Causseaux, Jr., Hearing Examiner From: Grant Beck, Director of Community Development Date: January 6, 2004 Subject: Appeal of Site Plan Review Approval SPR-03-8354-YL APL-03-8361-YL Appellant: Mr. and Mrs. Steve Rothwell 1011 West Yelm Avenue Yelm, WA 98597 Location: 1011 West Yelm Avenue, Tax Parcel Number 21724130300 Proposal: Appeal conditions 2 and 3 of the site plan review approval, requiring connection of existing buildings on the property to the City sewer and water systems. I. INTRODUCTION The Rothwell's appeal conditions of their site plan review approval allowing the after the fact conversion of a residential accessory structure to a dance studio. II. FACTS On May 5, 2003, the Rothwell's were issued a building permit to construct a "50 x 64 enclosed play area" classified as residential accessory. The building was reviewed as a group U occupancy under the 1997 Uniform Building Code, which is defined at Section 312 of the 1997 Uniform Building Code as: Group U Occupancies shall include buildings or structures, or portions thereof, and shat! be: Division 1. Private garages, carporfs, sheds and agricultural buildings. The Uniform Building Code considers this particular occupancy group as private (not for use by the general public) and does not require the same level of life safety requirements as if the structure were open to the public (as in a dance studio) such as: egress with panic hardware; fire alarms and detectors; and restroom facilities. Staff Report Page 1 of 8 The Yelm Zoning Code considers an enclosed play area with a group U occupancy to be a accessory use to the single family dwelling on~the property. Subsequent to the final approval of the structure for private recreational use, the Community Development Department became aware that the Rothwell's were advertising dance lessons at the Luv2Dance Studio via flyers and advertisements at the Yelm Cinemas. Upon investigation, it was determined that the Rothwell's were operating the dance studio out of the building permitted as a residential play area and that restroom facilities had been installed inside the structure without benefit of building or plumbing permits. Further, the restroom was connected to a well and the on-site sewage disposal system located on the property without benefit of approval by the Thurston County Health Department. The Rothwell's were notified of the violation through a letter from Gary Carlson, the City's Code Enforcement Officer and Building Official on July 2, 2003. On July 16, 2003, apre-submission conference was held with the Rothwell's in order to review the requirements to convert the building to a dance studio. During the meeting, it was indicated that the requirements for conversion of a portion of the structure would be significantly easier to accomplish and the pre-submission notes were updated on August 6, 2003, assuming that 1,000 square feet of the building would be separated for use by the dance studio. The Site Plan Review application was approved on December 3, 2003. The permit was issued with a number of conditions of approval, including 2.a. The applicant shall connect all existing structures to the City water system. The cost to connect shall include a fee of $1,500.00 per Equivalent Residential Unit (each ERU equals 240 gallons of water consumption per day, fee subject to change.). The applicant shall provide proposed water usage calculations for the dance studio to the Community Development Department for review and approval, to determine the number of gallons of daily use. 2.b. The applicant shall abandon the existing well per Washington State Department of Ecology standards, and transfer any existing water rights to the City of Yelm. 3.a. The applicant shall connect all existing structures to the City S. T.E.P. sewer system. The cost to connect shall include a fee of $5,125.00 per ERU (each ERU equals 240 gallons of water consumption per day, fee subject to change). The number of ERU's required will be determined by approved water consumption calculations. 3.6. The applicant shall abandon the on-site sewage systems per the Thurston County Department of Health standards, and provide proof of approval to the City. The property is just over 4 acres in area, fronts on Yelm Avenue West, and currently is occupied by a single family dwelling, a double wide manufactured home, and the building constructed as a residential enclosed play area. A well located on the property provides potable water to the Staff Report Page 2 of 8 house and manufactured home, as well as being connected to the enclosed play area without building permit or County Health Department approval. There are two on-site sewage disposal systems serving the house and manufactured home. The system connected to the mobile home was installed in 1970 to serve two bedrooms pursuant to permit number 3054 issued by the Thurston-Mason Health District. The applicant's engineer was unable to provide any records relating to the septic system serving the house, most likely as the house was constructed in 1944 and pre-dates requirements for building or septic permits. According to the Washington Department of Health Rules: Public water system shall mean any system providing water for human consumption through pipes or other constructed conveyances, excluding a system serving only one single-family residence and a system with four or fewer connections all of which serve residences on the same farm. [Section 246-290- 020 (1) WAC] A Group B water system is a public water system that does not meet the definition of a Group A water system. (See Table 1 and chapter 246-291 WAC for further explanation of a Group B water system.) [Section 246-290-020 (5)(c) WAC] The Rules and Regulations of the Thurston County Board of Health (Health Code) states in Article III: 1.2 General Requirements. Every residence, place of business, or other building or place where people congregate, reside or are employed shall be served by a water system that is designed and operated to deliver safe drinking water. 1.2.1 Single-family, two-party, and rental unit water supplies shall be subject to the requirements of PARTS 1 and 2 of this regulation. 1.2.2 All public water supplies except two-party systems shall meet the design, construction, monitoring, quality, quantity and operational standards of PARTS 1 and 3 of this regulation and Chapter 246-290 WAC. Two-party water systems shall be considered public water systems for the purpose of administering the Thurston County Coordinated Water System Plan. Only the buildings and projects identified in SECTION 7.3 are exempt from this regulation. The South Thurston County Urban Growth Areas Abbreviated Coordinated Water System Plan establishes policies related to public water systems within the Yelm Water Service Area and Urban Growth Area, as follows: The designated water system is assigned a priority right to provide service within their designated Urban Water Supply Service Area (UWSSA). The UWSSAs for the municipalities of Yelm, Rainier, and Tenino are their respective Urban Growth Areas as identified in the Joint Plans adopted by the municipalities and Thurston County... Staff Report Page 3 of 8 The UWSSA is the area intended to be ultimately served by the designated utility... [Section 2.1 Water System Plan] Over time, existing small public water systems should generally be incorporated into the designated utility to ensure adequate fire flow to protect structures and public safety and provide professional water system operation and management. Wells that are no longer used must be properly decommissioned to reduce risk of groundwater contamination and allow full development of these areas. Timing of incorporation into the designated system will depend on connection requirements of the individual water systems. [Section 2.1.2 Water System Plan] Minimizing the number of separate water systems is a long-term objective of the Public Water System Coordination Act. Incorporating existing small systems into municipal systems is consistent with this objective. [Section 4.5 Water System Plan] Yelm's Comprehensive Plan and Joint Plan with Thurston County addresses public facilities and utilities in Chapter V, which states at Section V.3.d: The City considers a septic system a temporary system within the urban area and incompatible with long-term urban densities. Development standards shall be developed to identify the timing and nature of funding and conversion obligations for septic systems in the urban area. Groundwater monitoring is appropriate in areas under septic tank management. Most of Yelm is in an area of extreme aquifer sensitivity. The current sewage treatment plan was required due to groundwater pollution concerns. For this reason, development at urban levels of density on septic tanks is not in the public interest. Many areas within the Urban Growth Area are already on septic tanks. In addition, some development will likely occur at one unit per five acres density on septic tanks within the unsewered areas of the City and the Urban Growth Area. The City will permit development in non-severed areas with low densities on septic tanks. Such installations must be prepared to transfer to the sewer line when facilities are available and hook-up required under the criteria set forth in the development standards. The County would follow similar guidelines in the unincorporated Urban Growth Area. The City's Development regulations implements the Comprehensive Plan at Section 7A.020: Except as provided herein, it shall be unlawful to construct or maintain any privy, privy vault, cesspool, or other facility intended or used for the disposal of sewage and to install or use any onsite soil absorption systems in such cases where the City's sewer collection system is available for service as provided herein. For purposes of this Section (Ordinance 505), the sewer collection system shall be deemed available when the premises are within 200 feet of the City's collection lines; provided that the City's treatment plant holds sufficient unused capacity to Staff Report Page 4 of 8 treat the expected sewage from the premise. The 200-foot distance shall be calculated by measuring from the lot line closest to the existing portion of the City's collection system. For the purpose of this chapter, when sewer is not available as defined in this Section, primarily treated waste water maybe disposed of onsite with a treatment and disposal system that meets the approval of the Health Officer. All components shall be designed and constructed to meet the City of Yelm's STEP System Standards, included in this Chapter. The City of Yelm shall establish the standards under which all components of the system will be constructed, including: side sewers, tanks, pumps, pump controls, and associated appurtenances for both the municipal system and onsite soil absorption systems that will be converted for use in the transport of effluent to the Yelm municipal collection system at such time as sewer is available. The owner(s) of any premises upon which any building is located within the City's sewer service area shall connect to the City's municipal sewer system if.• (a) the City's sewer collection system is available to the premises, as defined herein; (b) the Thurston County Health Department has determined that the interests of public health and safety require a connection to the City's municipal sewer system. Where the sewer collection system is available and as such, a property owner is required to connect to such system, such connection shall be made when, in the opinion of the Health Officer, the on-site system on the premises requires repair or replacement. Such connections shall be made at the sole expense of_ the owner within 30 days after notification by the City that service is available. These policies and regulations have been codified at Section 13.08.020 (A) Yelm Municipal Code: It is unlawful for any person to place, deposit or permit to be placed or deposited, any human or animal excrement, sanitary sewage or other objectionable waste, by any natural or nonnatural means in any manner, upon property of the city or private property within the city sewer boundaries, or in any area under the jurisdiction of the city, except through the city's sewage collection system or through an approved on-site system as provided in this chapter. Section 17.84.010 (A)Yelm Municipal Code states that: Site plan review and approval shall be required prior to the use of land or building for the location of any commercial, industrial or public building or activity, including environmental checklist review, and for the location of any building in which more than two dwelling units would be contained. Additionally, site plan review shall be required for any allowed, regulated or special use activity on lands containing a wetland or wetland buffer areas pursuant to the requirements of Chapter 14.08 YMC. Staff Report Page 5 of 8 Section 17.84.020 (C) states that a Site Plan Review should be approved when: The SPRC shall review a site plan and approve, or approve with conditions, site plans which conform to the standards, provisions and policies of the city as expressed in its various adopted plans and ordinances including the applicable sections of the shoreline master program for the Thurston Region. III. ISSUES The appellant indicates that the site plan review approval should be issued without conditions 2 and 3 for the following reasons: The possibility of connection to sewer and water were not addressed in the pre- submission conference and, therefore, the City is barred from requiring this as part of the site plan review approval. 2. The existing well is adequate and legal for the existing dwellings. 3. The project is not'new development' as there is no major building construction on the property. 4. No City regulation or standard requires the connection of the existing residences to the City water and sewer systems. 5 - ~~~ / -~~"~' ~ IV. ANALYSIS A. Statements in apre-submission conference are not binding on the subsequent permit. 1. Apre-submission conference is a preliminary meeting with potential developers to review the general requirements for a development. It is simply not possible to complete a full project review at the time of the pre-submission meeting as the detailed application materials required for the permit review have not been submitted. The written notes for apre-submission meeting prepared by the Community Development Department make this clear with the following statement: These comments are preliminary in nature and are not intended to represent final comments and or requirements for the City of Yelm. Until a complete application is made, the Community Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre-submission. In the case at hand, the site plan submitted by the Rothwell's for the meeting did not contain any dimensions, show the limits of the proposed parking area, identify water or sewer connections or the existing drainfield or well, identify the access to the building or even which portion of the building would be used for the dance studio. In fact, key information was not presented (including the proposed Staff Report Page 6 of 8 internal building layout) until the application was determined to be complete on October 30, a month after the site plan review application was initially submitted. 2. Even if apre-submission meeting were binding, the Rothwell's were clearly made aware at the pre-submission conference that the possibility existed that connection to City services would be required, and that this issue would be reviewed as part of the site plan review application. The Development Services Engineer for the City noted in his written comments that: NOTE: It is unknown at this time if the existing residence will be allowed to continue on the current water and sewer system. These options will be reviewed at the time of civil engineering review. if the residence is required to connected to the public water and sewer system, the well and septic system will have to be decommissioned. C. The well is a public water system within the Yelm Water System Service area which must be abandoned. The Rothwell's are incorrect in stating that the existing well is not a Group B water system which requires approval by Thurston County. Any well which provides water for human consumption excluding a system serving only one single-family residence is a public water system pursuant to Section 246-290-020 WAC. Two party water systems shall be considered public water systems pursuant to Article III, Section 1.2 of the Thurston County Health Code. The policies of the Water System Plan, adopted by both Thurston County and the City of Yelm as the primary water service provider within the urban growth area, clearly indicate that other water systems within Yelm's service area should be incorporated into the municipal system. D. The construction of a 3,200 square foot enclosed play area followed by a conversion to a dance studio requires Site Plan Review Approval. Whether or not the project is considered a `new development' a site plan review approval is clearly required by Section 17.84.010 as the project is a new commercial or public building. The construction of a building exempt from site plan review and subsequent conversion is reviewed no differently than a new building for a commercial or public use. E. A site plan review is a discretionary permit. The site plan review process is a discretionary land use permit that may include conditions of approval designed to implement adopted policy as well as regulatory requirements. The policies of the Comprehensive Plan, the Coordinated Water System Plan, the Development Guidelines, the Municipal Code, and the County Health Codes when reviewed together clearly indicate that within the urban growth area urban services should be provided by the City of Yelm. Picking at the individual threads of this policy does not unravel the tapestry. Staff Report Page 7 of 8 V. CONCLUSION The conditions of site plan review approval are appropriate, are supported by adopted City policies, are not contrary to law, and should be upheld. Ordinance 17.84.050 Preliminary site Ulan, states that, "Prior to applying for site plan. review, a developer may file with the SPRC a summary site plan, which shall contain in a .rough and approximate manner all of the information required in the site plan appi.ication. The purpose of. the summary site plan is to enab).e a developer filing the plan to obtain the comments of the SPRC as to the applicability of the intent, standards anal provisions of this chapter to the plan." New development is not defined in rbe City Ordinances 17.06.410 through 17.06.830 and therefore should not arbitrarily classify any project under any circumstances as "New Development". The project site is zoned in a commercial area (Village Retail) and the proposed business is allowed under this Zoning. Since the residential homes are i.n separate structures away from. the dance studio it does not seem reasonable to require these structures to also be connect to the City water and sewer system. Through my review of the Development Guidel_i.nes dated May 2402, }: could not find any City Ordinances or Public Works standards that would required the existing .residences to be connected to the City water and sewer system. Proponent: Steve and Darlene Bothwell Project Proposal: Luv2Dance Studio (After the fact) Project Location: 1017 West Yefm Avenue Zoning and Setbacks The property is zoned Commercial (C-1), Chapter 17.26 YMC. This district allows `Studios, such as record recording, couturier, artist, music, dancing, and photographic' as a permitted use subject to site plan review. Note that the code does not distinguish between `commercial' and public or private dance studios, the site plan review process and other requirements of the Zoning Code apply to either. Minimum lot size: 5,000 square feet. Maximum height of buildings: 40 feet. Front yard setback: 15 feet. Side yard setback: 10 feet. Rear yard setback: 15 feet. Parking Chapter 17.72 YMC requires one parking space for every 10 occupants, based on the maximum occupant load as determined by the Uniform Building Code for Assembly areas of less-concentrated use. Based on a maximum occupant load of 217, 22 parking spaces would be required. A parking plan needs to be submitted to the Community Development Department for review and approval a the time of application for site plan review. All required parking areas must be paved and striped. Ingress/Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 4B.140. Landscaping Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type II landscaping would be required along the side and rear property lines and adjacent to the building. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. For a dance studio, the trip generation rate is 1.83 per 1,000 square feet. To determine the projects impact and fee, use the following formula: ((Peak PM Trip Rate * Gross Floor Area)/1,000) * $750.00 =TFC Example: ((1.83 PM Trips x 3,200 sq. ft.)/i,000) * X750.00 = X4,392.00 If the applicant feels the proposed use would not generate the default number of trips as designated'in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist will be required ifi the proposal requires more than 20 or more parking stalls or other buildings than the pole structure are used as part of the dance studio. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 to 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of land use approval, the applicant can submit building plans for approval. Parking Spaces -Access and Dimensions. Adequate provision shall be made for individual ingress and egress by vehicles to all parking stalls at all times by means of unobstructed maneuvering aisles. Maneuvering aisles, .parking stall dimen- sions and requirements shall be as shown in:Tables 17-2 through 17-4. 4. Small Car Parking Spaces. In all parking facilities containing 25 or more parking spaces, a maximum of 25 percent of the required parking spaces may be reduced in size for the use of small cars, provided these spaces shall be clearly identi-• feed with a sign permanently affixed immediately in front of each space containing the notation, "Compacts Only." Your site will be required to connect to the City of Yelm public water system. See attached detail for general requirements of the water system connection. Water hook-up fees are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,500/240gpd (fee subject to change) inside city limits. At the time of application submittal you will be required to submit water usage calculations provided by a licensed civil engineer. The water fees will be calculated using the information provided by the engineer. A cross connection/backflow prevention device will be required to be installed following the domestic water meter and a inspection will be required to verify the well is disconnected from the recreation center. The proposed site is not currently connected to the City of Yelm's STEP sewer system. Your site will be required to connect to the city's sewer system. Sewer hook-up fees are based on a consumption rate of 240 gallons per day and are charged at a rate of $5,125.00/240gpd (fee subject to change) inside city limits. At the time of application submittal you will be required to submit water usage calculations provided by a licensed civil engineer. The sewer fees will be calculated using the information provided by the engineer. It is unclear at this time if the existing septic tank(s) will meet the requirements of the proposed usage. See attached detail for general requirements of the step tank system. NOTE: It is unknown at this time if the existing residence will be allowed to continue on the current water and sewer system. These options will be reviewed at the time of civil engineering review. If the residence is required to connected to the public water and sewer system, the well and septic system will have to be decommissioned. Fire protection to the buildings must be provided per the Uniform Building Code. All parts of the building must have fire hydrant coverage. The coverage is limited to 150' of hose pull from each hydrant. Another option may be to have a 20' fire lane around the building. This will be determined upon further review of the civil plans by the Building Official. Frontage improvements are defined as widing the asphalt, concrete curb and gutters, planter strip and street trees. At that time I stressed that to do so would trigger upgrades to the building you needed to be prepared for. You did not pursue the matter and the structure was completed as a private residential play shed. The use of the structure now as a public building is in violation of Yehn Municipal Code as adopted in Chapter 15. You maybe cited under each code if you continue the dance classes in the structure without the following upgrades: Uniform Building Code-Meet the conditions of a public building used for exercise and education. The closest occupancy under the code would be a gymnasium. Based on this occupancy you are required to have two three foot exit doors. Exits need to have illuminated exit signs and emergency lighting. Panic Hardware may be waived under certain circumstances. All interior finishes and flooring to have a Class III flame rating. A public discharge connecting the building to the public street is required. Minimum width is twenty feet, and will remain unobstructed to Yelm Ave West. Meet ADA requirements. All exits, door hardware, and restroom fixtures will meet the standards. Required sidewalks and parkinj stalls will meet requirements. Uniform Fire Code-Sprinklers and fire alarm not required at this time. You must have two fire extinguishers rated at 2AlOBC mounted no higher then 5 feet at your exits. Uniform Plumbing and Mechanical Code- Heating shall meet all applicable standards. Supply a minimum of 2 water closets and one lavatory sink in separate restrooms for men and women. Each restroom shall have a floor drain. Proponent: Steve and Darlene Rothwell Project Proposal: Luv2Dance Studio (After the fact) Project Location: 1017 West Yelm Avenue Zoning and Setbacks The property is zoned Commercial (C-1 ), Chapter 17.26 YMC. This district allows `Studios, such as record recording, couturier, artist, music, dancing, and photographic' as a permitted use subject to site plan review. Note that the code does not distinguish between `commercial' and public or private dance studios, the site plan review process and other requirements of the Zoning Code apply to either. Minimum lot size: 5,000 square feet. Maximum height of buildings: 40 feet. Front yard setback: 15 feet. Side yard setback: 10 feet. Rear yard setback: 15 feet. Parking Chapter 17.72 YMC requires one parking space for every 10 occupants, based on the maximum occupant load as determined by the Uniform Building Code for Assembly areas of less-concentrated use. Based on a maximum occupant load of 49, 5 parking spaces would be required. A parking plan needs to be submitted to the Community Development Department for review and approval a the time of application for site plan review. All required parking areas must be paved and striped. Ingress/Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 4B.140. Landscaping • Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type II landscaping would be required along the side and rear property lines and adjacent to the building. Type II landscaping is charactorized by an 8 foot landscape strip between uses and a 5 foot strip around buildings of any combination of evergreen and deciduous trees (with no more than 50 percent being deciduous), shrubs, earthen berms and related plant materials or design features may be selected; provided, that the resultant effect is to provide partial screening and buffering between uses and of softening the appearance of streets, parking and structures. Fences are acceptable in lieu of the 8 foot landscape strip. Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas. Type III landscaping would be required along Yelm Avenue. Type III landscaping is typified by a six foot landscaping strip with street trees for a large overstory canopy along streets and pedestrian corridors and grass or other approved vegetation for groundcover. Earthen berms with grass or other vegetative groundcover and other design features may be worked into landscaping provided the resultant effect of providing apedestrian-friendly environment and visual relief where clear site is required can be achieved. • Type IV landscaping is intended to provide visual relief and shade in parking areas. At least 24 square feet of landscape development for each parking stall proposed. Each area of landscaping must contain at least 100 square feet of area and must be at least six feet in any direction. Each planting area must contain at least one tree. Live groundcover shall be provided throughout each landscaping area. No parking stall shall be located more than 50 feet from a tree. • Type V landscaping is required in storm water retention areas, if required. The floor and slopes of any stormwater retention/detention area shall be planted in vegetation that is suitable and will thrive in hydric soils. The landscaping of the stormwater facility shall be incorporated with all on-site landscaping. A conceptual landscaping plan is required with the application for site plan review. Final landscaping and irrigation plan is required as element of civil construction drawings, with installation prior to occupancy. Existing vegetation may be retained to fulfil landscaping requirements and could satisify landscaping requirements, if the purpose of each type of landscaping is met or exceeded. The refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be screened with an enclosure of a material and design compatible with the overall architetural theme. If fencing is used to enclose the refuse area, it must be landscaped with sight obscuring vegetation. No refuse container shall be permitted between a street and the front of a building. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. For a dance studio, the trip generation rate is 1.83 per 1,000 square feet. To determine the projects impact and fee, use the following formula: ((Peak PM Trip Rate * Gross Floor Area)/1,000) * $750.00 =TFC Example: ((1.83 PM Trips x 1,000 sq. tt.)/1,000) * $750.00 = $1,372.50 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist will be required if the proposal requires more than 20 or more parking stalls or other buildings than the pole structure are used as part of the dance studio. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 to 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of land use approval, the applicant can submit building plans for approval. Other Design Guidelines -the attached checklist must be submitted at time of application, with written responses on how each guideline requirement is proposed to be met. (1) Relate development to pedestrian street frontage. Frontage improvements are not required for project. The existing structure does not front the main street and because of the existing landscaping cannot be viewed from the public roadway. LE. (1) Integrate biofiltration swales and ponds into the overall site desig~z There will be no bioswales on this project and there is an existing infiltration area within the project limit at this time. II.A. (1) All pedestrian paths must correspond with federal, state, and local codes for handicapped access, and the Americans with Disabilities Act. The handicapped access meets all local codes and the American with Disabilities Act. ILA. (2) Provide adequate lighting at the building entries and all walk ways and paths through parki~zg lots. Adequate lighting will be provided at the building entrance. ILB. (1) Provide a pedestrian path at least 60" wide (preferably 96" wide) from the street sidewalk to the main entry. A pathway from the street to the main entrance of the structure has not been provided for the following reasons: There are no sidewalks along the frontage road and frontage improvements are not required for this project. Without a connection point for the pathway, it would lead pedestrian into an unsafe condition along Yelm Highway. The dance studio is a private business and not open to the public. ~~~ ~Y ~:_ IL C. Pursuant to Chapter 15.49 Integrated Project Review Process, a project, tivhich is subject to Site Plan Approval, is a Type II Permit and can be appealed to the Yelm Hearing Examiner. An appeal must be flied within 14 days of the date of this notice. Site Plan Approval is v~~i,d for 18 months from the date of this letter. . The affected property owners may request a change in property tax valuation from the Thurston County Tax Assessor's Office. Proposal: The applicant has applied for Site Plan Review for the conversion or' 1,000 sq. fi ofi an existing structure into a Dance Studio with the addition of 110 sq. ft. for entrance and restroom facilities. Site plan review is required for any commercial use or activity, with exemptions allowed if the use is similar to the prior use. The building was permitted for personal use. Operating a dance studio at this site requires Site Plan Review. The project is approved subject to the foliowing conditions of approval: 1. New developments do in fact burden the city's central streets, and unless the alternate routes are accomplished, the City would have to require developers to pay the cost of the internal street widening. The city plans show, and the City finds that adequate fiacilities will be accomplished better and in a timely fashion by the alternate route facilities as a substitute for the widening of existing facilities. As a result, the City finds that the regional plans in fact benefit projects in ail areas on the City and will accomplish the goal of providing adequate facilities to City standards within a reasonable time to serve the demands created by the proposed project. Finding: The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak trip. The Ordinance provides a default table that is used to determine new pm trips generated by the. proposed use. The table does not list a dance studio, so a similar use was determined. The new trip generation rate is based on 1.37 new pm peak hour trips, per 1,000 sq. ft. of gross floor area. Finding: Street frontage improvements are required as part of Site Plan Review and approval. At this time the City of Yelm is granting the project a "frontage deferment". A deferment means that at any time the City can require this project to complete its frontage. Typically this is when the city has more than one project located along side each other that are required to construct frontage improvements. Your firontage improvements will be required when the Yelm High School improves its frontage on SR 510. ~^° Conditions of Approval: 1 a. The applicant shall mitigate traffic impacts to the transportation system. Mitigation includes payment of the Transportation Facility Charge (TFC). The cost to connect shall include a fee of $1,500.00 per Equivalent Residential Unit (each ERU equals 240 gallons of water consumption per day, fee subject to change.). The applicant shall provide proposed water usage calculations for the dance studio to the Community Development Department for review and approval, to determine the number of gallons of daily use. 2b. The applicant shall abandon the existing well per Washington State Department ofi Ecology standards, and transfer any existing water rights to the City of Yelm. 2c. YMC requires all development to comply with the City stormwater Manual. The manual states that projects creating less than 5,000 sq. ft. of impervious surface must contain and treat all stormwater runoff on site Conditions of Approval: 4a. The applicant shall submit civil plans that show appropriate stormwater containment. 5. Parking Finding: The City of Yelm Development Guidelines, Design Guidelines, and Municipal Code address parking regulations from many aspects, including, but not limited to; design, number of stalls required, pedestrian pathways, and safiety. The requirements of off-street parking and loading facilities and their design shall be regarded as the minimum; however, the owner, developer or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises even though such space or its arrangement is in excess of the minimum set forth. Chapter 17.72 YMC requires one parking space for every 10 occupants, based on the maximum occupant load as determined by the Uniform Building Code for Assembly areas of less-concentrated use. Based on a maximum occupant load of 49, 5 parking spaces would be required. Conditions of Approval: 5a. The applicant shall creme a paved parking area, meeting the Cit`~ of Yelm Development Guideline standards, ~~riith a minimum of 5 parking stalls, one being handicap van accessible. 5b. Parking area shall be landscaped per YUIC 17.80. fi. Fire Finding: Fire protection to the buildings must be provided per the Uniform Fire Code. Requirements for installation of fire hydrants will be determined in civil plan review. Finding; The Uniform Building Code (UBC) provides occupancy ratings for different types of uses. The fire coverage for the commercial use must meet UBC requirements. Conditions of Approval 6a. The applicant shall submit fire flow calculations for all existing and proposed hydrants. All hydrants must meet minimum City standards. 6b. The applicant shall submit a fire hydrant plan to the Community Development Department for review and approval. 7. Landscaping Finding: Landscaping and screening are necessary to promote safety, to provide screening between compatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. YMC, Chapter 17.80 requires all development to provide on site landscaping. Finding: Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas. Type IV landscaping is intended to provide visual relief and shade in parking areas. Type V landscaping is required in storm water retention areas, if required. Conditions of Approval: 7a, The applicant shall provide for Type II landscape buffer adjacent to parking, drive aisles, and the west and south side of the building. 7b. Refuse container screening shall be of a material and design compatible with the overall architectural theme of the associated structure, shall be at least as high as the refuse container, and shall in no case be less than six-feat. 8b. No refuse container shall be permitted between a street and the front ofi a building. 8c. Refuse collection areas shall be designed to contain all refuse generated on site and deposited between collections. Deposited refuse shall not be visible from outside the refuse enclosure. 8d. A six-foot wall or fence, with sight obscuring gates shall enclose any outdoor refuse collection point. The fence shall be a solid material such as wood or masonry, and shall. be designed per the City of Yelm Development guidelines. 9. Other Conditions of Approval: 9a. In lieu of widening existing streets, the City has elected to create certain alternatives, Y-1, Y-2, Y-3, which will avoid the need to significantly widen existing Page 1 of 6 streets, and particularly Yelm Avenue. New developments do in fact burden the city's central streets, and unless the alternate routes are accomplished, the City would have to require developers to pay the cost of the internal street widening. The city plans show, and the City finds that adequate facilities will be accomplished better and in a timely fashion by the alternate route facilities as a substitute for the widening of existing facilities. As a result, the City finds that the regional plans in fact benefit projects in all areas on the City and will accomplish the goal of providing adequate facilities to City standards within a reasonable time to serve the demands created by the proposed project. Finding: The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak trip. The Ordinance provides a default table that is used to determine new pm trips generated by the proposed use. The table does not list a dance studio, so a similar use was determined. The new trip generation rate is based on 1.37 new pm peak hour trips, per 1,000 sq. ft. of gross floor area. Rothwell, As we discussed at your July 16 2003 Pre-submission Meeting, by reducing of the area of the dance studio to less then 1000 square feet and calling the use a classroom, with a maximum occupancy of 49, the following requirements apply: The area needs to be isolated from floor to roof with aone-hour occupancy separation (firewall). Openings in this wall are allowed as long as they are rated for one hour-`and self- closing. One exit a minimum of 36" is required. Latch must be open able with out a key. One restroom is required with one water closet and lavatory. Restroom must meet public standards and ADA standards Dance Studio must meet Energy Code for electrically heated business. All interior covering must have a Clas's III flame rating. This includes the dance floor. Proponent: Steve and Darlene Rothwell Project Proposal: Luv2Dance Studio (After the fact) Project Location: 1017 West Yelm Avenue Zoning and Setbacks The property is zoned Commercial (C-1 ), Chapter 17.26 YMC. This district allows `Studios, such as record recording, couturier, artist, music, dancing, and photographic' as a permitted use subject to site plan review. Note that the code does not distinguish between `commercial' and public or private dance studios, the site plan review process and other requirements of the Zoning Code apply to either. Minimum lot size: 5,000 square feet. Maximum height of buildings: 40 feet. Front yard setback: 15 feet. Side yard setback: 10 feet. Rear yard setback: 15 feet. Parking Chapter 17.72 YMC requires one parking space for every 10 occupants, based on the maximum occupant load as determined by the Uniform Building Code for Assembly areas of less-concentrated use. Based on a maximum occupant load of 49, 5 parking spaces would be required. A parking plan needs to be submitted to the Community Development Department for review and approval a the time of application for site plan review. All required parking areas must be paved and striped. Ingress/Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 46.140. Landscaping • Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type II landscaping would be required along the side and rear property lines and adjacent to the building. Type II landscaping is charactorized by an 8 foot landscape strip between uses and a 5 foot strip around buildings of any combination of evergreen and deciduous trees (with no more than 50 percent being deciduous), shrubs, earthen berms and related plant materials or design features may be selected; provided, that the resultant effect is to provide partial screening and buffering between uses and of softening the appearance of streets, parking and structures. Fences are acceptable in lieu of the 8 foot landscape strip. • Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas. Type III landscaping would be required along Yelm Avenue. Type III landscaping is typified by a six foot landscaping strip with street trees for a large overstory canopy along streets and pedestrian corridors and grass or other approved vegetation for groundcover. Earthen berms with grass or other vegetative groundcover and other design features may be worked into landscaping provided the resultant effect of providing apedestrian-friendly environment and visual relief where clear site is required can be achieved. • Type IV landscaping is intended to provide visual relief and shade in parking areas. At least 24 square feet of landscape development for each parking stall proposed. Each area of landscaping must contain at least 100 square feet of area and must be at least six feet in any direction. Each planting area must contain at least one tree. Live groundcover shall be provided throughout each landscaping area. No parking stall shall be located more than 50 feet from a tree. • Type V landscaping is required in storm water retention areas, if required. The floor and slopes of any stormwater retention/detention area shall be planted in vegetation that is suitable and will thrive in hydric soils. The landscaping of the stormwater facility shall be incorporated with all on-site landscaping. A conceptual landscaping plan is required with the application for site plan review. Final landscaping and irrigation plan is required as element of civil construction drawings, with installation prior to occupancy. Existing vegetation may be retained to fulfil landscaping requirements and could satisify landscaping requirements, if the purpose of each type of landscaping is met or exceeded. The refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be screened with an enclosure of a material and design compatible with the overall architetural theme. If fencing is used to enclose the refuse area, it must be landscaped with sight obscuring vegetation. No refuse container shall be permitted between a street and the front of a building. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. For a dance studio, the trip generation rate is 1.83 per 1,000 square feet. To determine the projects impact and fee, use the following formula: ((Peak PM Trip Rate * Gross Floor Area)/1,000) * $750.00 =TFC Example: ((1.83 PM Trips x 1,000 sq. ft.)/1,000) * $750.00 = $1,372.50 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist will be required if the proposal requires more than 20 or more parking stalls or other buildings than the pole structure are used as part of the dance studio. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 to 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of ,land use approval, the applicant can submit building plans for approval. At that time I stressed that to do so would trigger upgrades to the building you needed to be prepared for. You did not pursue the matter and the structure was completed as a private residential play shed. The use of the structure now as a public building is in violation of Yelm Municipal Code as adopted in Chapter 15. You maybe cited under each code if you continue the dance classes in the structure without the following upgrades: Uniform Building Code-Meet the conditions of a public building used for exercise and education. The closest occupancy under the code would be a gymnasium. Based on this occupancy you are required to have two three foot exit doors. Exits need to have illuminated exit signs and emergency lighting. Panic Hardware maybe waived under certain circumstances. All interior finishes and flooring to have a Class III flame rating. A public discharge connecting the building to the public street is required. Minimum width is twenty feet, and will remain unobstructed to Yelm Ave West. Meet ADA requirements. All exits, door hardware, and restroom fixtures will meet the standards. Required sidewalks and parking stalls will meet requirements. Uniform Fire Code-Sprinklers and fire alarm not required at this time. You must have two fire extinguishers rated at 2AlOBC mounted no higher then 5 feet at your exits. Uniform Plumbing and Mechanical Code- Heating shall meet all applicable standards. Supply a minimum of 2 tivater closets and one lavatory sink in separate restrooms for men and women. Each restroom shall have a floor drain. Walls and floors will meet code requirements. 2001 Washington State Energy Code-with the installation of insulation and glazing that meet the U- Factors for the heat type supplied. Default would be electrical heating. Once your building has met these minimum standards you may open for your building to the public. Proponent: Steve and Darlene Rothwell Project Proposal: Luv2Dance Studio (After the fact) Project Location: 1017 West Yelm Avenue Zoning and Setbacks The property is zoned Commercial (C-1), Chapter 17.26 YMC. This district allows `Studios, such as record recording, couturier, artist, music, dancing, and photographic' as a permitted use subject to site plan review. Note that the code does not distinguish between `commercial' and public or private dance studios, the site plan review process and other requirements of the Zoning Code apply to either. Minimum lot size: 5,000 square feet. Maximum height of buildings: 40 feet. Front yard setback: 15 feet. Side yard setback: 10 feet. Rear yard setback: 15 feet. Parking Chapter 17.72 YMC requires one parking space for every 10 occupants, based on the maximum occupant load as determined by the Uniform Building Code for Assembly areas of less-concentrated use. Based on a maximum occupant load of 217, 22 parking spaces would be required. A parking plan needs to be submitted to the Community Development Department for review and approval a the time of application for site plan review. All required parking areas must be paved and striped. Ingress/Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 46.140. Landscaping Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type II landscaping would be required along the side and rear property lines and adjacent to the building. Type II landscaping is charactorized by an 8 foot landscape strip between uses and a 5 foot strip around buildings of any combination of evergreen and deciduous trees (with no more than 50 percent being deciduous), shrubs, earthen berms and related plant materials or design features may be selected; provided, that the resultant effect is to provide partial screening and buffering between uses and of softening the appearance of streets, parking and structures. Fences are acceptable in lieu of the 8 foot landscape strip. • Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas. Type III landscaping would be required along Yelm Avenue. Type III landscaping is typified by a six foot landscaping strip with street trees for a large overstory canopy along streets and pedestrian corridors and grass or other approved vegetation for groundcover. Earthen berms with grass or other vegetative groundcover and other design features may be worked into landscaping provided the resultant effect of providing apedestrian-friendly environment and visual relief where clear site is required can be achieved. • Type IV landscaping is intended to provide visual relief and shade in parking areas. At least 24 square feet of landscape development for each parking stall proposed. Each area of landscaping must contain at least 100 square feet of area and must be at least six feet in any direction. Each planting area must contain at least one tree. Live groundcover shall be provided throughout each landscaping area. No parking stall shall be located more than 50 feet from a tree. • Type V landscaping is required in storm water retention areas, if required. The floor and slopes of any stormwater retention/detention area shall be planted in vegetation that is suitable and will thrive in hydric soils. The landscaping of the stormwater facility shall be incorporated with all on-site landscaping. A conceptual landscaping plan is required with the application for site plan review. Final landscaping and irrigation plan is required as element of civil construction drawings, with installation prior to occupancy. Existing vegetation may be retained to fulfil landscaping requirements and could satisify landscaping requirements, if the purpose of each type of landscaping is met or exceeded. The refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be screened with an enclosure of a material and design compatible with the overall architetural theme. If fencing is used to enclose the refuse area, it must be landscaped with sight obscuring vegetation. No refuse container shall be permitted between a street and the front of a building. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. For a dance studio, the trip generation rate is 1.83 per 1,000 square feet. To determine the projects impact and fee, use the following formula: ((Peak PM Trip Rate * Gross Floor Area)/1,000) * $750.00 =TFC Example: ((1.83 PM Trips x 3,200 sq. ft.)/1, 000) * $750.00 = $4, 392.00 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist will be required if the proposal requires more than 20 or more parking stalls or other buildings than the pole structure are used as part of the dance studio. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 to 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of land use approval, the applicant can submit building plans for approval. Other Design Guidelines -the attached checklist must be submitted at time of application, with written responses on how each guideline requirement is proposed to be met. Your site will be required to connect to the City of Yelm public water system. See attached detail for general requirements of the water system connection. Water hook-up fees are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,500/240gpd (fee subject to change) inside city limits. At the time of application submittal you will be required to submit water usage calculations provided by a licensed civil engineer. The water fees will be calculated using the information provided by the engineer. A cross connection/backflow prevention device will be required to be installed following the domestic water meter and a inspection will be required to verify the well is disconnected from the recreation center. The proposed site is not currently connected to the City of Yelm's STEP sewer system. Your site will be required to connect to the city's sewer system. Sewer hook-up fees are based on a consumption rate of 240 gallons per day and are charged at a rate of $5,125.00/240gpd (fee subject to change) inside city limits. At the time of application submittal you will be required to submit water usage calculations provided by a licensed civil engineer. The sewer fees will be calculated using the information provided by the engineer. It is unclear at this time if the existing septic tank(s) will meet the requirements of the proposed usage. See attached detail for general requirements of the step tank system. NOTE: It is unknown at this time if the existing residence will be allowed to continue on the current water and sewer system. These options will be reviewed at the time of civil engineering review. If the residence is required to connected to the public water and sewer system, the well and septic system will have to be decommissioned. Fire protection to the buildings must be provided per the Uniform Building Code. All parts of the building must have fire hydrant coverage. The coverage is limited to 150' of hose pull from each hydrant. Another option may be to have a 20' fire lane around the building. This will be determined upon further review of the civil plans by the Building Official. Preliminary Stormwater Report and conceptual plan may be submitted with site plan review application if required. Street Improvements: Frontage improvements will be required for this project. Frontage improvements are defined as widing the asphalt, concrete curb and gutters, planter strip and street trees. These improvements would be along only where your property is adjacent to West Yelm Ave. At this time the City will allow a deferment of the improvements. This is an agreement between the City and the applicant that says the improvements will be constructed when the City requires them in the future. Your improvements will be required when the high school, Twin County Credit Union and the Moose Lodge completes its frontage. The intent is to complete larger sections of frontages instead of piece-by-piece improvements. Street Lighting: Nothing to report. ADA Requirements: The American Disabilities Act required that facilities are ADA accessible. Facility improvements will have to meet current code.
