Dear Mr. Hertel:
It has been some time since we have heard from you, and wanted to follow up with the Site Plan
Approval for Prairie Auto Glass.
Under normal circumstances, all conditions of approval must be met before a business receives
Certificate of Occupancy. The Prairie Auto Glass business was operating in violation of Yelm
Municipal Code Chapter 17, and Site Plan Approval was required to bring the site into
compliance with City regulations.
In light of the Yelm Avenue construction project, some leeway for the required improvements
was granted, to allow for the road construction to be completed.
Now that the road construction is complete, the Site Plan Review Conditions of Approval must
be met. I have listed below, the conditions that are not complete at this time. Please complete
the following conditions, and request an inspection by the Community Development Department
by June 30, 2003.
3. Sewer System
Conditions of Approval:
a. Upon completion of the onsite installation as per the City's Development
Guidelines, the S.T.E.P. sewer equipment shall be deeded to the City, and an
easement provided for maintenance.

5. Parking
Conditions of Approval:
a. The applicant shall create a paved parking area, meeting the City of Yelm
Development Guideline standards, with a minimum of 7 parking stalls. The
parking bays inside the structure do not count towards this requirement.

6. Building Department
Conditions of Approval:
a. Design Guidelines II, Pedestrian Access. All pedestrian paths must correspond
with federal, state and local codes for handicap access, and ADA requirements.
All buildings shall have a paved pedestrian path from street sidewalk to the main
entry, and provide pathways through parking lots.

7. Fire
Conditions of Approval
a. The applicant shall submit fire flow calculations for all existing and proposed
hydrants. All hydrants must meet minimum City standards.
Incomplete.
b. The applicant shall submit a fire hydrant plan to the Community Development
Department for review and approval.
Incomplete.
8. Landscaping
Conditions of Approval:
a. The applicant shall include a landscape plan to the Community Development
Department with civil plan submittal, for review and approval.
Incomplete.
b. The applicant shall provide for Type II landscaping around the building.
Incomplete.
c. The applicant shall provide for Type IV landscaping in the parking areas.
Incomplete.
d. The applicant shall provide a letter signed by the tenants of the two homes on the
site, agreeing to allow the business to operate without the required landscape
buffers.

e. Completed landscaping shall be approved by the Community Development
Department at the completion of installation of the utilities and parking.
Incomplete.
10. Other Conditions of Approval:
a. Commercial signage is governed by Yelm Municipal Code, Chapter 15.24. The
business owner shall be required to bring his signage into compliance with City
codes within 30 days of receipt of this letter. The owner of Prairie Auto Glass
should contact Mr. Gary Carlson, City of Yelm Building Official at 360-458-8407,
to discuss sign code requirements.

ENVIRONMENTAL and OTHER DOCUMENTS SUBMITTED WITH THE APPLICATION: An
Environmental Checklist not required WAC-197-11-800(1)(iii).
Additional Information or Project Studies Requested by the City: The City has not requested any
additional information at this time.
No preliminary determination of consistency with City development regulations has been made.
At minimum, this project will be subject to the following plans and regulations: City of Yelm
Comprehensive Plan, Zoning Title (17), Critical Areas Ordinance (14.08), Storm Water Drainage Design
and Erosion Control Manual (DOE), Uniform Building Code, State Environmental Policy Act (SEPA) Title
(14), Road Design Standards, Platting and Subdivision Title (16), and the Shoreline Master Program.
The City of Yelm invites your comments early in the review of this proposal. Comments should be
directed to Tami Merriman, Community Development Department, P.O. Box 479, Yelm WA 98597, 360-
458-3835.
THE 15-DAY PUBLIC COMMENT PERIOD ENDS AT 5:00 PM ON JUNE 4, 2002
This notice has been provided to appropriate local and state agencies, and property owners within 300
feet of the project site. These recipients, and any others who submit a written request to be placed on the
mailing list, will also receive the following items when available or if applicable: Environmental Threshold
Determination, Notice of Public Hearing and Notice of Final Decision. If the proposed project requires a
City Council decision, it will be mailed to all those who participate in the public hearing and to anyone else
requesting the decision in writing. Additionally, there will be a 14-day public comment period if an
environmental determination is issued. Opportunities for appeal occur within twenty one (21) days after
the date the environmental determination is issued. City Council decision can be appealed through
Superior Court. Appeals of site plan review decisions may be filed within 14 days of Notice of Final
Decision.

I have received your Site Plan Review Application for the Prairie Auto Glass
business on Vancil Road. At this time the application is incomplete. The list of
surrounding property owners does not include the correct 300-foot Radius. The
list is large, but it is missing many of the adjacent property owners, such as the
Rite Aid, The Redeemer Lutheran Church, and Safeway properties. I tried to go
through the list to find the appropriate names, but too many were missing.
I have returned the map of the surrounding property owners with the approximate
300-foot radius marked, and the instructions for the submittal of adjacent
property owners.
When I received the revised adjacent property owners list, I can then process
your application.
Please submit your revised list to me no later than May 20, 2002.

This letter serves to document the discussion you had with Tim Peterson, Public Works
Supervisor on April 24, 2002 regarding utility work related to your property on Vancil
Road. The following utility work will be completed as part of your right-of-way donation
related to the Yelm Ave./Vancil Road improvement project:
*One 8" water stub from the east side of Vancil Road will be extended to your
property line on the west side of Vancil.
*The two existing water services will be moved to the new back of sidewalk to
serve as connection points.
*The two existing sewer services will be moved to the new back of sidewalk to
serve as connection points.
When you develop your property in the future (including a short plat}, water and sewer
connection points and main extensions will need to be reevaluated based on the
particular use of the property.

Dear Tami,
Regarding compliance for Prairie Auto Glass located on Vancil Rd. SE. you ask for a proposal from
me to bring the property into compliance for the change of use.
There are several issues to contend with , each of which carries a substantial cost to complete. A couple
of issues ie: paving the parking and landscaping make no sense to do prior to the completion of the road
project on Vancil Rd.
I am proposing to start with the sewer connection followed by the water hook up which should be
worked on in conjunction with the road project. The paving and landscape would follow the completion
of the road and sidewalk.
Since I am planning to redevelop the entire parcel in the near future I would like to take the time to
plan the future as best possible in order to provide adequate sewer and water to accommodate the future
development. My goal would be to be completed in 12 months but no longer than 24 months. The paving
and landscape would be done following the road and sidewalk completion.
The tenants on either side of the auto glass shop are well aware of the commercial business there and
have no problem with it. The owner of the business has a good relationship with his neighbors and
respects their space and privacy.

Dear Mr. Hertel:
As a follow-up to our meeting last week, I would like to confirm our conversation.
At this time, the Prairie Auto Glass business is in violation of City codes and regulations.
In our conversation, you stated that you could not complete the improvements required
by the City, due to funding and future development of the property. You asked that the
City work with you, to come to an agreement that would allow the business to remain.
I requested that you write a letter stating which of the requirements you can achieve,
and a proposal for completion of the items that you feel you cannot accomplish at this
time. I have included a copy of the letter I sent to you in December 2001, detailing the
requirements for your reference.
Please provide this letter of request to me by March 15, 2002. City staff will review your
request, and provide you with a response.
If I do not receive your letter by March 20, 2002, the City will need to take further action
regarding this issue.

Dear Mr. Hertel:
Thank you for attending the Site Plan Review meeting on Wednesday, November 28, 2001.
The Site Plan Review Committee has reviewed the items that we discussed in the meeting, and
have determined based on City ordinances, that the following items will be required to continue
the Auto Glass Building at this site. The City understands that you have future plans for this
site, but until formal application is made for site development, we cannot defer the required
improvements.
For planning requirement issues:
1. Parking; Chapter 17.75 states that miscellaneous retail establishments require one stall
per 250 sq. ft. The City of Yelm Development Guidelines requires that parking areas be
paved, striped, and landscaped. The use of the existing paved area, and "shared
parking" with a neighbor, can be explored as an option for meeting minimum parking
requirements.
2. Landscaping; Type III landscaping will be required to separate pedestrians from street
and parking areas. Type IV landscaping will be required in parking areas. As stated in
the meeting, the typical Type I, and Type II landscaping requirements for commercial
development shall be waived, until such time as new development, or any other change
of use occurs on the site.
3. The requirement for refuse screening shall be waived as long as the refuse containers
are stored inside the building.
4. The Traffic Facility Charge (TFC) is charged based on the square footage of the building.
At 1750 sq. ft., the TFC shall be $3,150.00. This fee is due within 30 days from Land
Use Approval. If and when the site is developed, this amount shall be credited to the
new TFC charge.
5. Mr. Gorton has submitted application for a sign permit, which is under review by the
Building Department.

For civil requirement issues:
1. Water; The commercial business (garage) shall be connected to City water, as
described in the Civil Comments from the meeting. The Latecomer fee of $3,097.88
shall be paid before connection will be allowed. The two residential units are not
required to connect. The water line from the well, serving the garage must be closed per
Thurston County and Department of Ecology Standards.
2. Sewer; The commercial business (garage) shall connect to City sewer, as described in
the Civil Comments from the meeting. The Latecomer fee of $875.82 shall be paid
before connection will be allowed.
3. Fire; Fire protection must be provided per the Uniform Fire Code.
4. Stormwater; Stormwater treatment is required when improvements create over 5,000
sq. ft. of impervious surface.
5. Street Improvements; As discussed in the meeting, if you agree to dedicate the needed
right-of-way for the road improvements, the improvements will be completed with the
City of Yelm/Department of Transportation project. If you choose not to dedicate the
required right-of-way, you will be responsible for the dedication of the property, and the
cost of improvements.
6. Street lighting; Street lighting is required per the City of Yelm Development Guidelines.
Street lighting is part of the City of Yelm/Department of Transportation project.
7. ADA Requirements; The facility must meet ADA requirements.

storage only (future conversion of storage area would require compliance with this chapter)
and the proposed use is similar as classified by the Standard Industrial Code Classification
Manual
C. An application, in completed form, shall be filed for site plan review and approval with the
city planning department. An application shall not be in completed form under this section if
it fails to contain any of the information and material required under Section 17.84.060.
D. The site plan review committee shall consist of the following members: the city planner, who
shall serve as chairman; city administrator; the city director of public works and the building
official, or their designees.
17.84.020 Review by the site plan review committee (SPRC).
A. The site plan review committee (SPRC) shall review site plan applications as provided in
YMC, 15.49.
B. SPRC shall mail notification of the proposed project to owners of adjacent property within
300 feet.
C. The SPRC shall review a site plan and approve, or approve with conditions, site plans which
conform to the standards, provisions and policies of the city as expressed in its various
adopted puns and ordinances including the applicable sections of the Shoreline Master
Program for the Thurston Region. Whenever the SPRC disapproves a site plan, it shall set
forth in writing its findings which shall specify the particular standards, provisions and
policies to which the site plan fails to conform and the reasons why it fails to conform.
D. All decisions of the SPRC shah be mailed to the applicant.
E. The decision of the SPRC shall be final unless appealed as provided in YMC, Chapter
15.49.160.

Dear Mr. Gorton:
Your business located at 10619 B, Vancil Road S.E. requires review and approval by the
City, prior to operating a business at that site. Before your occupancy, the building was
used as an accessory building (garage), that was clearly incidental to the residential use
of the lot. While your auto glass business is an allowed use in the C-1 Zoning District,
conversion of a residential use to a commercial use requires compliance with current
City Codes. .
To bring your building and business into compliance with the Yelm Municipal Code, you
must obtain land use, civil plan, and building plan approval. Please contact our office to
make an appointment to meet with us. At that meeting, we will provide you with the
information you need to proceed with securing the correct permits.
Use of a building without compliance with Chapter 17, Zoning, is a violation of the Yelm
Municipal Code. To avoid further action by the City, your immediate response to this
letter is required.
