MIIVU'IES CITY OP' YELM REG[IL~1R COUNCIL MEETING WIDNESDAY, JU[~ 10, 1992, 7:30 PM, YEIM CITY I-TALL COUNCIL CHAMBERS The regular meeting was called to order by Mayor Sanders at 7:30 PM. All present joined in the flag salute. Council present: Kathy Wolf, Amos Lawton, Martha Parsons and Don Miller. Staff: Glenn Dunnam, Todd Stamp, Gene Borges and Shelly Badger. No visitors were present. The agenda was approved with the addition of items 9(a) - AWC Convention and 11(c) - Ft. Stevens school letters on a motion by Amos Lawton, second by Kathy Wolf. Motion carried. The minutes of the May 27, 1992 regular meeting were approved on a motion by Martha Parsons, second by Don Miller. Motion carried. The following vouchers were Amos Lawton. Motion carried. CURRENT: POLICE: STREET: ARTERIAL STREET: CDBG: WATER/SEWER: GARBAGE: approved on a motion by Kathy Wolf, second by 90 WATER REDEMPTION FUND: TOTAL $ 8,365.74 $ 3,215.71 $ 4,719.44 $11,399.08 $ 5,681.09 $13,053.08 $10,173.06 $20,735.00 7,342. At 7:32 PM a Pub]_ic Hearing on an amendment to the Yelm Zoning Ordinance was opened. Todd Stamp stated that the proposed amendment conforms to state law and makes City Council public hearings relating to Title 17 of the City Code (zoning) optional. However, if a party is aggrieved by a decision of the Planning Commission, a public hearing before the Council can be requested. With no further comments, the Hearing was closed at 7:34 PM. Kathy Wolf moved to adopt Ordinance No. 437 providing that a public hearing before the City Council to amend zoning be at the option of the City Council, second by Martha Parsons. Motion carried. Effective date: June 23, 1992. Staff presented City Council with a copy of the hearing procedures resolution recently adopted by the Planning Commission. The resolution sets forth stan- dard and optional procedures for conducting development-related public hear- ings and clarifies the roles and duties of the various participants. To en- sure consistent and fair decision-making in the land use and development arena, both Todd Stamm and Gene Borges recommended that the Council also adopt the resolution. Don Miller rrbved to adopt Resolution No. 249 with the following changes: 1. Addition to Section 2 stating that: Failure of any governing body, committee, or staff member of the City 'of Yelm to comply with any specific provision of this resolution will not and should not be cause to invalidate any decision made in conformance with law and with the intent of this resolution". 2. Change title to "City of Yelm Land Use and Development Hearing Pro- cedures". ' 3. Add to Section 3, C(2) the word "State" at beginning of sentence. Motion was seconded by Martha Parsons. Motion carried. Discussion on a letter to Mayors received June 8, 1992 from the Department of Community Development, Fire Protection Services Division, relating to state water shortages and restriction of use of fireworks to July 4 only or the re- striction of use of fireworks for the summer. Council unanimously opted to NOT RESTRICT THE USE OR SALE OF FIREWORKS IN YELM, however, asked that a no- tice be placed in the Nisqually Valley News warning that any person may be held financially responsible for any (including fire) damage caused by the use of fireworks. Also, to ask citizen cooperation in using strict caution i_n their use of fireworks and urge them to restrict usage to July 4 only, for a safe, sane and sober 4th of July 1992. r i_ Mayor Sanders announced that he would be unable to attend the Association of Washington Cities Annual Convention June 16-19, 1992. PLANNING COMMISSION MEETING OF JUNE 2, 1992: Work continued on the designa tion of a growth boundary; the Commission opted to exclude the 4-Corners and "undeveloped across-the-canal",areas, but to designate them as "urban re- serve" areas (areas for growth boundary consideration at a later date). The proposed boundary will be submitted to Thurston County in July for considera- tion by Thurston County Commissioners and the Urban Growth Management Commit- tee. PARK ADVISORY COMMITTEE MEETING OF JUNE 9, 1992: No quorum present. Martha Parsons moved to approve the following park use requests: 1. A. Marjorie Smith, McKenna Community Church Ladies Aid, June 17, 12-2PM. 2. Cathy Hall, McKenna Reds Little League, June 13, 12-6PM. 3. Susan Betschart, graduation party, baseball game, June 21, 12-7PM. Motion was seconded by Don Miller. Motion carried. YELM HISTORIC PRESERVATION COMMISSION MEETING OF JUKE 9, 1992: No quorum present. Briefing on County-Wide Policy: Last week the County-Wide Policy Coordinat- ing Committee passed recom-nended policies (to comply with HB1025) out of com- mittee to all cities and Thurston County for ratification. Each city has 1 vote, along with 1 vote from each Thurston County Commissioner. Todd and Gene have both reviewed the policies and feel they are acceptable to Yelm. During the policy development process, small cities were listened to and heard. Each city and Thurston County shall provide for public review of the document and forward a decision back to the Committee by July 15, 1992. Council concurred that a Public Hearing on the policies should be held at the July 8, 1992 Council Meeting with limited notification. CORRESPONDENCE: 1. Letters from -the class of Room 10, Fort Stevens Elementary School. ~ Kathy Wolf moved to direct staff to write a thank you letter to the class and to share the letters with the economic development committee of the Yelm Chamber, second by Amos Lawton.
