Box 42525 Olympia, WA 98504 Dear Ms. Roe: This letter should serve as documentation that the City of Yelm has reviewed it's development regulations, including Title 17 Yelm Municipal Code (Zoning), for their effect on fair housing objectives. Yelm has concluded that the Zoning laws currently in place serve to implement the objectives of Title VIII of the Civil Rights Act (the "Fair Housing Lave'). The Yelm Comprehensive Plan contains a number of goals which address fair housing, including policies which: • Ensure a sufficient housing supply for the 20 year planning horizon. • Encourage a variety of housing types and densities and a range of affordable housing. • Encourage the provision of adequate affordable building sites through appropriate zoning., infrastructure, and the overall regulatory climate. • Permit a variety of housing types within the residential and mixed use designations to promote the range of alternatives within the community, including but not limited to government assisted housing, housing for low-income families, manufactured housing, multi-family housing, group and foster homes. • Encourage housing with a pedestrian orientation in order to promote a sense of community and safety. • Meet County-wide planning policy requirements to ensure a fair. share of affordable housing. • Encourage housing that meets adequate safety standards. • Continue to adopt the most up-to-date and safest building, housing, mechanical and other codes. • Require owners of unsafe dwelling units to correct significant problems. • Conserve and improve the existing housing stock and neighborhoods. Encourage and facilitate economic development as an important element of improving housing conditions by providing economic opportunity. These policies are carried out through Yelm's Zoning Code and development guidelines, which provide residential densities of 4 units per acre to 16 units per acre and allow single family dwellings, duplexes, apartments, townhouses, mobile home parks, accessory dwelling units, transitional housing, group homes, and foster care facilities. Yelm's Comprehensive Plan, Zoning Code, and Development Guidelines provide housing opportunities for all citizens regardless of race, color, religion, sex, familial status, handicap, or national origin. Yelm's regulations also provide a clear and consistent set of rules and a predictable and transparent permitting process. Yelm has developed a brochure relating to fair housing (copy attached) which is available throughout City Hall and has also been published on the City's web site (www.ci.yelm.wa.us). The brochure reviews: which housing is covered by the Fair Housing Act; prohibited acts in the sale or rental of property and lending; disability protections; requirements for new housing; family housing requirements; and information on filing a housing discrimination complaint with HUD. The web site includes a link to the HUD website for additional information and a direct link to the online housing discrimination complaint form. The City also maintains posters regarding the Fair Housing Act. In addition, City staff regularly meets with the local real estate community through the Yelm Real Estate Network. Whenever the Community Development Department is asked to participate in a YREN meeting, we review the City's fair housing policies. The intent of this letter is to summarize the results of my monitoring and to identify final actions required to close the grant contract. During the course of my review, I spoke with Shelly Badger, City Administrator; Agnes Bennick, City Clerk-Treasurer; and Cindy Cecil, YCS Executive Director. The CDBG compliance areas reviewed for the YCS facility project are: • Subrecipients/Overall Management System • Procurement/MWBE Outreach • Progress in Activities • Labor Standards • National Objectives • Civil Rights • Environmental Review • Record Keeping • Financial Management • Citizen Participation I will summarize the results of each review area on the following pages. i~ The Honorable Mayor Rivas December 19, 2003 Page 2 SUBRECIPIENTS/OVERALL MANAGEMENT SYSTEM Yelm Community Services is the subrecipient of this CDBG General Purpose Grant. I reviewed and approve of the subrecipient agreement between the city and YCS that supports the implementation of this project in compliance with CDBG requirements. Shelly Badger is responsible for the grant contract at the city and Cindy Cecil is responsible for project administration with the YCS. Both provide satisfactory oversight of the grant contract and project progress. Staff from the city of Yelm and staff from YCS have maintained a good working relationship during this project. No required actions. PROGRESS IN ACTIVITIES The CDBG contract end date is September 30, 2003. Given it is anticipated that the project will be completed with a certificate of occupancy within six months of this date and no CDBG contract budget revisions are anticipated, a formal amendment to extend the contract's project period is not required. My site visit confirmed that the construction is nearing completion. No required actions. NATIONAL OBJECTIVES This CDBG-funded facility will principally benefit low- and moderate-income persons by providing a variety of services that target low- and moderate-income families and youth for at least ten years. Based on conversations with Cindy Cecil, it appears some of the programs originally proposed to provide services will be changed once the expanded facility is complete. Com uter Classes 110 110 100% 2,000 2,000 The Honorable Mayor Rivas December 19, 2003 Page 3 Required Action By January 19, 2004, please resubmit a summary of the actual programs that will occupy the completed facility and the corresponding low- and moderate- income percentages (based on current data) with the proportion of CDBG funds used. Using this information, recalculate the expanded facility's overall percent benefit to low- and moderate-income persons. Provide a narrative statement describing each activity/program and the data that supports the low- and moderate-income percentage for my review. Once approved, the updated number and percentage of persons and low- and moderate-income persons served are to be listed on the Beneficiary Summary Page of the Grantee Closeout Performance Report. This report is located in the CDBG Management Handbook as Attachment 16-A and available electronically upon request. ENVIRONMENTAL REVIEW I reviewed the environmental review records and found them complete. Both NEPA and SEPA requirements are met. No required actions. FINANCIAL MANAGEMENT I reviewed the city's financial management system and found the city ensures internal control and seeks timely expenditure of funds, while maintaining satisfactory records on project expenses and grant receipts. YCS has adopted a financial policy manual in May 2003, and intends to revisit their internal control procedures due to changes in staff. The city and YCS have expended all but the final five percent of the grant funds. Back-up documentation verifies the grant has been used for CDBG-eligible costs. Required Action A payment request for final funds must be resubmitted once all required actions are met. PROCUREMENT/MWBE OUTREACH I reviewed and approve of YCS's process for procuring architectural services and construction contractors. YCS followed open and competitive processes that met federal and state procurement requirements and included efforts to solicit bids from minority- and women-owned business enterprises. The contractors were confirmed not to be on HUD's list of debarred or suspended contractors. The Honorable Mayor Rivas December 19, 2003 Page 4 Required Action By January 19, 2004, please document that YCS's procurement file includes a distribution list by informing me of the number of invitations to bid sent to construction contractors. LABOR STANDARDS Cindy Cecil, of YCS, is satisfactorily ensuring the project's compliance with labor standards requirements, including the Davis Bacon Act. She has collected and reviewed certified payrolls and fringe benefit documentation, conducted employee interviews and regularly corresponded with the general contractor, subcontractors and myself to ensure the payment of prevailing wages. Regular inspection of the construction activities was conducted. Contract and Subcontract Activity forms were submitted. In her diligence, Cindy Cecil identified several potential wage underpayments for which I am seeking a sample of resolution documentation: Required Action By January 19, 2004, please submit a payroll to document the refrigeration mechanic employee(s) with the subcontractor, Blue Mountain Mechanical, Inc., was paid the higher federal wage rate for plumbers as identified by the US Department of Labor in their September 4, 2003 letter. By January 19, 2004, please submit a payroll(s) for the owner/operator of the subcontractor, Main Frame Construction, documenting that the weekly compensation divided by the actual hours of work performed for that week result in an "effective" hourly wage rate not less than the prevailing wage rate for the type of work involved. Submit a Final Labor Standards Report as part of the Grantee Closeout Performance Report (Attachment 16-A in the CDBG Management Handbook.) This report will summarize the labor standard violations resolved during the construction project. CIVIL RIGHTS Local Employment Practices I reviewed the city's employment practices and verified that the city advertises as an Equal Opportunity Employer (EEO) and displays EEO posters. The city has completed an EEO-4 Report and YCS provided satisfactory data on employees to demonstrate equal opportunity efforts. No further action required. The Honorable Mayor Rivas December 19, 2003 Page 5 Beneficiary The city completed a Title VI certification, ensuring that discrimination will not occur with the CDBG-funded project. The expanded YCS facility will house programs that target low-income persons and collect beneficiary data on persons served through intake forms, eligibility criteria and local demographic data. No further action required, except as noted in the National Objectives section. Fair Housing The city adopted a Fair Housing Resolution and a Residential Anti-Displacement and Relocation Assistance Plan, and provides information on fair housing through the city's website and written materials. The city has supported local low-income housing advocates and streamlined its permitting process to affirmatively further fair housing objectives. I verified that fair housing posters are displayed and brochures are available for distribution. Required Action By January 19, 2004, please submit a memo documenting the city has reviewed local zoning laws and procedure for their effect on fair housing objectives. A sample memo is available upon request. By January 19, 2004, please send me documentation of the city's efforts to share fair housing information and the city's Fair Housing Resolution with local realtors and lending institutions. A sample letter is available upon request. Handicap Accessibility Prior to 1995, the city completed aself-evaluation to identify and address handicap accessibility needs, including a grievance procedure. New city hall facilities and the CDBG-funded YCS building expansion are being constructed following Americans with Disability's Act (ADA) building standards. The city will be further monitored for ADA compliance with its new facilities and also its city programs and procedures with a future monitoring of its CDBG-funded Senior Center project. No further action required for the YCS project. Recommendation The city may wish to utilize YCS' ADA Input/Evaluation Committee during future evaluations of ADA accessibility to city facilities and programs. The Honorable Mayor Rivas December 19, 2003 Page 6 RECORD KEEPING Both the city's CDBG administration files and YCS's CDBG project files are organized and well documented. YCS's CDBG project files will be consolidated or coordinated with the city's CDBG files when the project is complete. Required Action Once the construction is complete, all required actions are met and a certificate of occupancy is authorized, please submit a Grantee Closeout Performance Report. This report is available as Attachment 16-A in the CDBG Management Handbook or is available electronically upon request. CITIZEN PARTICIPATION The city has adopted a grievance procedure for CDBG-funded projects. This procedure ensures that a response will be made to all written complaints within 15 working days, where possible. Required Action By January 19, 2004, please conduct a final public hearing to review the project's performance. Box 479 Yelm, Washington 98597 (360) 458-3244 Travis Ness, Architect Helix Architecture, PS 6021 12th Street East Suite 201 Tacoma, Washington 98424-1376 RE: Civil Engineering Final Inspection and Punch list Items Yelm Communi#y Services (SPR-02-832U-YL) Dear Travis, On October 30, 2003 I visited the project site and conducted a "final inspection" at the request of Josh Miller. The following lists of civil engineering items are required before the project can be closed out. This list of items is a comprehensive list of the requirements and does not specify who is responsible for addressing each comment.. Site Inspec#ion: 1. Approx. 20'-30' feet of the sidewalk located along Crystal Springs Road needs to be replaced. It appears that when the sidewalk was poured someone walked through the concrete when it was "wet". 2. The sidewalk along Crystal Springs Road needs to have soil placed along side the back of walk. There must be at least 1' of soil even with the top edge of the sidewalk. This is currently a tripping hazard. 3. The fences need to be completed on the north property line and a portion of the south property line appears to have blown down in the wind. 4. The water department needs to complete their final inspection on the water system. 5. The bollards need to be install on the access roadway for the storm pond. Closeout Requirements: 6. The civil engineering as-builts need to be submitted and approved. The original information should be lined out and revisions and changes shown on the plans. Submit 2 copies for review. 7. The final Stormwater Report needs to be submitted. Submit 2 copies for review. 8. The STEP sewer easements and bill of sale need to be submitted. 9. The water system easements need to be submitted. 10. The civil engineering inspection fees need to be paid. An invoice will be seat to your office. Landscaping comments: 11. A planter island is missing at the west end of the parking area that is in front of the lawn at the west end of the stormvvater pond. This needs to be installed. 12. The planter boxes are missing in front both of the thrift shop additions. The City of Yelrn is an Er~unl Opportunity Provider Additional Project Requirements: During recent open house regarding the City's proposal to construct a new potable water tank at the Public Works facility, it was brought to our attention that there is a well located on the Yelm Community Services property. This well, located on a small peninsula of YCS property at the northeastern corner of the site, was thought to be on the neighboring property owners land. This well was not shown on the land use application, civil plans, or referenced in the SEPA checklist for the project. Had this required information been present on the documents this project would have been required to decommission this well, as City of Yelm Code requires. Therefore this well needs to be abandoned and decommissioned at this time. Although this requirement should have been met prior to occupancy of the structure, the City is willing to consider issuance of a temporary certificate of occupancy provided all other requirements are met for occupancy and a financial guarantee in the amount of 150% of the anticipated cost of decommissioning the well. The License and Agreement has been reviewed by James Densley, Deputy Prosecuting Attorney. I am also sending the GPS mount drawing and site-placement maps to Grant Beck, Community Development Department Director. I spoke with Grant on May 28 to answer any additional questions he might have had. It seemed his greatest concern may be the landscaping, if any is required. Regarding the timing of the installation of the GPS mount, I am hopeful that we can work out the scheduling to take place during the month of June. PANGA's contractor, PLi Systems out of Portland, Oregon, is willing to bring their equipment in on a Sunday to install the pile in order to avoid any scheduling conflicts with your site expansion building work. PLi Systems need only a couple of hours to install the pile. They believe they can install the piles for all three of the County's CORS sites the same day. The additional work of installing the PVC pipe cover around the "H" pile, trenching (by hand) for antenna conduit, mounting of the GPS control cabinet, and installation of the power can be done by the Survey Section during the week with minimal impact on your contractor, staff, and visitors. Figure 3 H-Beam Pier New Mexico State Highway and Transportation Department Albuquerque, New Mexico LICENSE AND AGREEMENT FOR CONTINUOUSLY OPERATING REFERENCE STATION (CORSI TIIIS LICENSE AND AGREEMENT is made and entered into by and between the COUNTY OF PIERCE, a political subdivision of the State of Washirigton, hereinafter referred to as "COUNTY", and Yelm Community Services/UCBO, 624 Crystal Springs Road NW, P.O. Box 5320, Yelm, WA 98597, hereinafter referred to as "Yelm Community Services". In consideration of the payments, covenants, and agreements hereinafter mentioned, to be made and performed by the parties hereto, the parties covenant and agree to the following: 1. DURATION OF LICENSE AND AGREEMENT The term of this License and Agreement shall commence upon execution by the parties on the date set forth below and continue in effect for 5 years. The COUNTY and Yelm Community Services may, upon their mutual discretion elect to extend this Agreement for FY2008 during which the terms and conditions herein shall remain in full force and effect. The extension of this Agreement for FY2009 shall be permitted with a review of ATTACHMENT A, "Fee Schedule", for inflation. 2. DESCRIPTION OF PROTECT. This License and Agreement is connection with the following: The installation, maintenance and removal of a Continuously Operating Reference Station (CORS) to be located at the easterly angle point in the fenced area abutting and lying westerly and southerly of the battered women's shelter located in the Northwesterly comer of the Yelm Community Services property, as shown on the attached map . The CORS equipment shall consist of, but not be limited to, the following: • One (1) Leica, RS 500 Geodetic Reference Station, i.e. Global Positioning System (GPS) with water tight cabinet. • One (1) CDMA compliant modem, i.e., AirLink Communications Raven modem with Yagi antenna when needed. • Battery backup equipment, providing 24 hours of battery backup. The CORS geodetic mount shall consist of the following (see attached drawing): • The base shall consist of a HP 12 x 53 "H" pile. The "H" pipe shall be placed to minimum depth of 30 feet below existing ground surface with not more than 10 feet exposed above surface. • The "H" pile shall be incased with a 15 inch diameter white PVC pipe. • The area between the "H" pile and PVC pipe will be filled with pea gravel. rK ~ ~4 ~ r • The GPS antenna will be mounted atop the "H" pile and covered with a white 15" environmental dome. The County may modify the above equipment if other equipment would better serve the purpose of the project. 3. OBLIGATIONS OF YELM COMMiJNITY SERVICES Yelm Community Services shall provide the following: • Provide space for CORS installation. • Provide electrical service to operate CORS paid for by Pierce County per SCHEDULE «A» • Avoid obstruction to access or which would interfere with the proper operation of the CORS equipment. • Provide 24 hour access for the installation, maintenance and removal of the CORS geodetic mount, GPS and cellular equipment and electrical service. 4. OBLIGATIONS OF THE COUNTY The County shall provide the following: All necessary engineering, labor, tools, materials, equipment, and administrative costs necessary to install, maintain and removal of the CORS geodetic mount, GPS and cellular equipment and electrical service. Pierce County will obtain all necessary permits for said work. Pierce County will perform all work in a professional manner and in conformance with all codes and regulations. COMPENSATION The County shall reimburse Yelm Community Services for the electricity used to operate said CORS, see SCHEDULE A, "Fee Schedule". All other compensation shall be expressed in the mutual benefits enjoyed by each party. 6. COMMENCEMENT OF WORK Time is of the essence in this Agreement. The COUNTY shall commence work within five (5) days of receipt of the Notice to Proceed from Yelm Community Services. 7. TERMINATION Either the COUNTY or Yelm Community Services may terminate this Agreement at its sole discretion upon giving 45 days notice by Certified Mail to the other, and shall only be liable for 2 the services performed until receipt thereof by the other, less any prior interim payments. Upon termination, the COUNTY shall be discharged from any and all liability hereunder. 8. INDEMNIFICATIONRND HOLD HARMLESS All services and work to be rendered or performed under tl}is Agreement will be performed and rendered entirely at the COUNTY'S risk and the COUNTY expressly agrees to hold harmless and indemnify Yelm Community Services, its elected officials, employees, agents, and representatives or otherwise from any and all claims, liability, loss, or damage(s), including costs and reasonable attorneys fees for defense of the same that Yelm Community Services may suffer as a result of claims, demands, actions, or damages to any and all persons or property, costs, or judgments against the Yelm Community Services which result from, arise out of, or are in any way connected with the work to be performed by Yelm Community Services, its agents, or employees under this Agreement. This expressly includes any and all claims by employees of Yelm Community Services or for which Yelm Community Services would have immunity under the Workers Compensation Act or any similar law. Nothing herein shall require the Yelm Community Services to indemnify and hold harmless the COUNTY from any claim or action at law or in equity based solely on the conduct of the COUNTY, its officers, agents, or employees. In the event of claims or actions arising out of the concurrent negligence of the parties hereto, this indemnification and hold harmless provision with respect to said claims or actions shall be valid and enforceable only to the extent of the negligence of the COUNTY, its agents, or employees. 9. OWNERSHIP OF MATERIALS/WORK PRODUCED Upon completion or termination of this Agreement, the Yelm Community Services shall turn over all tools, materials, and equipment of the CORS geodetic mount, GPS and cellular equipment and electrical service hereunder to the COUNTY which shall retain the exclusive ownership of said items. The COUNTY will return the site to as good condition as before installation. 10. CONFIDENTIALITY Yelm Community Services hereby acknowledges that the services provided hereunder may involve litigation of claims against or instituted by the COUNTY. All work performed hereunder by the COUNTY is strictly confidential. No disclosure of the work performed by the COUNTY shall be permitted without the prior, express written consent of the COUNTY. 11. MODIFICATION This Agreement may only be amended or modified by xhe mutual written agreement of the parties. Any amendments or modifications shall be signed by both parties and attached to this Agreement. 13. INDEPENDENT CONTRACTORS The COUNTY is and shall perform this Agreement as an independent contractor, and as such shall have and maintain complete control over all of its employees, agents, representatives and operations. Neither COUNTY nor anyone employed by it or its delegatee or subcontractors shall be or be deemed to be or act or purport to act as the agent, representative, employee, or servant of the Yelm Community Services. 14. ASSIGNMENT. DELEGATION. SUBCONTRACTING The COUNTY shall perform the terms of the LICENSE AND AGREEMENT using only its bona fide employees or agents, and the obligations and duties of the COUNTY hereunder shall not be assigned, delegated, or subcontracted to any other person or firm without notice to Yelm Community Services. 15. NONWAIVER OF RIGHTS The parties agree that the excuse or forgiveness of performance, or waiver of any provision(s) of this Agreement does not constitute a waiver of such provision(s) or future performance, or prejudice the right of the waiving party to enforce any of the provisions of this Agreement at a subsequent time. 16. LIABILITY INSURANCE The COUNTY is self-insured against any and all claims arising from or in any way related to performance under this Agreement. This shall in no way be construed to be a limitation upon the COUNTY'S duty to indemnify and hold hamiless Yelm Community Services as provided in this Agreement. 17. NON-DISCRIMINATION The COUNTY, its assignees, delegatee or subcontractors, shall not on the grounds of race, color, sex, sexual orientation, religion, national origin, creed, marital status, age, Vietnam era or disabled veteran status, or the presence of any sensory, mental or physical handicap, 4 discriminate against any person in the performance of any of its obligations hereunder, including the procurement of materials and/or leases of equipment. 18. CHOICE OF LAW This Agreement has been and shall be construed as having been made and delivered within the State of Washington, and it is agreed by each party hereto that this Agreement shall be governed by the laws of the State of Washington, both as to lts interpretation and performance. 19. JURISDICTION Any action at law, suit in equity, or judicial proceeding arising out of this Agreement shall be instituted and maintained only in any of the courts of competent jurisdiction in Pierce County, Washington. 20. SEVERABILITY The parties understand and agree that if a court holds any part, term, or provision of this Agreement to be illegal or invalid in whole or in part, the validity of the remaining provisions shall not be affected, and the parties' rights and obligations shall be construed and enforced as if the Agreement did not contain the particular invalid provision. 21. ENTIRE AGREEMENT The parties agree that this Agreement is the complete expression of the terms and conditions hereunder. This 12 L1 + 12 L2 receiver provides the best possible signal reception, satellite tracking, jamming resistance, multipath rejection and measurement quality. Data are logged at any rate from 0.1 to 60 seconds. The memory can be split into primary and secondary (ring buffer) files for simultaneous recording at different rates. Designed to operate continuously, day after day, 365 days a year, the RS500 has four RS232 ports, four power inputs, fwo event inputs and a pps port. It will operate and log data in different modes, output RTK ILeica, CMR, CMR+, RTCM) and DGPS (RTCMI, and connect to radios, phones, modems, device servers etc.. The MC500 has all the functions and capabilities of the RS500 but is housed in a heavy-duty aluminum case. The AT504 Dorne & Margolin choke-ring antenna is built to IGS standards for the most stringent requirements in national and continental networks. The AT503 lightweight choke-ring antenna may be preferred for local or regional networks. I spoke with Grant on May 28 to answer any additional questions he might have had. It seemed his greatest concern may be the landscaping, if any is required. Regarding the timing of the installation of the GPS mount, I am hopeful that we can work out the scheduling to take place during the month of June. PANGA's contractor, PLi Systems out of Portland, Oregon, is willing to bring their equipment in on a Sunday to install the pile in order to avoid any scheduling conflicts with your site expansion building work. PLi Systems need only a couple of hours to install the pile. They believe they can install the piles for all three of the County's CORS sites the same day. The additional work of installing the PVC pipe cover around the "H" pile, trenching (by hand) for antenna conduit, mounting of the GPS control cabinet, and installation of the power can be done by the Survey Section during the week with minimal impact on your contractor, staff, and visitors. I am happy to hear that the owner will install planter boxes, and would like that to be reflected on the plans. It seems that a couple of items from my original continents were missed, and need to be reflected on the plans. 1. City of Yelm Development Guidelines 4G.110.6b states that at least 40% of the trees planted in parking areas shall be evergreen, and be reasonably distributed. This was reflected in my comment #3 on the redlined copy. 2. Yelm Municipal Code 17.80.OSO.f2 states the Type V landscaping in stormwater ponds shall be consistent with the onsite landscaping. The hydro seeding of the pond slopes is reflected in the approved civil plans, however, there shall be landscaping around the perimeter of the pond. This was reflected in my comment #5. This can be accomplished by planting shrubs and evergreens around the upper comers. In this instance, because a board fence screens the northern side of the pond, the landscaping can be limited to the eastern corners, and along the western curve of the pond access road. 3. I strongly object to further development ofthis property without the fence being finished. Some 8 years or so ago when UCBO was first approved by the city, one of the stipulations was that their property be fenced with 6' chain link fencing, where it abutts my property and drive to the NE. Only about 1/4 ofthis was completed. Although not extreme, we have had problems from time to time with people from UCBO coming on our property to take a smoke break under the apple tree behind the loading dock, to say nothing of the paper etc that often blows from the dumpster area onto our property. With the expansion ofthis facilty and particularly with youngsters going to the gymnasium, I predict a significant increase in infringemint upon my property. I am sure if you look back in the records where the original approval of UCBO was granted, or for that matter check with Don Miller, you will find the fence requirement. Thrift Store and food bank: One space for each 250 sq. ft. of gross floor area for retail, with one space for each 1,000 sq. ft. of warehouse area. One loading area required -minimum area to accommodate a vehicle 45' in length, 12' in Width, and 14' in height. City of Yelm Development Guidelines requires that parking be paved. Parking plan shall be submitted with Site Plan Review. Ingress/Egress: Ingress and egress at the site shall be consistent with the Yelm Development Guidelines 48.140. Existing access is on Crystal Springs Road. No other access proposed, or allowed. Landscaping: Chapter 17.80, Type I, II, III, IV, and V. Type I landscaping is intended to provide a very dense sight barrier and physical buffer to significantly separate conflicting land uses. A minimum 15- foot Type I landscaping buffer will be required along the north and south property lines, separating the residential uses. Type II landscaping is used to provide visual separation of compatible uses. Type II landscaping is required around the perimeter of a site, which has compatible zoning and adjacent to buildings to provide visual separation of compatible use and soften the appearance of streets, parking areas and building elevation. Type II landscaping will be required on the east side of the property line, and surrounding the buildings. Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas while providing an attractive setting and overstory canopy. Type III landscaping is required as part of street frontage improvements. Type IV landscaping is used to provide visual relief and shade in parking areas. Type V landscaping is intended to provide visual relief in storm water retention/detention areas. A conceptual landscaping plan is required with application for Site Plan Review. Final landscaping and irrigation plan is required as element of civil drawings. Refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be of a material and design compatible with the overall architectural theme. If fencing is used to enclose the refuse area, it must be landscaped with sight obscuring vegetation. Traffic: The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak trip. The Ordinance provides a default table that the applicant can use to determine new pm trips generated. If the proposed use is not listed in the table, the ITE Trip Generation Manual is used. The ITE manual lists a Recreation Community Center as creating 1.75 new pm peak hour trips per 1,000 sq. ft. To determine the projects impact and fee, use the following formula for the use proposed: TFC payment is required at building permit issuance. New Trip Generation Rate x gross floor area = 1,000 x $750.00 =TFC Example: 1.75 x 11,700 = 20,475 _ 1,000 = 20.48 x $750.00 = $15,360.00 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance an analysis prepared by a Washington State Licensed Engineer can be submitted to the Ciry for review and consideration. SEPA: SEPA and NEPA Environmental review is complete Application and Process: Site Plan Review, Chapter 17.84, with environmental checklist is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 - 18 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Following land use approval, civil drawings are required. They must be submitted to the Community Development Department for review and approval, and satisfy all conditions of approval. Upon satisfactory completion of all conditions, the applicant can submit building plans for approval. OAPCA: Buildings containing asbestos and/or lead paint are potential environmental and health hazards. State and federal laws regulate the demolition of buildings containing asbestos and/or lead paint. State law (WAC 173-425) defines land clearing burning as outdoor burning of trees, stumps, shrubbery, or other natural vegetation from land clearing projects. Olympic Air Pollution Control Authority (OAPCA) issues land clearing permits for burning. The applicant shall contact the Olympic Air Pollution Control Authority, 909 Sleater-Kinney Rd SE, Suite 1, Lacey, WA 98502, (360) 438-8768 to secure any necessary permit(s) for the removal of materials containing asbestos and/or lead paint, and for land clearing burn permits. Prior to issuance of a city building permit the applicant shall demonstrate compliance with any OAPCA requirements. A sewer installation inspection fee is also required. The inspection fee is $145.00 per an ERU. Fire lanes will also need to be established per the Uniform Fire Code. There may be existing fire hydrants on this site; however, additional hydrants may be required to meet current standards. This will be determined upon further review of the civil plans. Developments with over 5,000 sq ft of impervious surface are required to provide stormwater facilities per the DOE Stormwater Manual. A preliminary Stormwater Report and conceptual plan must be submitted with land use application. Impervious area is defined as ground surface that is not able to absorb rainfall or has been disturbed from its existing state. Examples of this are concrete, asphalt, buildings, gravel and grass surfaces and any additional roadway surfaces required for this development. The current system can't be utilized for the increase of stormwater by the expansion. The current stormwater pond is located the Yelm Creek flood plain. Street Improvements: Frontage improvements shall be consistent with Yelm's Development Guidelines. You are required to improve your projects roadway frontage. Crystal Springs Road is classified as a Neighborhood Collector. This requires you to complete half street roadway improvements. These improvements may consist of asphalt widening, curb and gutter, landscape planter, street trees, sidewalk and street lighting. See the attached detail for the specifications. This street classification does not allow on-street parking. Street Lighting: Street lighting shall be installed as required per the Ciiy of Yelm Development Guidelines. The onsite parking lot lighting will be reviewed at the time of civil engineering plan review. ADA Requirements: The American Disabilities Act required that facilities are ADA accessible. The estimated trip generation for the project is found to be below threshold needed for a full traffic review as the 13 trips expected for the PM peak hour of the project does not meet the bottom threshold volumes of 20 PM peak hour trips. Nonetheless the city of Yelm is requesting a trip generation review to discern project volumes. Introduction The addition is comprised of 3,400 squaze feet of wazehousing to provide support azea for the existing food bank operation and an increase of 6,000 squaze feet to the recreation center. Both operations exist on the site and the increase in facility size will provide more complete utilization of the facilities. The trip generation presented for both uses represent the traffic expected during the busiest hour of the day for the local street system. The recreation facilities might experience higher traffic at other times, primarily weekends and later evenings, when roadway system travel is lower than the PM peak hour. Trip Generation Trip generation is used to determine the magnitude ofproject impacts on the surrounding street system. Data for this assessment was taken from the Institute of Transportation Engineers publication, Trip Generation, Sixth Edition.
