AGREEMENT WAIVER OF PROTEST AND SPECIAL POWER OF ATTORNEY (LID/ULID/LATECOMER) ~h THIS INSTRUMENT is entered into this day of 1~ , 20th , by and between the CITY OF YELM, a municipal corporation, hereinafter referred to as the "CITY", and the Yelm Adult Community Center, Fran Sherrill Director, and Reba Minton, hereinafter referred to as the "OWNER". WITNESSETH: WHEREAS, the OWNER holds record title to the following described property located within Thurston County, Washington: See Legal Description, Attachment A and WHEREAS, the CITY has required as a condition of approval of the OWNER's site plan for said property that the OWNER participate in the construction of certain utilities and/or street improvements as they directly relate to said property and the OWNER desires that said requirement be delayed until projects are formulated for the joint participation of other affected owners. NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as follows: 1. The CITY will delay its requirement for the immediate participation by the OWNER in the construction of certain utilities and/or street improvements, subject to the conditions set forth hereinafter. 2. Wa. street projects on an equitable basis with other affected property owners: Sanitary sewer system improvements; Water system improvements; X Storm water system improvements; X Street improvements; X Street lighting improvements; X Sidewalk improvements; X Street Landscaping; which improvements are more specifically described as follows: The required street fronfage improvements from the east edge of the Shoreline Jurisdiction area heading west towards Ye/m Creek, to the western property line. 3. The OWNER hereby waives all rights to protest against future Local Improvement District (LID), Utility Local Improvement District (ULID), or Latecomer Ordinance and Agreement proceedings for the construction of said improvements described in Section 2 herein. For purposes of this Instrument, "rights of protest" shall mean only those formal rights to protest contained within the LID, ULID or Latecomer Ordinance and Agreement statutes, except, however, nothing herein shall constitute a waiver by the OWNER or the OWNER's heirs, assigns or successors in interest, of the right to object to the OWNER's individual assessment amount or latecomer charge or to appeal to the Superior Court the decision of the Council affirming the final assessment roll or latecomer ordinance and agreement, which rights are specifically preserved. 4. The OWNER hereby grants and conveys to the City Engineer of the City of Yelm, or his successor in interest or designee, a Special Power of Attorney to exercise any and all rights of the OWNER, including any purchasers, mortgage holders, lien holders or other person who may claim an interest in the property described hereinabove, to accomplish the following: At such time as a Local Improvement District, Utility Local Improvement District, or Latecomer Ordinance and Agreement is proposed that would cause said improvements to be made available to the OWNER's property described hereinabove, to execute a Petition on behalf of the OWNER for the creation of such LID, ULID or Latecomer Ordinance and Agreement. This special Power of Attorney is granted in consideration of the CITY executing this Instrument, and shall be a power coupled with an interest which may not be terminated. This Special Power of Attorney shall not be affected by the disability of the OWNER. If the OWNER fails to perform in good faith in accordance with this Instrument, it is agreed that the CITY may discontinue utility service to the property described herein, after giving 20 days notice thereof and an opportunity for hearing thereon, or may pursue other equitable or legal remedies. 6. The OWNER hereby declares that they are the sole owners of the property described herein and have full power to commit said property to this Agreement, Waiver of Protest and Special Power of Attorney. 7. This Instrument constitutes a covenant running with the land and shall be finding on all heirs, assigns, transferees, and successors in interest. 8. For purposes of RCW 35.43.182, and any LID or ULID thereunder, the effective term of this Instrument shall be a period of ten years from the date hereof. For purposes of RCW 35.72 and RCW 35.91, and any Latecomer Ordinance and Agreement thereunder, the effective term of this Instrument shall be a period of fifteen years from the date such an Ordinance and Agreement becomes effective. Landscaping is not complete. They have many areas that are still dirt and gravel, many plants sitting around in pots. The main areas that I remember are the planter/grass areas around the building, and the grass in the large planter area adjacent to 103~d. The sidewalk has not been backfilled in this area, the completion of the landscaping will provide the back fill for the sidewalk. The recycle container must be contained within the refuse enclosure, it may not be left in the parking lot. Gravel parking is not allowed. At both the east and west end of the buildings, gravel has been laid to what appears to be a parking area. Box 757 Yelm, WA 98597 SUMMARY OF REQUEST: The applicant is applying for a special use permit to construct a 6,000 square foot senior multipurpose center within the city limits of Yelm. SUMMARY OF DECISION: Request granted, subject to conditions. PUBLIC HEARING: After reviewing Planning and Community Development Staff Report and examining available information on file with the application, the Examiner conducted a public hearing on the request as follows: The hearing was opened on September 29, 2003. Parties wishing to testify were sworn in by the Examiner. The following exhibits were submitted and made a part of the record as follows: i EXHIBIT "1" - Planning and Community Development Staff Report and Attachments TAMI MERRIMAN appeared, presented the Community Development Department Staff Report, and testified that funding for the project comes from a block grant. The City administers the funds as a clearing house. The applicant will construct a 3,000 square foot building, but the hearing will consider the eventual 6,000 square foot structure. The City reviewed the environmental impacts of the project under SEPA and NEPA and issued a FONSI and DNS. The site has a lot of environmental issues. The applicable R-6 zone -2- classification authorizes the senior center subject to a conditional use permit. Yelm Creek with its associated wetlands and flooplains crosses the southwest corner of the site. The applicant found the original plan costly and scaled it back. The original plan showed a larger fire lane, two entrances, and significant landscaping. Additional costs included storm water retention and treatment. The proposed landscaping was very expensive and exceeded City standards. The revised plan shows one access and smaller fire lanes. The entire project is outside of the shoreline jurisdiction of Yelm Creek, and no construction will occur within the floodplain. The City will defer certain road improvements for 103`d as it has a plan to improve said road. The applicant will attach the sewer line beneath the bridge over the creek. The number of parking spaces exceeds code requirements. The storm water detention and pond swales are located near the center. The applicant will provide a 15 foot wide buffer along the east property line as it abuts a single family dwelling. City transportation charges are based on square footage, and the City will calculate those charges at the completion of construction when it can measure the final size. Appearing was FRAN SHERRELL, executive director of the center, who testified that they will construct a 5,400 square foot building per phase with a total of 10,000 square feet. Appearing was GRANT BECK who testified that Ms. Sherrell's testimony proposes a structure different from the notice. However, the new structure will not increase the amount of impervious coverage. MS. MERRIMAN testified that the code grants parking allowances for the use of buses and vans, and that the parking lot can provide 25% compact spaces. The site also has additional room for more parking. Reappearing was MS. SHERRELL who testified that she has no problems with conditions of approval. No one spoke further in this matter and so the Examiner took the request under advisement and the hearing was concluded. NOTE: A complete record of this hearing is available in the City of Yelm Community Development Department FINDINGS, CONCLUSIONS AND DECISION: FINDINGS: The Hearing Examiner has admitted documentary evidence into the record, heard testimony, and taken this matter under advisement. 2. The City has performed an environmental review, to include SEPA and NEPA, and -3- issued a Finding of No Significant Impact on August 22, 2003, with a commend deadline of September 5, 2003, and an appeal deadline of September 12, 2003. 4. The applicant has a possessory ownership interest in an irregularly shaped parcel of property abutting the north side of 103~d Avenue SE, northeast of its intersection with Creek Street. The parcel abuts 103~d Avenue for 500 linear feet and measures 365 feet in depth. The applicant requests a conditional use permit to authorize construction of a10,000 square foot, senior multipurpose center and associated parking. 5. The site plan shows present improvements consisting of a barn, shed, and concrete pad in the central portions of the site. The applicant will remove all improvements and construct the multipurpose center in the northcentral portion of the site in two phases. Phase 1 will consist of a rectangular, 5,400 square foot building, and Phase 2 will connect onto the south side of Phase 1 and will expand the building to a total of 10,000 square feet. The site plan shows 62 parking spaces to include four handicapped spaces located south of the building. A single access extending north from 103rd Avenue E. near the east property line provides access to the parking area and also to an emergency vehicle access drive circling the building. 6. Yelm Creek, designated as a shoreline by the City shoreline regulations, bisects the southwest corner of the parcel and flows beneath 103`d Avenue in a boxed culvert. While Yelm Creek has an associated floodplain and wetlands, no development will occur within the shoreline jurisdiction or wetland buffers. The applicant will demolish and remove existing improvements which include an uninhabitable mobile home and dilapidated water tower. 7. The site is located within the Moderate Density Residential (R-6) zone classification of the Yelm Municipal Code (YMC). Said classification has no minimum lot size requirements, but all buildings must meet the setbacks of five foot side yard with a total of 12 feet on both sides, 25 foot rear yard, and 15 foot front yard with a minimum 20 foot driveway approach. The parcel abutting the north property line is located within the Open Space/Institutional (OS) zone classification and improved with an elementary school. Parcels abutting the east and southeast portions of the site are located within the RR 1-5 classification in unincorporated Thurston County and improved with residential uses. Parcels to the southwest are located in the Heavy Commercial (C2) classification and improved with apartments and a plumbing business. The property abutting the west property line is located within the Commercial (C1) classification and improved with a church. The proposed senior center will fit well with the existing mixed uses in the area. 8. The site plan shows the required 15 foot wide, dense, landscape buffer on the east property line abutting residential uses. No development will occur on the western -4- portion of the site within 200 feet of Yelm Creek, listed as a shoreline of the State. Wetlands and wetland buffer areas associated with the creek will remain undisturbed and in their natural state. No construction will occur nor fill placed in flood zone areas. The applicant will extend a City sewer line east along 103rd Avenue E. to the site and will cross Yelm Creek by attaching it to the bottom of the existing culvert/bridge. The City reviewed the crossing pursuant to SEPA/NEPA environmental review and determined that the bridge crossing will create no adverse environmental impacts. The Washington Administrative Code (WAC) exempts the bridge crossing from the requirements of an Hydraulic Project Approval (HPA) and from shoreline management. 9. The City of Yelm Development Guidelines list 103`d Avenue as a local access residential street which has the capacity to serve traffic generated by the center. However, new developments burden the City's central streets, and the applicant must mitigate its traffic impacts. The Institute of Transportation Engineer's Manual, 5th Edition (ITE) provides that a recreational facility generates 1.75 new p.m. peak trips per 1,000 square feet of area. The City's transportation facility charge currently equals $750 per new p.m. peak trip and is payable at building permit issuance. The City will determine the proper charge based upon the square footage of the building. 10. Chapter 15.40 YMC requires the applicant to upgrade 103`d Avenue SE to City standards for utilities, curbs, gutters, sidewalks, and bicycle lanes. 103`d Avenue crosses Yelm Creek on a small bridge which abuts the site. Conditions require the applicant to improve 103`d Avenue E. with the exception of the 103`d Avenue bridge which the City intends to widen. The City will defer the improvements of the portion of the road leading to the bridge to the time of the bridge improvement project. 11. Chapter 17.72 YMC sets forth the off-street parking and loading requirements, but does not list a senior center as a specific use. This nearest category is "places of assembly without fixed seats", and such uses require one parking stall per ten occupants. The maximum occupancy of a 6,000 square foot facility calculates to 400 persons which requires 40 parking stalls. As previously found, the site plan shows 62 parking stalls, but the applicant now proposes a 10,000 square foot building. However, the site has more than sufficient room to provide additional parking. In addition, the applicant would qualify for a reduced number of parking spaces based upon its vans and buses which transport some seniors to and from the center. The applicant can also provide compact parking spaces within the presently proposed parking area. The site can provide adequate parking for a 10,000 square foot structure. 12. While the parcel is located within the City's water service area, it presently has no connection to the City water system. Conditions of approval require the applicant to connect to an existing six inch water line currently installed in 103` Avenue. Such -s- will assure provision of both domestic water and fire flow to the site. 13. The site is located within the City sewer comprehensive plan, and as previously found, the applicant must extend a sewer line east on 103`d Avenue to the site to provide sanitary sewer service. 14. The impervious surfaces created by development of the site will increase storm water runoff and the applicant must construct a storm water drainage system which will accommodate the quantity of runoff and also maintain the quality of the runoff in accordance with City storm water manual requirements. 15. The building must meet the requirements of the Uniform Fire Code to include specifications for fire hydrants, fire lanes, or sprinkler systems. 16. In accordance with Section 17.80.030(6) YMC, the applicant will provide a 15 foot wide, Type 1 landscape buffer along the eastern property line to buffer existing residential uses. CONCLUSIONS: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. The request for a special (conditional) use permit satisfies all criteria set forth in Chapter 17.66 YMC. The senior center will provide a needed service to senior citizens, is located in a convenient area, and will have an appropriate size and scale. The setbacks and buffers will ensure minimal, if any, adverse impacts to adjacent properties and to the community as a whole. 3. The project provides for the public health, safety, and general welfare and also conforms with the Yelm-Thurston County Joint Comprehensive Plan, the City zoning ordinance, and the City's development and design guidelines. Therefore, the special use permit should be approved subject to the following conditions: Transportation: 1. The applicant shall mitigate transportation impacts based on the new p.m. peak hour trips generated by the project. The Transportation Facility Charge (TFC) shall be based on the square footage of the building at building permit issuance. 2. The applicant shall make on-site and frontage improvements consistent -6- with City standards. Improvements for 103~d Avenue shall be consistent with the City of Yelm Development Guidelines fora "Local Access Residential Street", and shall be installed from the eastern property line west to approximately 200 feet east of the bridge over Yelm Creek. Remaining improvements shall be deferred. Parking: 3. The applicant shall provide for a minimum of 30 parking stalls on site. 4. The applicant shall provide for handicap parking stalls as required by ADA. 5. Parking areas shall be landscaped consistent with Chapter 17.80, Landscaping, and City of Yelm Development and Design Guidelines. 6. The applicant may phase their parking improvements to concur with building phases, meeting minimum requirements. Water: 7. The applicant shall. connect to the City water system. Water ERU's are based on a consumption rate of 240 gallons per day and are charged a current rate of $1,500 (fee subject to change) inside City limits. The number of ERU's required for this project shall be determined by calculations provided by the applicant, and approved by the Community Development Department. 8. Water connection fees shall be paid at building permit issuance. Wastewater: 9. The applicant must connect to the City sewer system. Sewer ERU's are based on the on the water calculations provided by the applicant, and reviewed and approved by the Community Development Department. ERU's are based on a discharge of 240 gallons per day. The current rate for one ERU in the LID is $2,620.00.00 (fee subject to change). 10. The sewer main shall be extended along the frontage of the site, from the corner of 103~d Avenue and Creek Street to the eastern property corner. -7- 11. Sewer connection fees are payable at building permit issuance. Drainage/Stormwater: 12. The applicant shall design and construct all Stormwater facilities in accordance with the DOE Manual, as adopted by the City of Yelm. Best Management Practices are required during and post construction. 13. Stormwater areas shall be landscaped consistent with Chapter 17.80, Landscaping, and City of Yelm Development and Design Guidelines. 14. The applicant shall submit a final stormwater report with civil plan application. 15. The applicant shall submit a storinwater maintenance plan with civil plan application. 16. The applicant shall provide a blanket easement for maintenance of all utilities deeded to the City, and access to the Stormwater facility. Landscaping. Development Guidelines, and Design Guidelines: 17. The applicant shall provide fora 15' dense "Type I" landscape buffer along the eastern property line, adjacent to the residential uses. 18. An 8-foot, Type II landscaping is required along the north and west property line. A 5-foot Type II landscaping is required around the buildings. 19. Type III landscaping is required as part of the frontage improvements. 20. Type IV landscaping is required in parking areas. 21. Type V landscaping is required in Stormwater retention facilities. 22. The applicant shall submit a final landscape and irrigation plan, pursuant to Chapter 17.80, to the Community Development Department for review and approval. -8- 23. Completed landscaping shall be approved by the Community Development Department prior to building occupancy. Refuse: 24. Refuse container screening shall be required, and be of a material and design compatible with the overall architectural theme of the associated structure, shall be at least as high as the refuse container, and shall in no case be less than six feet high, with a gated enclosure. 25. No refuse container shall be permitted between a street and the front of a building. 26. Refuse collection areas shall be designed to contain all refuse generated on site and deposited between collections. Deposited refuse shall not be visible from outside the refuse enclosure. DECISION: The request for a special use permit to allow construction of a 10,000 +/- square foot, senior multipurpose center at a site located at 13530 103`d Avenue SE is hereby granted subject to the conditions contained in the conclusions above. Box 757 Yelm, WA 98597 SUMMARY OF REQUEST: The applicant is applying for a special use permit to construct a 6,000 square foot senior multipurpose center within the city limits of Yelm. SUMMARY OF DECISION: Request granted, subject to conditions. PUBLIC HEARING: After reviewing Planning and Community Development Staff Report and examining available information on file with the application, the Examiner conducted a public hearing on the request as follows: The hearing was opened on September 29, 2003. Parties wishing to testify were sworn in by the Examiner. The following exhibits were submitted and made a part of the record as follows: EXHIBIT "1" - Planning and Community Development Staff Report and Attachments TAMI MERRIMAN appeared, presented the Community Development Department Staff Report, and testified that funding for the project comes from a block grant. The City administers the funds as a clearing house. The applicant will construct a 3,000 square foot building, but the hearing will consider the eventual 6,000 square foot structure. The City reviewed the environmental impacts of the project under SEPA and NEPA and issued a FONSI and DNS. The site has a lot of environmental issues. The applicable R-6 zone -2- classification authorizes the senior center subject to a conditional use permit. Yelm Creek with its associated wetlands and flooplains crosses the southwest corner of the site. The applicant found the original plan costly and scaled it back. The original plan showed a larger fire lane, two entrances, and significant landscaping. Additional costs included storm water retention and treatment. The proposed landscaping was very expensive and exceeded City standards. The revised plan shows one access and smaller fire lanes. The entire project is outside of the shoreline jurisdiction of Yelm Creek, and no construction will occur within the floodplain. The City will defer certain road improvements for 103~d as it has a plan to improve said road. The applicant will attach the sewer line beneath the bridge over the creek. The number of parking spaces exceeds code requirements. The storm water detention and pond swales are located near the center. The applicant will provide a 15 foot wide buffer along the east property line as it abuts a single family dwelling. City transportation charges are based on square footage, and the City will calculate those charges at the completion of construction when it can measure the final size. Appearing was FRAN SHERRELL, executive director of the center, who testified that they will construct a 5,400 square foot building per phase with a total of 10,000 square feet. Appearing was GRANT BECK who testified that Ms. Sherrell's testimony proposes a structure different from the notice. However, the new structure will not increase the amount of impervious coverage. MS. MERRIMAN testified that the code grants parking allowances for the use of buses and vans, and that the parking lot can provide 25% compact spaces. The site also has additional room for more parking. Reappearing was MS. SHERRELL who testified that she has no problems with conditions of approval. No one spoke further in this matter and so the Examiner took the request under advisement and the hearing was concluded. NOTE: A complete record of this hearing is available in the City of Yelm Community Development Department FINDINGS, CONCLUSIONS AND DECISION: FINDINGS: The Hearing Examiner has admitted documentary evidence into the record, heard testimony, and taken this matter under advisement. 2. The City has performed an environmental review, to include SEPA and NEPA, and -3- issued a Finding of No Significant Impact on August 22, 2003, with a commend deadline of September 5, 2003, and an appeal deadline of September 12, 2003. 4. The applicant has a possessory ownership interest in an irregularly shaped parcel of property abutting the north side of 103~d Avenue SE, northeast of its intersection with Creek Street. The parcel abuts 103~d Avenue for 500 linear feet and measures 365 feet in depth. The applicant requests a conditional use permit to authorize construction of a10,000 square foot, senior multipurpose center and associated parking. 5. The site plan shows present improvements consisting of a barn, shed, and concrete pad in the central portions of the site. The applicant will remove all improvements and construct the multipurpose center in the northcentral portion of the site in two phases. Phase 1 will consist of a rectangular, 5,400 square foot building, and Phase 2 will connect onto the south side of Phase 1 and will expand the building to a total of 10,000 square feet. The site plan shows 62 parking spaces to include four handicapped spaces located south of the building. A single access extending north from 103~d Avenue E. near the east property line provides access to the parking area and also to an emergency vehicle access drive circling the building. 6. Yelm Creek, designated as a shoreline by the City shoreline regulations, bisects the southwest corner of the parcel and flows beneath 103` Avenue in a boxed culvert. While Yelm Creek has an associated floodplain and wetlands, no development will occur within the shoreline jurisdiction or wetland buffers. The applicant will demolish and remove existing improvements which include an uninhabitable mobile home and dilapidated water tower. 7. The site is located within the Moderate Density Residential (R-6) zone classification of the Yelm Municipal Code (YMC). Said classification has no minimum lot size requirements, but all buildings must meet the setbacks of five foot side yard with a total of 12 feet on both sides, 25 foot rear yard, and 15 foot front yard with a minimum 20 foot driveway approach. The parcel abutting the north property line is located within the Open Space/Institutional (OS) zone classification and improved with an elementary school. Parcels abutting the east and southeast portions of the site are located within the RR 1-5 classification in unincorporated Thurston County and improved with residential uses. Parcels to the southwest are located in the Heavy Commercial (C2) classification and improved with apartments and a plumbing business. The property abutting the west property line is located within the Commercial (C1) classification and improved with a church. The proposed senior center will fit well with the existing mixed uses in the area. 8. The site plan shows the required 15 foot wide, dense, landscape buffer on the east property line abutting residential uses. No development will occur on the western -4- portion of the site within 200 feet of Yelm Creek, listed as a shoreline of the State. Wetlands and wetland buffer areas associated with the creek will remain undisturbed and in their natural state. No construction will occur nor fill placed in flood zone areas. The applicant will extend a City sewer line east along 103`d Avenue E. to the site and will cross Yelm Creek by attaching it to the bottom of the existing culvert/bridge. The City reviewed the crossing pursuant to SEPA/NEPA environmental review and determined that the bridge crossing will create no adverse environmental impacts. The Washington Administrative Code (WAC) exempts the bridge crossing from the requirements of an Hydraulic Project Approval (HPA) and from shoreline management. 9. The City of Yelm Development Guidelines list 103`d Avenue as a local access residential street which has the capacity to serve traffic generated by the center. However, new developments burden the City's central streets, and the applicant must mitigate its traffic impacts. The Institute of Transportation Engineer's Manual, 5th Edition (ITE) provides that a recreational facility generates 1.75 new p.m. peak trips per 1,000 square feet of area. The City's transportation facility charge currently equals $750 per new p.m. peak trip and is payable at building permit issuance. The City will determine the proper charge based upon the square footage of the building. 10. Chapter 15.40 YMC requires the applicant to upgrade 103rd Avenue SE to City standards for utilities, curbs, gutters, sidewalks, and bicycle lanes. 103`d Avenue crosses Yelm Creek on a small bridge which abuts the site. Conditions require the applicant to improve 103`d Avenue E. with the exception of the 103rd Avenue bridge which the City intends to widen. The City will defer the improvements of the portion of the road leading to the bridge to the time of the bridge improvement project. 11. Chapter 17.72 YMC sets forth the off-street parking and loading requirements, but does not list a senior center as a specific use. This nearest category is "places of assembly without fixed seats", and such uses require one parking stall per ten occupants. The maximum occupancy of a 6,000 square foot facility calculates to 400 persons which requires 40 parking stalls. As previously found, the site plan shows 62 parking stalls, but the applicant now proposes a 10,000 square foot building. However, the site has more than sufficient room to provide additional parking. In addition, the applicant would qualify for a reduced number of parking spaces based upon its vans and buses which transport some seniors to and from the center. The applicant can also provide compact parking spaces within the presently proposed parking area. The site can provide adequate parking for a 10,000 square foot structure. 12. While the parcel is located within the City's water service area, it presently has no connection to the City water system. Conditions of approval require the applicant to connect to an existing six inch water line currently installed in 103`d Avenue. Such -5- will assure provision of both domestic water and fire flow to the site. 13. The site is located within the City sewer comprehensive plan, and as previously found, the applicant must extend a sewer line east on 103`d Avenue to the site to provide sanitary sewer service. 14. The impervious surfaces created by development of the site will increase storm water runoff and the applicant must construct a storm water drainage system which will accommodate the quantity of runoff and also maintain the quality of the runoff in accordance with City storm water manual requirements. 15. The building must meet the requirements of the Uniform Fire Code to include specifications for fire hydrants, fire lanes, or sprinkler systems. 16. In accordance with Section 17.80.030(B) YMC, the applicant will provide a 15 foot wide, Type 1 landscape buffer along the eastern property line to buffer existing residential uses. CONCLUSIONS: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. The request for a special (conditional) use permit satisfies all criteria set forth in Chapter 17.66 YMC. The senior center will provide a needed service to senior citizens, is located in a convenient area, and will have an appropriate size and scale. The setbacks and buffers will ensure minimal, if any, adverse impacts to adjacent properties and to the community as a whole. 3. The project provides for the public health, safety, and general welfare and also conforms with the Yelm-Thurston County Joint Comprehensive Plan, the City zoning ordinance, and the City's development and design guidelines. Therefore, the special use permit should be approved subject to the following conditions: Transportation: 1. The applicant shall mitigate transportation impacts based on the new p.m. peak hour trips generated by the project. The Transportation Facility Charge (TFC) shall be based on the square footage of the building at building permit issuance. 2. The applicant shall make on-site and frontage improvements consistent -6- with City standards. Improvements for 103~d Avenue shall be consistent with the City of Yelm Development Guidelines fora "Local Access Residential Street", and shall be installed from the eastern property line west to approximately 200 feet east of the bridge over Yelm Creek. Remaining improvements shall be deferred. Parkin 3. The applicant shall provide for a minimum of 30 parking stalls on site. 4. The applicant shall provide for handicap parking stalls as required by ADA. 5. Parking areas shall be landscaped consistent with Chapter 17.80, Landscaping, and City of Yelm Development and Design Guidelines. 6. The applicant may phase their parking improvements to concur with building phases, meeting minimum requirements. Water: 7. The applicant shall connect to the City water system. Water ERU's are based on a consumption rate of 240 gallons per day and are charged a current rate of $1,500 (fee subject to change) inside City limits. The number of ERU's required for this project shall be determined by calculations provided by the applicant, and approved by the Community Development Department. 8. Water connection fees shall be paid at building permit issuance. Wastewater: 9. The applicant must connect to the City sewer system. Sewer ERU's are based on the on the water calculations provided by the applicant, and reviewed and approved by the Community Development Department. ERU's are based on a discharge of 240 gallons per day. The current rate for one ERU in the LID is $2,620.00.00 (fee subject to change). 10. The sewer main shall be extended along the frontage of the site, from the corner of 103`d Avenue and Creek Street to the eastern property corner. -~- 11. Sewer connection fees are payable at building permit issuance. Drainage/Stormwater: 12. The applicant shall design and construct all Stormwater facilities in accordance with the DOE Manual, as adopted by the City of Yelm. Best Management Practices are required during and post construction. 13. Stormwater areas shall be landscaped consistent with Chapter 17.80, Landscaping, and City of Yelm Development and Design Guidelines. 14. The applicant shall submit a final Stormwater report with civil plan application. 15. The applicant shall submit a stormwater maintenance plan with civil plan application. 16. The applicant shall provide a blanket easement for maintenance of all utilities deeded to the City, and access to the Stormwater facility. Landscaping, Development Guidelines, and Design Guidelines: 17. The applicant shall provide fora 15' dense "Type I" landscape buffer along the eastern property line, adjacent to the residential uses. 18. An 8-foot, Type II landscaping is required along the north and west property line. A 5-foot Type II landscaping is required around the buildings. 19. Type III landscaping is required as part of the frontage improvements. 20. Type IV landscaping is required in parking areas. 21. Type V landscaping is required in Stormwater retention facilities. 22. The applicant shall submit a final landscape and irrigation plan, pursuant to Chapter 17.80, to the Community Development Department for review and approval. -8- 23. Completed landscaping shall be approved by the Community Development Department prior to building occupancy. Refuse: 24. Refuse container screening shall be required, and be of a material and design compatible with the overall architectural theme of the associated structure, shall be at least as high as the refuse container, and shall in no case be less than six feet high, with a gated enclosure. 25. No refuse container shall be permitted between a street and the front of a building. 26. Refuse collection areas shall be designed to contain all refuse generated on site and deposited between collections. Deposited refuse shall not be visible from outside the refuse enclosure. I have eliminated the costs for street light design and checking the trip generation calculations. However, it is not possible to eliminate the soils testing as the City stated. Determining the high water level and soil infiltration rates are critical to designing a storm system that works. It is not sound engineering to use guess work on such a cn6cal issue and is aM+ays required per state design guidelines. Regarding the STEP calculations, the cities comments referred to estimatlng the sewer use of the new senior center for sizing of the STEP tank. I had already included that in my original proposal. I have also enclosed a proposal for the necessary wetland biologist work for the project. Box 757 Yelm, WA 98597 Proposal: The applicant is applying fior a Special Use Permit to construct a 6,000 square foot Senior Multipurpose Center within the city limits of Yelm. The project will occur in two phases, with approximately 3,000 square feet being built at this time. The project is being reviewed in its entirety to assure that when the Senior Center is ready to complete their second phase of construction, all approvals shall be in place. Public Notice of the date and time of the Public Hearing was posted on the project site, mailed to property owners within 300 feet of the project site on September 16, 2003, and advertised in the local newspaper on September 19, 2003. The City has pertormed an environmental review, to include SEPA and NEPA, and issued a Finding of No Significant Impact on August 22, 2003, with a comment deadline of September 5, 2003, and an appeal deadline of September 12, 2003. Summary: Staff recommends approval of the proposal, subject to the conditions listed in this report. DEPARTMENT ANALYSIS AND FINDINGS: 1. Public Notice: Notice of the public hearing was published in the Nisqually Valley News on Friday, September 19, 2003, and posted in public areas on Wednesday, September 17, 2003. The notice was mailed to adjacent property owners, and the applicant on September 17, 2003. The City of Yelm is an Equal Opportunity Provider 2. Existing Land Use and Zoning. Finding: The site is zoned Moderate Density Residential, (R-6), YMC Chapter 17.15. In the R-6 zone, Special Uses are allowed as provided for in Chapter 17.66, Special Uses. Conclusion: A Senior citizen center is classified as a special use and is allowed in any zoning district provided any unique impacts resulting from the proposal can be mitigated. 3. Lot Size and Setbacks: Finding: This property was used residential in the past, however at this time, the property is vacant. There is located on site an uninhabitable mobile home, and a dilapidated water tower. In April 2003 the Washington State Office of Archaeology and Historic Preservation deemed that the water tower was not eligible for the National Register of Historic Places, and the City does not have the water tower listed as an historic site. Both the mobile home and water tower will be demolished and removed from the site. The R-6 zone does not have a minimum lot size requirement, however all buildings must meet required setbacks. The setbacks for the R-6 zone are; a minimum of 5-feet on side yards with a minimum total of both sides 12-feet, 25-feet on rear yards, and front yards 15-feet with a minimum of 20-foot driveway approach. The maximum height of buildings shall be 35 feet. Conclusion: The proposal meets current minimum setbacks and lot size requirements. 4. Adjacent Land Uses and Zoning. Findin The property to the north is zoned OS, Open Space/Institutional District, and is developed as an elementary School. The properties to the east, and southeast are zoned RR 1/5, are in residential use, and are not within City Limits. The properties to the southwest are zoned C-2, Heavy Commercial to include residential apartments, and a plumbing business. The property to the west is zoned C-1 Commercial, and is improved as a church site. Conclusion: There is a mixture of uses of the surrounding properties. Where there are residential uses, a 15-foot dense landscape buffer will be required. This is reflected in the landscaping section. Perimeter site landscaping, Yelm Creek, or 103rd Avenue will separate the other commercial uses. 5. Environmental and Shoreline. Finding: The applicant is constructing this facility and site improvements with funds received through a Community Development Block Grant. This funding source requires projects to perform both a State Environmental Policy Act (SEPA) environmental review and a R:\Project Files\CUP Conditional Use Permit\8336 Senior Center\1Hearing Examiner Staff Report.doc Page 2 of 9 National Environmental Policy Act (NEPA) environmental review. The City performed both the SEPA and NEPA environmental review as required, and has issued a Finding of No Significant Impact on August 22, 2003. This finding was mailed to interested parties, state agencies, and published in the local paper. Findin The project site is bisected in the southwest corner by Yelm Creek, which is listed as a Shoreline of the State. Findin All of the site improvements are situated outside of the Shoreline Jurisdiction area, and the shoreline jurisdiction area will be left undisturbed and in its natural state. Finding: All of the site improvements are situated outside of wetland buffers and flood zones. Wetland and wetland buffer areas will be left undisturbed in and their natural state. No construction or fill will be placed in flood zone areas. Findin The applicant is required to extend a City sewer service line along the frontage of their property, which requires a conduit crossing under an existing bridge over Yelm Creek. Conclusion: The City has performed an environmental review, issuing a Finding of No Significant Impact. The project is outside of the Shoreline Jurisdiction area, and does not require a shoreline substantial development permit. The project meets wetland buffer requirements. The project will not construct or place any fill in flood zone areas. The sewer line bridge conduit crossing was reviewed in the SEPA/NEPA environmental review, and deemed to create no impact. The sewer line bridge conduit crossing is exempt from Hydraulic Project Approval, Section 220-110-100 WAC. The sewer line bridge conduit crossing is exempt from Shoreline Management, Section 173-27- 040(2)(b) WAC. 6. Transportation and Site Access. Finding: Yelm is a small compact community most directly affected by two state highways which bisect the community. The two state highways are used by local residents for transportation throughout the city and for access to commercial and residential areas throughout the community. In lieu of widening existing streets, the City has elected to create certain alternatives, Y-1, Y-2, Y-3, which will avoid the need to significantly widen R:\Project Files\CUP Conditional Use Permit\8336 Senior Cen[er\1Hearing Examiner Staff Report.doc P2ge 3 of 9 existing streets, and particularly Yelm Avenue. New developments do in fact burden the city's central streets, and unless the bypass alternatives are accomplished, the City would have to require developers to pay the cost of the internal street widening. The city plans show, and the City finds that adequate facilities will be accomplished better and in a timely fashion by bypass facilities as a substitute for the widening of existing facilities. As a result, the City finds that the regional plans benefit projects in all areas of the City and will accomplish the goal of providing adequate facilities to City standards within a reasonable time to serve the demands created by the proposed project. Findin The project fronts on 103rd. Avenue, east of Creek Street. This portion of 103rd Avenue is listed as a Local Access Residential street in the City of Yelm Development Guidelines. Finding: The City of Yelm 2001 Comprehensive Transportation Plan Update lists Goals and Policies relating to transportation impacts. #30. Funding Sources Policy provides methods for financing transportation projects, and includes a policy that "requires impact mitigation payments, or seek voluntary contributions from developers". Findin The City of Yelm Concurrency Management Code also describes mitigation measures for impacts to the City's transportation system by requiring the project to make a contribution to the facilities identified in off-site comprehensive transportation plan, in the form of a transportation facility charge. The ordinance lists new trip rates for land uses. If the ordinance does not list the proposed use, the City refers to the Institute of Transportation Engineers Manual, 5fh Edition, (ITE). The ITE manual also did not list a senior center. After researching this manual, it was determined that the closest use is a "Recreational Facility" (495). The ITE manual states that a recreational facility creates 1.75 new pm peak trips, per 1,000 square feet. To determine the projects impact and fee, the City uses a formula based on square footage for the use proposed. Using this formula, the number of new pm peak trips generated by a 6,000 square foot Senior Center is 10.5. The Transportation Facility Charge is currently $750.00 per new pm peak trip, and is payable at building permit issuance. The Transportation Facility Charge will be based on the square feet being constructed. Findin Chapter 15.40 Concurrency Management provides for mitigation measures for impacts to the City's transportation system. Chapter 15.40.020(5)(x) states that "The project makes on-site, and frontage improvements, consistent with City standard for u#ilities, curbs, gutters, sidewalks, bicycle lanes where appropriate, and roads necessary to serve the proposed project consistent with safety and public interest. Frontage improvements are usually required for the entire property frontage. Findin This site is bisected by Yelm Creek. 103rd Avenue has a small bridge over Yelm Creek. R:\Project Files\CUP Conditional Use Permit\8336 Senior Center\1Hearing Examiner Staff Report.doc Page 4 of 9 It was determined that the frontage improvements for this project shall not include improvements to the 103rd Avenue bridge, and the amount of road leading to the bridge that would be part on bridge improvements shall be deferred. Conclusion: The construction of this project will create impacts to the existing traffic system. The City of Yelm has created mitigation measures through its Municipal Code, Comprehensive Transportation Plan, and Development Guidelines. 7. Parking. Finding: Chapter 17.72, Off-Street Parking and Loading provide guidelines for parking requirements. Chapter 17.72 does not list a senior center as specific use; it does however provide guidelines for places of assembly without fixed seats. This use was determined to be the closest to a senior center. This type of occupancy requires 1 stall for each 10 occupants. Fora 6,000 square foot facility, a maximum occupancy is approximately 400, which requires forty (40) parking stalls. Findin Chapter 17.72, Off-Street Parking states; The requirements for off-street parking and loading facilities and their design shall be regarded as the minimum; however, the owner, developer, or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises, even though such space is in excess of the minimum set forth in this chapter. Findin The facility has it's own transportation van to transport some seniors to and from the center. Chapter 17.72.090, Incentives for reducing the number of parking stalls, allows fora 25% reduction in parking stall requirements when a private vanpool operation is provided by the development. Conclusion: Off-street parking shall be provided on site. Number of stalls may be reduced by 25%. 8. Water Supply. Findin The City's Water Comprehensive Plan identifies a portion of the City area for service. The City is pursuing additional land areas for approval and the extension of facilities. Completion of such activities is dependent on grant and developer funding, as well as planned bonding and existing public funds. The status of such plans and funding sources must be considered in any review of concurrency. Developer extensions and or dedications, latecomer agreements, oversizing agreements, and the creation of local improvement districts may all be considered. In the event of a new funding source, however, concurrency is not found until the funding source is in fact in pace - e.g. award of a grant, a binding letter commitment for third parting funding, or the successful R:\Projec[ Files\CUP Conditional Use Permit\8336 Senior Center\1Hearing Examiner Staff Report.doc Page 5 Of 9 formation of a local improvement district. Any necessary water rights are considered, only after approved for municipal use by the Washington State Department of Ecology, or appropriate appeals board, and the time for appeal or challenge has expired. Finding: The site is in the City's water service area but is currently not connected to the City's Water system. The applicant is required to connect to the existing 6-inch water line that is currently installed in 103~d Avenue. Connection charges are based on water consumption. One connection is based on a consumption rate of 240 gallons per day. This connection is referred to as an "ERU". Conclusion: The proposed development to this site creates an impact on the City's water system. 9. Wastewater: Finding: The city's Sewer Comprehensive Plan identifies a portion of the City area for service. The City is pursuing additional land areas for approval and the extension of facilities. Completion of such activities is dependent on grant and developer funding, as well as planned bonding and existing public funds. The status of such plans and funding sources must be considered in any review of concurrency. Developer extensions and or dedications, latecomer agreements, oversizing agreements, and the creation of local improvement districts may all be considered. In the event of a new funding source, however, concurrency is not found until the funding source is in fact in place - e.g. award of a grant, a binding letter commitment for third parting funding, or the successful formation of a local improvement district. Finding: The site is not currently connected to the City sewer system. Sewer ERU's are based on water consumption. The property is assessed for sewer ERU's through a City LID. Participation in the LID provides a reduced cost for sewer connection. Conclusion: The proposed development to this site creates an impact on the City's sewer system. 10. Drainage/Stormwater: Findmg: The completed project will increase the amount of impervious surface on the site, and on the adjacent streets. Impervious surfaces create stormwater runoff. Uncontrolled and untreated stormwater runoff can create health and safety hazards. YMC requires all development to comply with the adopted City Stormwater Manual. 11.Fire Finding: Fire protection to the buildings must be provided per the Uniform Fire Code. Requirements for installation of fire hydrants, fire lanes, or sprinkler systems will be determined in civil plan, and building permit review. Landscaping, Development Guidelines, and Design Guidelines. Finding: Landscaping and screening are necessary to promote safety, to provide screening between compatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. YMC, Chapter 17.80 requires all development to provide on site landscaping. Findin YMC 17.80.030(B) states; Whenever a nonresidential activity is proposed adjacent to a residential use, a minimum 15-foot buffer area of Type I landscaping shall be provided along the property boundary between the uses. Findin YMC, Development Guidelines, and Design Guidelines provide regulations regarding street trees, parking lot landscaping, perimeter and interior landscaping. YMC Chapter 17.80 describes the different landscaping regulations by "Type". 13. Refuse: Findin The City of Yelm Design Guidelines provides guidance for the placement and screening of service areas. Design Guidelines I.D.(1)(b) states; When service elements are visible from the sidewalk, or adjacent properties, the elements must be screened. A six-foot wall or fence shall enclose any outdoor refuse collection point. The fence shall be a solid material such as wood or masonry. Staff Analysis and Conclusion. Based on the conceptual plan as proposed by the applicant, the analysis and findings above, and the conditions described below, staff finds that the project: Adequately provides for the public health, safety and general welfare, and for drainage ways, streets, potable water supplies, sanitary wastes; and The project is in conformance with The Yelm-Thurston County Joint Comprehensive Plan, the City Zoning Ordinance, the City's Development and Design Guidelines, and the Shoreline Management Act. CONDITIONS OF APPROVAL: Transportation: 1. The applicant shall mitigate transportation impacts based on the new p.m. peak hour trips generated by the project. The Transportation Facility Charge (TFC) R:\Project Files\CUP Conditional Use Permit\8336 Senior Center\1Hearing Examiner Staff Report.doc Page 7 of 9 shall be based on the square footage of the building at building permit issuance. 2. The applicant shall make on-site and frontage improvements consistent with City standards. Improvements for 103rd Avenue shall be consistent with the City of Yelm Development Guidelines fora "Local Access Residential Street", and shall be installed from the eastern property line west to approximately 200 feet east of the bridge over Yelm Creek. Remaining improvements shall be deferred. Parking: 3. The applicant shall provide for a minimum of 30 parking stalls on site. 4. The applicant shall provide for handicap parking stalls as required by ADA. 5. Parking areas shall be landscaped consistent with Chapter 17.80, Landscaping, and City of Yelm Development and Design Guidelines. 6. The applicant may phase their parking improvements to concur with building phases, meeting minimum requirements. Water: 7. The applicant shall connect to the City water system. Water ERU's are based on a consumption rate of 240 gallons per day and are charged a current rate of $1,500 (fee subject to change) inside City limits. Landscaping, Development Guidelines, and Design Guidelines: 17.The applicant shall provide fora 15' dense "Type I" landscape buffer along the eastern property line, adjacent to the residential uses. 18.An 8-foot, Type II landscaping is required along the north and west property line. A 5-foot Type II landscaping is required around the buildings. 19. Type III landscaping is required as part of the frontage improvements. 20. Type IV landscaping is required in parking areas. 21. Type V landscaping is required in stormwater retention facilities. 22.The applicant shall submit a final landscape and irrigation plan, pursuant to Chapter 17.80, to the Community Development Department for review and approval. 23. Completed landscaping shall be approved by the Community Development Department prior to building occupancy. Refuse: 24. Refuse container screening shall be required, and be of a material and design compatible with the overall architectural theme of the associated structure, shall be at least as high as the refuse container, and shall in no case be less than six feet high, with a gated enclosure. 25. No refuse container shall be permitted between a street and the front of a building. 26. Refuse collection areas shall be designed to contain all refuse generated on site and deposited between collections. Deposited refuse shall not be visible from outside the refuse enclosure. Staff Recommendation: Based on the Analysis, Findings, and Conditions of Approval, staff finds that the project, as conditioned, meets the City's minimum requirements and standards. Drought Resistant Landscaping DROUGHT RESISTANT LANDSCAPING Page 1 of 2 Please note: Drought tolerant does not mean "do not water". It means that once a plant becomes established, probably after the first season, it will require little water. Many plants need ample moisture throughout the growing season. Creating a landscape that is more resilient in dry weather can cut back on both maintenance time and water use. Start by conditioning the soil to develop adrought-resistant landscape. Soil with organic matter holds water like a sponge. Before planting, incorporate about five bushels of compost, peat, rotted sawdust or similar material into the top 10 inches of soil for every 100-square foot area. In addition to retaining water, organic matter will provide nutrients and create air pockets important for healthy roots. When you're ready to plant, select annuals, perennials, shrubs and trees that tolerate dry soil. Ask if they have been "hardened off," meaning the plants receive less and less water prior to sale, so they are used to drier conditions. If you grow your own seedlings, cut back on water gradually before planting them outside. Buy only dark green, sturdy plants. Tall, spindly plants with pale leaves won't tolerate dry conditions even if you provide adequate organic matter and mulch. Drought-resistant annuals include amaranth, nicotiana, geranium, marigold, petunia, annual phlox, cosmos, rose moss, annual pink, gloriosa daisy, dusty miller, annual baby's breath, strawflower, verbena, lantana and zinnia. Perennials that do well in dry conditions are yarrow, butterflyweed, indigo, coreopsis, gaillardia, daylily, ageratum, liatris, flax, lupine, poppy, ground phlox, rudbeckia, sedum, prickly pear cactus and many kinds of ornamental grasses. Drought-tolerant trees and shrubs include box elder, silk tree, gray birch, hackberry, Osage orange, Japanese black pine, bur oak, black locust, sassafras, Siberian elm, Japanese barberry, flowering quince, sweetfern, gray dogwood, witch hazel, juniper, privet, bayberry, bush cinquefoil and staghorn sumac. After you have installed your plants, one of the most effective methods of water conservation is weed control. Weeds can consume large amounts of water. An effective, long-term method of controlling weeds is to put a 3- to 4-inch layer of mulch around your plants. This limits the need for hand weeding and using herbicides. Determining the direction of prevailing winds and planting or erecting windscreens can drastically decrease your landscape's water consumption. Wind draws a lot of moisture from soil and plant tissue. Reducing air movement over your plants will reduce moisture loss. Most windbreaks modify air movement for a distance of about twice their height. For example, a 6-foot screen reduces air flow about 12 to 15 feet in front of it. If you have plants farther away than 15 feet from your windbreak, make sure your windbreak isn't channeling wind toward those plants. Shrubs that make good windscreens include flowering quince (6 ft.), mentor barberry (7 ft.), pea tree (15 ft.), bayberry (10-12 ft.), gray dogwood (12 ft.) and privet (15-20 ft.). Make sure to plant these shrubs at least 5 feet from your other plants so that they will not draw water from them. Under extremely dry conditions, you can prevent moisture loss by spraying your plants with an antidesiccant, a latex-like film available at garden centers. The spray forms an invisible, watertight film over the leaves' surface. This film does not harm plants and wears off after a few weeks. Antidesiccants are most effective on evergreens and mature foliage. New leaves need additional spraying as they grow.
