Re: U-Haul Truck and Trailer Site Plan Review Application
Dear Ms. Mendes:
NOTICE IS HEREBY GIVEN pursuant to Section 1.12.010 YMC that your use of property at 109 93rd Avenue SE, Yelm, WA 98597 is in violation of the Yelm Zoning Code, Title 17 YMC.
ALLEGATIONS OF FACT
1. Teresa Mendes owns or controls real property within the City of Yelm, identified by tax parcel numbers 21724210401 and 21724210600, and described as 24-17-1E 1.06A NE-NW W 115F OF
N 430F LY SWLY OF SSH 5 I LE SS N 30 and 24-17-1E NE NW W115F OF E230F OF W345F OF N432F LESS N30F R D, and located at 109 93rd Avenue SE, Unit A.
2. On or before May 1, 2006, U-haul trucks and trailers were found to be on the site adjacent to the Bucky’s Muffler Shop, and the business of renting the U-haul equipment being operated
by Teresa Mendes.
3. Although the subject property is identified by the Yelm Zoning Code as being within the Commercial zoning district, which allows this type of retail establishment, Section 17.84.010
(A) YMC requires site plan review approval prior to the use of land or buildings for the location of any commercial, industrial, or public building or activity.
4. Teresa Mendes was contacted by Larry Hanson, the Code Enforcement Officer for the City at the time, and explained that Site Plan Review was required, and suggested that Ms. Mendes
attend a presubmission meeting.
5. Teresa Mendes attended a presubmission meeting with the Community Development Department on May 10, 2006, where site plan review requirements were discussed, and provided as written
notes.
6. On August 26, 2006, an incomplete application for site plan review was received by the Community Development Department. A letter was written and sent to both Ms. Mendes and to Design
By Others, Olympia, WA, on September 12,
2006 explaining that the application was incomplete, and described the information that is required.
6. To this date, there has been no contact with the Community Development Department regarding the application.
ALLEGATIONS OF LAW
A. The above described real property is within the City of Yelm.
B. The above described development is in violation of the Yelm Zoning code.
C. The property owners failed to comply with site plan review requirements and still operate the U-Haul business at the location.
IT IS ORDERED THAT Teresa Mendes or any other person acting as her employee or agent shall submit a complete site plan review application to the Community Development Department no later
than February 15, 2007.
Failure to comply with the terms of this notice of violation will result in further actions by the City of Yelm, including, but not limited to the issuance of civil penalties of up to
$250.00 per day of violation or further enforcement action through a court of competent jurisdiction.
