Findings of Fact, Conclusions of Law, and Decision
FINDINGS OF FACT
1. Rikki Bourque owns and resides in the home located at 9942 Dragt St SE, Yelm, WA 98597,
known as Lot 157, Plat of Tahoma Terra PH I DIV II.
2. The property is identified by the Unified Development Code, Title 18 YMC, as being within
the Master Planned Development (R 4-6) Low Density Residential zoning district.
3. The ministerial site plan review process is to ensure that projects are consistent with
applicable development, construction and design standards of the Unified Development
Code [Title 18, YMC]. Ministerial permits do not require public notice.
4. Rikki Bourque proposes to provide online sales within the home.
5. Chapter 18.65 YMC provides requirements and standards for home occupations. These
include
The home occupation shall not occupy more than 25 percent of the total floor area of
the residence, or exceed 500 square feet if in an accessory building.
Traffic generated by the home occupation shall not exceed 3 commercial vehicles per
week, and all parking of customers’ vehicles shall be off-street.
Storage of merchandise, material or equipment must be entirely within the residence
or accessory building.
Home occupation signs shall be wall mounted, and shall not exceed four square feet
in area. The sign cannot be internally illuminated, but may be indirectly illuminated.
CONCLUSIONS OF LAW
A. Section 18.12.080 YMC allows the Site Plan Review Committee to approve a home
occupation when it complies with all applicable development, construction, and design
standards of the Unified Development Code.
B. Rikki Bourque has established that the request for ministerial review approval can satisfy
all criteria set forth in Chapter 18.65 YMC, meet all requirements of the MPC R 4-6 zoning
classification, and meet all other requirements of the Yelm Municipal Code. Therefore,
the home occupation permit should be approved.
C. A home occupation approval is effective upon approval. The home occupation permit
maybe be revoked upon determination that there has been a violation of any conditions
of approval or standards of the Unified Development code.
DECISION
The request for a home occupation approval is hereby granted.

APPEAL
The Site Plan Review Committee’s decision in this matter may be appealed, pursuant to Chapter
18.10 YMC, to the City of Yelm Hearing Examiner no later than 21 days from the date of this
decision. An appeal must be in writing, contain specific factual objections, and include the appeal
fee of $1,250.00.
