11/23/93Q00:~~~ A(;EI~IDA/MO~PION N[~1BERS MINU`IES CITY COUNCIL MINUtES, T[7ESDAY, NOVIIHBER 23, 1993 7:30 P.M., CITY HALL COUNCIL CHAMBERS Mayor Kathryn Wolf was sworn in by Mayor Pro-Tempore Parsons for the short-term Mayor position through December 31, 1993. She will be sworn in again in January for her 4-year term of office. Councilmembers Patty Forrester, Bob Gallagher and Don Miller were sworn in by Mayor Wolf for their short-term Council positions through December 31, 1993. Their 4-year terms of office begin January 1, 1994. 1. The meeting was called to order after the swearing in of elected officials at 7:35 PM. AlJ_ present joined in the flag salute. Council present: Bob Gallagher, Amos Lawton, Patty Forrester, Martha Parsons and Don Miller. Staff: Gene Borges, Mark Cook, Ty Peterson, Glenn Dunnam, Shelly Badger and Jim Blundell (Owens Davies Mackie). Visitors present: Jon Potter .(representing Venture Partners), Elene Newby, Gordon Kampfer, Wess & Marie Goss, Mr. & Mrs. Henry Dragt, George Knight, Ken Garmann, Geoff Moore (Pac-Tec), Budd Crest (Crest Development), Bill Kreager, (Mithun Partners), Dennis Su, KCM, Dr. Paul B. Liao, CEO, Kramer, Chin & Mayo, Inc., Martin C. Dirks, President, Kramer, Chin & Mayor, Inc., & Robert "Budd" Welcome (all representing Thurston Highlands & Associates). Other visitors were present but were not listed on the sign-in sheet. 93-227 2. MOTION BY Martha Parsons, second by Patty Forrester to approve the agenda with the following amendment: Item 11(a), Canal Road Park name - Mayor Wolf asked that this item be tabled for legal clarification on process regarding the vote of November 10. Councilman Lawton questioned the process and legality of the Mayor's no vote (which broke the tie vote of Council) with the stipulation of bringing the issue up again in the future for further discussion. Motion carried. 93-228 3. MOTION BY Don Miller, second by Bob Gallagher to approve minutes of the November 10, 1993 Regular Meeting. Motion carried. 93-229 4. MOTION BY Don Miller, second by Martha Parsons to approve payroll for the month of November 1993. Motion carried. 93-230 5. MOTION BY Don Miller, second by Martha Parsons approving Resolution No. 302 establishing the City's intent with regard to its development of a wastewater reuse system. 6. PUBLIC HEARING on SW Yelm ,Annexation was called to order at 7:40 PM. With no corrrnents from the public, the Hearing was closed at 7:41 PM. 93-231 a. Motion carried. 93-232 b. MOTION BY Martha Parsons, second by Patty Forrester approving Ordinance No. 484 annexing the SW Yelm Annexation and granting Mayor Kathy Wolf authority to sign the accompanying agreement for the City of Yelm. Motion carried. Annexation effective date will be December 7, 1993. 93-233 c. MOTION BY Martha Parsons, second by Don Miller approving Resolution No. 303 expressing the City's intent to a future • amendment of its Comprehensive Plan consistent with the SW Yelm Annexation. Motion carried. 7. PUBLIC HEARING on the Determination of Similar Use in the Commercial C-1 zone was opened at 7:48 PM. Ty Peterson, Planner, gave a staff report and recommendation and provided copies of the Planning Commission minutes of November 15, 1993 where the Commission recommended approval of outside storage and sale of landscape materials as an accessory use to a nursery or garden center, with materials such as top soils, bark, gravel and dirt • contained with appropriate bunkering, remain retail in nature and have some size limitation. ~ Staff report recommended size of bunkers to be 50 cubic yards. There was public comment from Gordon Kampfer that 50 cubic yard bunkers were too small and recommended 80 cubic yard bunkers. With no further public comment, the Hearing closed at 7:57 PM. 93-234 MOTION BY Don Miller, second by Amos Lawton to accept the Planning Commission recommendation and directed staff to draft the appropriate amendment, including the staff recommendation, to the zoning ordinance allowing outside storage and sale of landscape materials as an accessory use to a nursery or garden center, with a bunker size limitation of 80 cubic yards per bunker and that the operation remain retail in nature. Motion carried. 8. Geoff Moore, Pac-Tec, Budd Crest, Crest Development and Bill Kreager, Mithun Partners were present to give a slide presentation showing a variety of options to achieve attractive affordable • housing in the Yelm community. With Yelm's development of standards, they feel it is an opportune time to provide the City with additional information on how to approach land planning to keep housing costs down. The slide presentation showed several communities in the Northwest that have used high •density and other alternate design standards to provide affordable housing. Councilmembers and staff asked for locational maps to the developments shown in the slide presentation so they can visit the sites. Planning Commission members will also be provided with copies. 9. PUBLIC HEARING on the 1993 Preliminary Budget was opened at 8:46 PM. Shelly Badger provided copies of the Preliminary Budget to Council and those interested. With no comments from the Public, the Hearing was closed at 8:48 PM. _ Page 2 ~, ®O~~f 10. a. Dates for City Council Budget worksessions were set for Tuesday, November 30, Wednesday, December 1 and Tuesday, December 7, 1993. The Final Budget Hearing will be held on Wednesday, December 22, 1993 as an agenda item at the Regular Council Meeting. 93-235 b. MOTION BY Martha Parsons, second by Bob Gallagher approving Ordinance No.-485 establishing the 1994 Ad Valorem Tax rate and amount for 1994 property tax collection. Motion carried. 12. a. Planning Commission Report: Minutes of the November 15, 1993 meeting were provided. b. Library Report: Mayor Wolf distributed a letter of appreciation and best wishes written to Faith Hagenhofer as she continues her career as the Librarian for the Nisqually Tribal Center. Council thanked Faith for~her contributions to the Yelm community during her time as Yelm Timberland Librarian. Faith was present to give the Council an update on the Thurston Council on Cultural Diversity and Human Rights (she will continue to represent the Yelm community). The October Librarian Report stated that the Friends of the Yelm Library have become the beneficiary of the estate of Jean DeRevere, an unexpected and generous gift of Ms. DeRevere's to the community. c(1). City Hall Report: No report this meeting. c(2). Police Report: Chief Dunnam updated City Council on grants that have been applied for and/or received. Recently 7 grants have been applied for including the Department of Justice grant to fund 75o of one additional officer's salary in 1995. Also, a letter has been signed by Mayor Wolf explaining the City's support of a skateboard area to aid the youth in their fund-raising efforts. c(3). Public Works Report: 103rd Ave. reconstruction is scheduled to begin the week of November 29th. Traffic bumpers have been installed on Yelm Ave. at the Post Office and on First St. Public Works Department was commended for their efficient work during this extremely busy time. d. Mayor°s Report: Mayor Wolf provided an update to Council on her monthly meetings (approximately 15) which included Thurston Regional Planning Council, Mayor's Forum. and Nisqually River Council. The City of Yelm, along with Chamber of Commerce members and citizens received second place honors (for pledges collected) in the American Heart Association f~eartwalk held in October.
