06/15/93CITY OF YELM COUNCIL MINUTES, ~~~~~{~ SPECIAL MEETING - TUESDAY, JUNE 15, 1993 (~ 4:30 P.M., CITY HALL COUNCIL CHAMBERS Agenda/Motion Numbers 1. The meeting was called to order at 4:32 p.m. by Mayor Kathy Wolf. Council present: Don Miller, Martha Parsons and Bob Gallagher. Staff present: Jim Blundell, Owens Davies Mackie, Gene Borge: Shelly Badger, Ty Peterson and Agnes Colombo. 2. The Council meeting was closed and Executive Session, to discuss possible litigation, was opened at 4:33 p.m. 3. Mayor Wolf reopened the Council meeting at 5:18 p.m. 4. To avoid any confusion Gene Borges requested that Council's motion of 8/22/90 be updated to reflect his new job title. 93-120 MOTION BY BOB GALLAGHER, SECONDED BY DON MILLER THAT AUTHORIZATION FOR CITY ADMINISTRATOR~GENE BORGES TO SIGN DOCUMENTS RELATING TO THE SEWER PROJECT, AS PER COUNCIL MOTION OF 8/22/90, INCLUDE THE AUTHORITY TO SIGN DOCUMENTS RELATING TO THE SEWER PROJECT AS SEWER PROJECT MANAGER. MOTION CARRIED. 5. Shelly Badger requested that Council give careful consideration to requests for City expenditures in light of the potential for the City to incur expensive legal costs. 6. Council and staff members were advised that approval should not be granted to any new (not yet applied for) subdivision plat that cannot be developed under current Thurston County regulations. Jim Blundell explained that the City should avoid creating moratorium on approval of subdivisions, but should require th~a~~~ meeting the county development standard be a condition for preliminary plat approval and that this condition be recorded as part of the final plat. Example: Seasons Development 'Jim Blundell, Yelm counsel, will prepare appropriate policy. Additional discussion concluded that while the unused lots created by this style of development might be viewed as being potentially unusable, research (MRSC) indicated this is permissible. When county reaction to this, policy was discussed Shelly Badger pointed out that these are not plats in the county - they are plats in the City of Yelm. It was determined that an executive session may be needed at the next Council meeting to discuss options to avoid litigation.
