Project Proposal: Boundary Line Adjustment / Possible Rezone
Project Location: Grove Road
“Boundary line adjustment” means a division made for the purpose of adjusting boundary lines which does not create any additional lot, tract, parcel, site or division nor create any
lot, tract, parcel, site or division which contains insufficient area and dimension to meet minimum requirements for width and area for a building site.
Zoning and Setbacks: Medium Density Residential, R-6 Chapter 17.15
Minimum lot size: None
Side yard setbacks – one side 5-feet, minimum 12-feet total
Rear yard setbacks – 25 feet
Front yard setbacks – 15 feet, with 20-foot minimum driveway approach.
Flanking yard setback – 15 feet
Maximum building coverage: 50% - Maximum height of buildings shall be 35 feet.
Ingress/Egress:
Ingress and egress at the site shall be consistent with the Yelm Development Guidelines 4B.140.
Applications for boundary line adjustments within or outside of an approved subdivision shall be presented to the Community Development Director. Upon finding compliance with minimum
zoning, health, building and other land use regulations and with the Yelm comprehensive plan and upon finding that the adjustment will not adversely affect access, easements or drainfields,
the Director shall issue a certificate of approval. The certificate shall be affixed to a supplemental declaration of subdivision which shall contain the adjusted legal description.
The adjustment shall be effective upon being recorded at Thurston County.
Application and Process:
A Boundary Line Adjustment is an administrative process. A current plat certificate, or Limited Liability Report (title) must be submitted with application. The new legal description
shall be written and certified by either a licensed surveyor, or title company.
ORCAA: State law (WAC 173-425) defines land clearing burning as outdoor burning of trees, stumps, shrubbery, or other natural vegetation from land clearing projects. Olympic Region
Clean Air Authority (ORCAA) issues land clearing permits for burning.
The applicant shall contact ORCAA, 909 Sleater-Kinney Rd SE, Suite 1, Lacey, WA 98502, (360) 438-8768 to secure any necessary permit(s) for the removal of materials containing asbestos
and/or lead paint, and for land clearing burn permits. Prior to issuance of a city building permit the applicant shall demonstrate compliance with any ORCAA requirements.
Rezone:
To change one parcel’s zoning, the applicant bears the burden of proving how the demand and needs of the city are met by completing the rezone.
