There are two existing duplexes on the original two lots, and the applicant has applied to construct another duplex on each lot. The property is zoned R-4 Low Density Residential, which allows up to 4 dwelling units per acre. Location: The property is located on Mill Road. The property is identified by Assessor's Tax Parcel Numbers 21725110101 and 21725110201. Description of Property: The subject property is bound on the north by a commercial business, to the south by a fire station, to the east, across Mill Road is Cochrane Park, and to the west, the property is currently in constnaction of a 40 lot subdivision. Notice of Application: Notice of this application was mailed to state and local agencies and property owners within 300 feet of the project site on July 20, 2004. The action is exempt from SEPA Environmental Review per Section 197-11-800(6)(a) WAC. The action does not require a public hearing pursuant to Section 16.12.100 Yelm Municipal Code. STAFF ANALYSIS Lots Size and Setbacks: The R-4 zoning district does not have a minimum or maximum lot size, although it does require standard yard setbacks of 15 feet from the front property line adjacent to local access road (with a minimum 20 foot driveway approach), 5 feet from side property lines (with a minimum of 12 feet between the two side yards), and 25 feet from the rear property line. The setback on a flanking yard is 15 feet from the property lines. The property is zoned R-4 Low Density Residential, which allows up to 4 dwelling units per acre. Construction of a duplex on each lot, meets this density. Adjacent Land Uses and Zoning: The property is bordered to the north by a commercial business, to the south by a Fire Station, to the west by a 40 lot residential subdivision (currently in construction) and to the ea, east is Cochrane Park. The plat as conditioned meets City of Yelm development requirements, and is a compatible use with surrounding properties. Open Space: The Growth Management Act establishes a goal for open space and recreation that states "encourage the retention of open space and development of recreational opportunities, conserve fish and wildlife habitat, increase access to natural resource lands and water, and develop parks" [RCW 36.70A.020(9)]. YMC Chapter 14.12 provides guidelines for the retention and creation of open space within the City. This chapter requires a minimum of five percent of the gross area be dedicated as open space or pay a fee in-lieu-of providing the open space on site. Five percent of the site is equal to 4,360.30 sq. ft. The fee is calculated at .77 cents per sq. ft., which equals to $3,357.43 as a fee in-lieu-of open space. It is acceptable to allow the payment of a fee in lieu of open space for this project, as Cochrane Park is directly across the street. Transportation and Site Access: The City of Yelm Development Guidelines require all new developments, including subdivisions, improve street frontages to current standards. Mill Road is a neighborhood collector, which requires a 16-foot drive lane, vertical curb, a 7-foot planter strip with street trees 35 feet on center, a 5-foot sidewalk, and "No Parking" signs installed. Street lighting shall be as required by the City Engineer. This site went through a boundary line adjustment in July 2003, changing the parcel configurations. The State Environmental Policy Act states that if the proposal consists of a series of actions that are individually exempt, but together may have a significant impact, the proposal is not exempt. In this project review, the boundary line adjustment was an exempt action, however, the resulting development of all the parcels were reviewed for cumulative impacts. The road frontage on these two reconfigured parcels are being improved as part of the Mill Pond Estates Subdivision SEPA mitigation. Parking: Chapter 17.72, Off-Street Parking and Loading, requires minimum parking ratio of two spaces per dwelling unit. Page 2 of 6 Water: The City's Water Comprehensive Plan identifies a portion of the City area for service. The City is pursuing additional land areas for approval and the extension of facilities. Completion of such activities is dependent on grant and developer funding, as well as planned bonding and existing public funds. The status of such plans and funding sources must be considered in any review of concurrency. Developer extensions and or dedications, latecomer agreements, oversizing agreements, and the creation of local improvement districts may all be considered. In the event of a new funding source, however, concurrency is not found until the funding source is in fact in place - e.g. award of a grant, a binding letter commitment for third parting funding, or the successful formation of a local improvement district. Any necessary water rights are considered, only after approved for municipal use by the Washington State Department of Ecology, or appropriate appeals board, and the time for appeal or challenge has expired. There is an existing watermain located on Mill Road. The applicant has already extended the waterline along the frontage of these parcels. A latecomers fee for water connection was paid at the time of the extension. The City of Yelm is dedicated to providing the best quality water possible to its consumers. Section 246-290-490, Washington Administrative Code, requires that the City take measures to ensure that contamination does not occur as a result of cross contamination. An irrigation meter may be installed for the purpose of irrigation. A backflow prevention device will be required for all landscape irrigation connections. Any irrigation system installed will need to have a back flow prevention device between the irrigation system and the city owned water meter. This also includes any private irrigation systems that may be located on each home lot. Wastewater: The city's Sewer Comprehensive Plan identifies a portion of the City area for service. Drainage/Sto rmwate r: The completed road frontage imrovements will increase impervious surfaces. Impervious surfaces create stormwater runoff. Uncontrolled and untreated stormwater runoff can create Page 3 of 6 health and safety hazards. The City of Yelm requires all development to comply with the Stormwater Manual for the control and treatment of stormwater runoff. The applicant has submitted a Preliminary Stormwater Report that estimates the impervious surface, infiltration rates of the runoff, and a conceptual design for treatment and storage of the stormwater. Stormwater facilities require continued maintenance to ensure they remain in proper working condition. Street Lighting: Adequate street lighting is necessary to provide safety to pedestrians, vehicles, and homeowners. Street lighting is reviewed to assure adequate lighting. State Environmental Policy Act: This short subdivision is exempt from SEPA environmental review under Section 197-11- 800(6)(a) WAC, however development of the two parcels were included and reviewed as part of a series of exempt and nonexempt actions and is conditioned by the Mill Pond Estates Mitigated Determination of Nonsignificance. Landscaping: Landscaping and screening are necessary to promote safety, to provide screening between compatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. Chapter 17.80, Landscaping, requires the applicant to provide on-site landscaping for all development proposals. The site is adjacent to properties that are compatibly zoned. Chapter 17.80 requires that the perimeter of the site be landscaped with a Type II landscaping. In residential subdivisions the city allows fencing to meet the landscaping requirement for the perimeter of the site. Landscape requirements shall be installed and approved prior to application for final plat. Section 17.80.090(F) YMC states that the owner/developer of any project requiring site plan review approval, subdivision approval, or short subdivision approval shall provide a performance assurance device in order to provide for maintenance of the required landscaping until the tenant or homeowners' association becomes responsible for landscaping maintenance. The performance assurance device shall be 150 percent of the anticipated cost to maintain the landscaping for three years. Conclusion and Staff Recommendation: Section 16.12.170 YMC requires written findings prior to a decision on a preliminary plat. Based on the project as proposed by the applicant, and the proposed conditions of approval as stated below, Community Development staff finds that the subdivision: Page 4 of 6 Adequately provides for the public health, safety and general welfare and for such open spaces, drainage ways, streets, potable water supplies, sanitary wastes, parks and recreation, schools, and sidewalks; That the public use and interest will be served by the subdivision of the property, if conditioned as proposed; The subdivision, if conditioned as proposed, is in conformance with the Yelm-Thurston County Joint Comprehensive Plan, the City of Yelm Zoning Code, the City of Yelm Subdivision Code, the Shoreline Management Act and the Thurston County Shoreline Master Program, and the City of Yelm Development Guidelines. Conditions of Approval: 1. Frontage improvements to Mill Road shall be constructed per Yelm Development Guidelines "Neighborhood Collector" The applicant shall dedicate sufficient right-of-way for 28-feet of frontage improvements, and provide an easement for utilities. 2. The applicant shall provide verbage on the face of the plat, which states that no access will be allowed to the subdivision adjacent to these parcels to the east. 3. The applicant shall connect to the City's water system. Water connection fees are charged at the current rate of $1,500 per connection, (fee subject to change) payable at building permit issuance. 4. The applicant shall meet all conditions for cross connection control as required in section 246-290-490 WAC. 5. This site went through a boundary line adjustment in July 2003, changing the parcel configurations. The State Environmental Policy Act states that if the proposal consists of a series of actions that are individually exempt, but together may have a significant impact, the proposal is not exempt. In this project review, the boundary line adjustment was an exempt action, however, the resulting development of all the parcels must be reviewed for cumulative impacts. Two reconfigured parcels front on Mill Road, each with a duplex building in construction. The third parcel fronts on 104th Ave. SE to the west of this proposal, with the probability of 9 parcels being created. The TIA submitted included this pipeline traffic. The 2003 traffic impact analysis (TIA) submitted as part of the subdivision application indicates that the project will generate an average of 446 vehicle trips per day, with a PM peak of 47 vehicles per hour. The 2003 TIA, assuming a baseline annual growth rate of 3.0%, indicated that: The signalized intersection of Yelm Ave. and Hwy 507 will be at a Level of Service (LOS) D, with an average delay of 46.6 seconds. The intersection of Mill Road and Hwy 507 will be at a LOS C, with an average delay of 15.3 seconds. The intersection of 104T" Ave. and Mill Road will be at LOS A, with an average delay of 8.1 seconds. The intersection of 104th Ave, and Carter Street will be at LOS A, with an average delay of 8.2 seconds. Frontage improvements will be constructed along 104th Avenue SE. The subdivision will provide a traffic facility charge of $757.50 for each dwelling unit. The 2003 TIA did not discuss improvements warranted or not warranted to Hwy 507 or any improvements warranted or not warranted to Mill Road. The 2003 TIA discusses a road connection from 104th Ave. SE to Carter Street, however does not list this connection as a proposed mitigation. The TIA submitted in October 2002 was created for a different subdivision, with a larger number of dwelling units (58), however the information presented in this 2002 TIA can apply to the proposed subdivision as well. This TIA indicates that the new traffic generated to Hwy 507 is 1 %. Geography challenges on Hwy 507 adjacent to the wetland, would make frontage improvements to the southeast side Hwy 507 extremely difficult, if not impossible. The 2002 TIA did not include a connection from 104th Ave. SE to Carter Street, which directed all traffic to the Mill Road/Hwy 507 intersection. Without that connection, a left turn pocket at this intersection was warranted. 5. The City of Yelm has adopted a concurrency management system as required by the Growth Management Act. Chapter 15.40 YMC (concurrency Management) is designed to ensure that the improvements required to support development are available at the time of development. A concurrency determination may be issued for a proposal as it relates to transportation issues when: the development provides on-site frontage improvements; the project makes off-site improvements as necessary to provide for the safe movement of traffic; and the project makes a contribution to projects identified the six year transportation improvement program in the form of a Transportation Facilities Charge. The Growth Management Act at Section 36.70.070 (6)(b) RCW states that a finding of concurrency can be issued when required improvements are in place at the time of development or that a financial commitment is in place to complete the improvements or strategies within six years. The City of Yelm 2003 - 2008 Transportation Improvement Program does not list any projects in this development area. The City's Comprehensive Transportation Plans connectivity policy recognizes that increasing connections throughout the City not only reduces traffic congestion, but also increases the sense of unity of the community. Section 16.16.090 Yelm Municipal Code (YMC) states that the layout of streets shall provide for continuation of streets existing in adjoining subdivisions. 7. Carter Street, in the Hawks Landing subdivision is an approved subdivision within the City limits, with streets constructed to current City standards. Carter Street provides for a full intersection onto Hwy 507. Connection from 104th Ave. SE to Carter Street meets the connectivity policies of the City, as well as provide for an improved access onto Hwy 507. 8. Mill Road is currently a substandard road, with the exception of half-road improvements located in front of the City of Yelm Cochrane Memorial Park. 9. The Thurston County Fire Station located on the corner of 104th Ave. and Mill Road has a "Road Frontage Deferment" that states the their frontage improvements were deferred until such time as other frontage improvements were constructed. This proposal and its required frontage improvements triggers the deferment for the fire station frontage improvements to be completed. 10. The property of the proposed subdivision borders State Hwy 507 for approximately 681 feet. A large wetland is located in this area, adjacent to Hwy 507. The wetland, and the area surrounding the wetland is listed as a Fish and Wildlife habitat conservation area. A wetland assessment and delineation plan was completed in March 2002. The delineation listed the wetland as a Type III wetland. Section 14.08.140(8) YMC Wetland Protection Standards requires a 50 foot buffer adjacent to, and outside of all Type III wetlands. 11. The wetland assessment and delineation plan listed ~uercus garryana (Garry Oak) as an upland species. Washington Department of Fish and Wildlife (WDFW) lists Quercus garryana as a priority habitat. WDFW recommends no loss of Garry Oak woodlands, except for habitat enhancement. 12. Section 14.16.110 YMC provides for the preservation of trees on private property with new development and requires that existing trees not be removed until a final decision is made regarding the feasibility of preserving existing trees. The existing trees on this property are a group of large Douglas Fir, Garry Oak and Black Cottonwood. The trees located in the wetland buffer will be left undisturbed. The applicant is responsible to provide a tree and vegetation plan, possibly changing the proposed layout of parcels to protect as many of the Garry Oak as feasibly possible. Trees that are to be preserved shall be protected during development with protective fencing at the drip line. All machinery shall be kept out of the drip line. 13. Chapter 14.12 YMC requires the dedication of open space for all residential development. Section 14.12.050 YMC lists four (4) attributes for qualification of open space. The wetland and adjacent buffer meet this requirement. 14. The Yelm School District has adopted a school mitigation requirement based on the demand that new residential units create for additional school services and facilities. Additional demands on the school system will be mitigated through the requirement that the developer enter into a mitigation agreement with the District. Mitigation Measures The developer shall mitigate transportation impacts based on the new residential P.M. peak hour trips generated by the project. The Transportation Facility Charge (TFC) shall be based on 1.01 new peak hour trips per residential unit. The proponent will be responsible for a TFC of $757.50 per dwelling unit which is payable at time of building permit. Credit should be given for the existing single-family dwelling. 2. Prior to final subdivision approval, the developer shall complete the following transportation improvements: a. The north half of 104th Avenue shall be improved to City Standards for a Local Access Residential from the east property line to and including the connection to Carter Street. This detail shall be modified to include vertical curb, and no on-street parking. b. The west half of Mill Road shall be improved to City Standards for a Neighborhood Collector from the southern property line of parcel 21 7251 1 01 01 to the northern property line of parcel 21 7251 1 0201. Parcel 21725110101 and 21 7251 1 0201 shall each be allowed one driveway access from Mill Road. Future development of the individual parcels may utilize a shared driveway access. 3. Prior to any land clearing, a revised site plan including the location of all trees to be retained and removed must be reviewed and approved by the Community Development Department. Reconfiguration of the parcels located on the northeastern side of the proposed plat maybe required. Trees located in the wetland buffer area are to remain undisturbed. Trees to remain must be protected during construction pursuant to Chapter 14.16 YMC. 4. Temporary erosion control systems to be approved by the City of Yelm. 5. The applicant shall dedicate the qualified open space to the City of Yelm. 6.
