitigated Determination of
NonSignificance (MDNS) for the project. The Traffic Facility Charge is a
mitigating requirement of the environmental review, and if you wish to pursue the
facility charge reduction, we will wait to issue the MDNS.
If you choose to accept the City's determination of the traffic facility charge, we

Re: Water / Sewer Hook-up Fees for 2002
Hello,
As you are aware, the water and sewer departments have undergone some
adjustments in their fee schedules. The following increases are effective January 1,
2002, and affect both development costs as well as the fees that the administrative
staff charges when collecting for delinquencies or unauthorized turn-ons.
The re-structuring of the water rates mainly affects the administrative staff at city hall
and will be effective May 1, 2002.
WATER FEES:
ERU Fees for development:
Inside city limits = $1,500; Outside city limits = $2,000
Unauthorized Turn-On = $60.00
Restoration of Service (from delinquent or non-paid bills) _ $20.00
*Section 3 of Ordinance 748 adjusts the flow per ERU from 1263 c.f to 900
c. f. making it consistent with the sewer ordinance.

Lots approved under the original sewer capacity (identified in Resolution No.

Lid properties will pay their assessment of $1,823 per Equivalent Residential
Unit and $2,549 at building permit issuance.

(sewer) for support documentation.

and irrigation plan are required as an element of civil drawings.
Open Space:
Chapter 14.12 requires 10% of the gross site area be dedicated to Open Space. To
qualify for open space the area must be used as:
1. Environmental interpretation or other education;
2. Park, recreational land, or athletic fields;
3. Off-rood footpaths or bicycle trails; or
4. Any other use found by the city to further the purposes of the open space
chapter.
Above ground stormwater facilities can not be counted towards open space
requirements.
As proposed on the site plan, you would need to provide 11,630.50 sq. ft. of open space.
The rec. room portion of the community building can be included, along with any patio
and grass area outside the community building.
Schools:
The Yelm School District requires residential developers to mitigate impacts to the
school district through a developers agreement. Current mitigation fees for apartments
are $775.00 per unit.
Traffic:
A Traffic Impact Analysis (TIA) is required per the Yelm Comprehensive Transportation
Plan. The TIA is an element of the environmental review and must be submitted with the
environmental checklist. A scoping meeting will be necessary to determine the content
of the TIA.
The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak
trip. The TFC is in addition to any needed transportation improvements identified in the
TIA. The Ordinance provides a default table that the applicant can use to determine new
pm trips generated. To determine the projects impact and fee use the following formula
for the use proposed:
.60 new trips x unit x $750.00 = TFC ( $450.00 per unit.)
.60 X 32 = 19.2 X $750.00 = $14,400
If the applicant feels the proposed use would not generate the default number of trips as
designated in the TFC Ordinance an analysis prepared by a Washington State Licensed
Engineer can be submitted to the City for review and consideration.
SEPA: Environmental checklist including a TIA is required for this project.
Application and Process:
Site Plan Review, Chapter 17.84 is an administrative process. Minimum application
requirements are located in Section 17.84.060 and are listed on the application form.
Land-use review and approval for this type of project could be completed in 12 - 18
weeks. Administrative Site Plan approval is valid for 18 months.

requirements for the City of Yelm. Until a complete application is made, the planning and/or public
works department can only attempt to inform the applicant of general requirements as they appear in the
form presented by the applicant at the time of pre-submission.

Water:
The proposed site would need to connect to the City's water system. There is
an existing 8" water line located on Mountain View Road. There is also an 8"
line depicted along Sprague. It appears that a "looped" watermain will be, ,\V\_
required to provide adequate fire flows for the buildings.
Water ERU's (equivalent residential units) are based on a consumption rate
of 240 gallons per day and are charged at a rate of $1,000/ERU (fee subject
~y to change) inside city limits. Each residential unit would be charged one /
ERU, however, the proposed units are multi-family units greater than four i~
units and would receive a discounted ERU rate of .75 x $1,000 or $750/ERU
(see attachment). Additional ERU's would be determined upon review of civil
i plans.
Irrigation Meter:
y An irrigation meter may be installed for the purpose of irrigation. A backflow
prevention device will be required for all landscape irrigation connections.
Sewer:
The proposed site will be required to connect to the City's sewer system.
There is a 4" connection line available on West Yelm Avenue. Each building
will be required to install a step sewer tank and a pump tank. The pump tank
will also be required to have a triplex pumping system. This system will be
i' designed and submitted to the City of Yelm for approval by a civil engineer
licensed in the state of Washington.
*t\I The proposed development falls in the Killion North LID District and has been
assessed a total of 24 ERU's. The hook up fee of $2,480 per an ERU (fee
subject to change) is payable at time of building permit issuance. This fee is
in addition to the LID assessment of $1,823.15/ERU, which is paid on an
i- annual basis for 15 years.

Sewer Cost Breakdown:
This project will require 32 sewer connections. (32 units)
Connection Fee: 24 connections x $2,480.00 = $59,520.00 t,
8 connections x $4,850.00 = $38.800.00
Due at building permit $98,320.00
LID Assessment:
24 connections x $1832.15 =$43,971.60
This fee can be paid in a lump sum at permit issuance
or annually over 15 years.
The total number of sewer ERU's required for this project is dependent on the
type of development that occurs. Each residential unit is charged one ERU.,
The additional sewer ERU's (equivalent residential units) not related to the
LID are based on discharge of 240 gallons per day and are charged at a
current rate of $4,850/ERU payable at building permit issuance.
Fire:
Fire protection to the buildings must be provided per the Uniform Fire Code.
There will be requirements for installation of fire hydrants, fire truck access
and fire truck turn-around. These will be determined upon further review of
l plans.
Stormwater:
If the proposed improvement is over 5,000 square feet of impervious surface
\,1A there are stormwater treatment requirements per the D.O.E. Stormwater
Manual. At the time of Site Plan Review submittal a Preliminary Stormwater ~a
U Plan and report will be required.
Street Improvements:
Frontage improvements shall be consistent with Yelm's Development
h Guidelines. Your project will be required to improve the your frontage alone
Mountain View Road NW. The required improvements shall be consistent
with the "neighborhood collector" roadway section per the city's development
guidelines. The interior drive isles and parking shall be consistent with the
s city's parking details located in the development guidelines.
Street improvements may not be limited to above references. The required
TIA may also require additional improvements to Mountain View Road or the
intersection of Mountain View Road and West Yelm Ave.
Street Lighting:
Street lighting shall be installed as required per the City of Yelm's
"Development Guidelines". The on-site parking lot lighting will be reviewed at
the time of civil engineering plan review.
ADA Requirements:
The American Disabilities Act requires the facilities are ADA accessible.
Facility improvements will have to meet current code. Review of these
improvements will be determined upon further review of the civil and
architecture plans.

16.12.020 Annlication procedure. An application for
large-lot subdivision, short subdivision, or full subdivi-
sion aproval shall be submitted to the city on forms pro-

Type II landscaping is used to provide visual separation of compatible uses. Type II
landscaping is required around the perimeter of a site, which has compatible zoning
and adjacent to buildings to provide visual separation of compatible use and soften the
appearance of streets, parking areas and building elevation.
Type III landscaping provides visual relief where clear sight is desired. This
landscaping includes street trees and vegetation required with frontage improvements
and along pedestrian walks for separation of pedestrians from streets and parking
areas.
Type IV landscaping is needed to provide visual relief and shade in parking areas.
Type V landscaping is required for all above ground storm water facilities.
A conceptual landscaping plan is required with land use application. Final landscaping
and irrigation plan are required as an element of civil drawings.
Open Space: Chapter 16.14 requires 10% of the gross site area be dedicated to Open Space.
To qualify for open space the area must be used as:
1. Environmental interpretation or other education;
2. Park, recreational land, or athletic fields;
3. Off-rood footpaths or bicycle trails; or
4. Any other use found by the city to further the purposes of the open ,
space chapter.
Above ground stormwater facilities can not be counted towards open space
requirements.
Schools: The Yelm School District requires residential developers to mitigate impacts to
the school district through a developers agreement. Current mitigation fees for
apartments are to $775.00 per unit.
Traffic: A Traffic Impact Analysis (TIA) is required per the Yelm Comprehensive
Transportation Plan. The TIA is an element of the environmental review and
must be submitted with the environmental checklist. A scoping meeting will be
necessary to determine the content of the TIA.
The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak
trip. The TFC is in addition to any needed transportation improvements identified in the
TIA. The Ordinance provides a default table that the applicant can use to determine
new pm trips generated. To determine the projects impact and fee use the following
formula for the use proposed:

If the applicant feels the proposed use would not generate the default number of trips
as designated in the TFC Ordinance an analysis prepared by a Washington State
Licensed Engineer can be submitted to the City for review and consideration.
SEPA: Environmental checklist including a TIA.
Application
and Process: Site Plan Review, Chapter 17.84 is an administrative process. Minimum
application requirements are located in Section 17.84.060 and are listed on the
application form.
Land-use review and approval for this type of project could be completed in 12 -
18 weeks. Administrative Site Plan approval is valid for 18 months.
Following land use approval the applicant is required to submit final civil
drawings to the Public Works Department for review and approval and satisfy all
conditions of approval. Upon satisfactory completion of all conditions the
applicant can submit building plans for approval.
Other: Tree & Vegetation Plan for existing vegetation.
Refuse Area large enough to accommodate a dumpster and recycle bin.
Refuse areas must be of a material and design compatible with the overall
architectural theme. If fencing is used to enclose the refuse area it must be
landscaped with sight obscuring Vegetation.

The Public Works Department has the following comments relative to the
proposed site development located on Mountain View Road:
WATER:
The proposed site would need to connect to the City's water system. There
is an existing 8" water line located on Mountain View Road. There is also
an 8" line depicted along Sprague.
Water ERU's (equivalent residential units) are based on a consumption
rate of 240 gallons per day and are charged at a rate of $1,000/ERU (fee
subject to change) inside city limits. Each residential unit would be
charged one ERU, however, the proposed units are mutli-family units
greater than four units and would receive a discounted ERU rate of .75 x
$1,000 or $750/ERU (see attachment). Additional ERU's would be
determined upon review of civil plans.
IRRIGATION METER:
An irrigation meter may be installed for the purpose of irrigation.
SEWER:
The proposed site will be required to connect to the City's sewer system.
There is a 4" connection line available on West Yelm Avenue.
The proposed development falls in the Killion North LID District and has
been assessed a total of 24 ERUS in the amount of $43,755.60. The ERU
fee of $2,480 (fee subject to change) is payable at time of building permit
issuance. This fee is in addition to the LID assessment of $1,823.15/ERU,
which is paid on an annual basis for 15 years.
The total number of sewer ERU's required for this project is dependent on
the type of development that occurs. Each residential unit (2/duplex) is
charged one ERU.
The additional sewer ERU's (equivalent residential units) not related to the

current rate of $4,850/ERU payable at building permit issuance.
FIRE:
Fire protection to the buildings must be provided per the Uniform Fire
Code. There will be requirements for installation of fire hydrants. To be
determined upon further review of plans.
STORM WATER:
If the proposed improvement is over 5,000 square feet of impervious
surface there are stormwater treatment requirements per the D.O.E.
Stormwater Manual.
STREET FRONTAGE:
There are frontage improvements required for this project. Frontage
improvements along Mountain View Road NW shall be consistent with
the section "Neighborhood Collector" per the City of Yelm's
Development Guidelines (attached). Interior streets shall be consistent
with the section "Local Access Residential".
STREET LIGHTING:
As required per the City's "Development Guidelines".
ADA REQUIREMENTS:
To be determined upon further review of plans.
OTHER:
These comments are preliminary in nature and are not intended to
represent final comments and or requirements for the City of Yelm. Until
a complete application. is made, the planning and/or public works

The zoning for the above referenced tax parcel is multi-family residential (R-14.) Enclosed is a
copy of Chapter 17.18, High Density Residential District. For new development the minimum
density requirement is six units per acre and the maximum is fourteen units per acre. The
information I have for the property indicates that it is approximately 2.67 acres. Therefore the
density for the site must be between 16 and 37 units.

This brief inquiry is for the purpose of confirming the zoning designation on the property
depicted in the attached plot plan sketch. We wish to pursue development of a 28-unit
family apartment complex on the site, and need assurance from your office that if
property zoning is not already in place, chances are positive or likely that needed
clearances can be obtained, and the particular steps involved in doing so.
