The meeting was called to order at 7:37 p.m. by Mayor Kathy Wolf. All present joined in the flag salute. Council present: Martha Parsons, Patty Forrester, Amos Lawton and Bob Gallagher. Councilman Don Miller arrived late due to an Intercity Transit meeting. Guests present: Eathan Earle, Shane Storie, Kevin Caupace, Trevor Boden, Amy Boswell and Justin Fugich. Kelly McGinnis, Lacey Beadle, Jennifer Mazza, Jesse Chasen, Jean Isaacs and Steve Keesla. Thomas Davis, Lawna Knight, Josh Eylander, Diane Suton, Sylvia Keesla and Simon Bradford. MOTION BY MARTHA PARSONS, SECONDED BY BOB GALLAGHER APPROVING THE AGENDA WITH ITEM #8b MOVED TO REPLACE #5 AND THE ADDITION OF ITEM 9.f., CHILDREN'S DAY. MOTION CARRIED. 93-180 3. MOTION BY MARTHA PARSONS, SECONDED BY PATTY FORRESTER APPROVING THE AUGUST 25, 1993 MINUTES AS WRITTEN. MOTION CARRIED. 93-181 4. MOTION BY BOB GALLAGHER, SECONDED BY PATTY FORRESTER APPROVING PAYMENT OF SEPTEMBER VOUCHERS TOTALLING $528, 809.03 . MOTION CARRIED. Due to a printer/computer malfunction warrants ~--% had not yet been printed and numbers were not available. 5. Mayor Wolf read a letter from local skateboard enthusiasts requesting the City's assistance in locating a place where they could practice their sport. Mayor Wolf opened the floor for comment. Chris Powers - explained that at the present time skateboarding was creating a insurance liability problem for businesses and that those active in the sport could build their own ramps if they had the land. It was mentioned that some cities confiscate boards and fine skateboarders. Steve Kessla and Shane Storie - expressed concern that people hate skateboarders and requested paved land on which they could build their own ramps. Kathy Beudin - said to use indoor and outc relieving the city of parks. Admission rangy that the city has enou area at Yelm City Park park. Some of the skaters parents would be willing to supervise. Skateboarding was presented as drug/alcohol free sport that ""~ keeps kids out of trouble. Gene Borges volunteered to work on the issue and pointed out that nonpayment for use would be more favorable to the City in regards to liability. Mayor Wolf thanked the audience for their input and praised them for going about trying to make changes in the correct way. Chief Dunnam was appointed to chair a committee to investigate possibilities and report back to City Council at the 10/13/93 meeting. Council will then review recommendations with a final decision slated for the 10/27/93 meeting. It was suggested that DARE and the Park Advisory Committee also be involved. Chief Dunnam requested that 1 or 2 of the young people contact his office and work on the issue. Mayor Wolf cautioned all about avoiding liability and pointed out that it would be irresponsible to put the City's 1,400 residents at financial risk. When skateboarders asked if they could use the paved area by the park stage during the interim Gene Borges and Mayor Wolf explained that they could not give permission .without accepting liability and their only recourse at this time was to suggest that private property be used with the owner's permission. 6. Executive Session - Mayor Wolf closed the regular meeting at 7:57 p.m. and Council went into executive session to discuss litigation. The regular meeting was reopened at 8:34 p.m. 93-182 MOTION BY BOB GALLAGHER, SECONDED BY PATTY FORRESTER THAT COUNCIL AUTHORIZE MAYOR WOLF TO SIGN THE SEWER OUTFACE AGREEMENT, AS PRESENTED AT 3:00 ON SEPTEMBER 8, 1993, BETWEEN THE CTTY OF YELM AND OTHER PARTIES INVOLVED IN THE SEWER AGREEMENT AND THAT A LETTER BE SENT TO THE DEPARTMENT OF ECOLOGY THANKING THEM FOR INPUT AND SUPPORT OF THE REACHED AGREEMENT. MOTION CARRIED. 8. New Business: a. Ordinance No. 481 - Chief Dunnam explained that the Yelm Police Department confiscates up to 25 fire arms per year of which one would possibly be an illegal weapon. MOTION CARRIED. b. Skateboards, moved to #5 c. Ordinance No. 482 - Shelly Badger explained that staff was recommending a 15~ salary increase of $161.00 per month be applied to the Office Assistant I position due to increased responsibility during the illness/recovery of the City Treasurer. The increase would be revisited with adjustment possible following the return of the treasurer. If no reduction/change was made between now and the end of the year, adjustments would still take place for 1994 during the upcoming budget process. • 93-184 MOTION BY MARTHA PARSONS, SECONDED BY PATTY FORRESTER ADOPTING ORDINANCE NO. 482-INCREASING THE CITY HALL OFFICE ASSISTANT I SALARY BY $161.00 PER MONTH. MOTION CARRIED. 9. Old Business: a. Sewer- Resolution No. 296 - tabled from 8/25/93 93-185 MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON THAT THE SEWER CAPACITY RESOLUTION NO. 296 BE POSTPONED TO 9/22/93. MOTION CARRIED. b. Thurston Co. Satellite Office Update - Shelly Badger explained that space issues had resulted in locating the Satellite Office in Tenino. Thurston County is still looking for another site. Councilman Don Miller arrived at 8:47 p.m. c. Park Playground Equipment - Shelly Badger explained that she had met with Tim Peterson to discuss options but, that it was difficult to develop a plan when AWC says the equipment shouldn't be there. While there have been no reported injuries from use of the playground equipment, the equipment is not "authorized" (purchased from certified manufacturer). Shelly proposed putting together a written plan and having it reviewed by AWC to see if they would be " comfortable with the possibility of having to defend the City. Don Miller suggested that a replacement plan be drawn up. Martha Parsons felt that AWC shouldn't expect the City to document intent. ` d. Members reviewed the Thurston Co. BRB Memorandum on the SW Yelm Annexation. e. Information concerning pets was distributed. Maria Kramer gathered public education information to be placed in the library. f. Children's day - Chief Dunnam expressed concern that young people feel the police don't like them. The Chief would like to change this perception and requested that Council approve a Youth Recognition Day to allow the kids an opportunity to demonstrate their capabilities. This activity would be coordinated with DARE. The Park Advisory Board could also be involved in the event. 93-186 MOTION BY AMOS LAWTON, SECONDED BY MARTHA PARSONS THAT YOUTH RECOGNITION DAY, AS PROPOSED BY CHIEF DUNNAM, BE HELD ON OCTOBER 10, 1993 IN YELM CITY PARK. Historic - Next Meeting 9/15/93 - Problems with the new booklet were identified. d. Councilman Bob Gallagher reported that a Public Works ""'~ Appreciation Pot Luck is being planned for Monday, September 27, in Council Chambers at noon. e. Police Report 1. Chief Dunnam reported on traffic problems now that the schools have reopened. The Chief will draft a letter to be published in the Nisqually Valley News explaining that the City doesn't have enough officers to direct traffic at all of the schools. 2. The Yelm Police Department is working on a historical file and looking for photos and information. 3. The Emergency Management Disaster Plan review will be completed this month. We will be the first city of our size to have a state approved plan. Work is being done towards a Thurston/Pierce County joint agreement that will address Yelm's response and/or responsibilities to threats to McKenna. 4. Work on the 1994 budget is underway. Chief Dunnam reported that he had spoken with the manager at the Cove Apartments and cleanup is progressing. Mayor Kathy Wolf reported that a letter from the City supporting continued subsidized senior housing at the Rainier Apartments had been sent to FmHA, the apartment ,~ manager and several residents. Don Miller reported on IT's new service. Roadway safety issues and routes are being evaluated. IT will locate a route/time information board somewhere in the City. 11. Correspondence: Mayor Wolf requested that the Thurston Council on Cultural Diversity information be given to Faith Hagenhofer. Shelly Badger reported that Yelm has requested to be the first speaker at the Urban Growth Management Hearing on 9/22 due to the regularly scheduled Yelm City Council meeting on that evening. 12.
