Until a complete application is made, the Community Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre-submission. Proponent: Advantage Collision, Tracie Carli Project Proposal: New Building to enclose paint booth or add stall between paint booth and existing building. Project Location: 801 Yelm Ave. West History: In January of 1999, a business license application was submitted to the City to operate a collision repair business at 801 Yelm Avenue West. At that time the business license was granted, however, after researching the ordinances, this business should not have been allowed at that site. Yelm Municipal Code 17.26 Commercial Zone C-1 prohibits Automobile Repair-Major in the C1 Zone. 17.06.129 Automobile Repair, Major: “Major automobile repair” means the rebuilding or reconditioning of motor vehicles or trailers, including trucks over one and one-half tons capacity, collision service, including body, frame or fender straightening or repair, overall painting or paint shop. Yelm Municipal Code, Chapter 17.93 Nonconforming Uses: 17.93.012 Nonconforming structures shall not be enlarged upon, expanded or extended in a manner which would increase the nonconforming aspects of said structure. 17.93.014 A nonconforming use of a structure, or land, shall not be extended or enlarged after the effective date of the ordinance codified in this title by attachment on a building or premises, or by the addition of other uses. The City cannot approve any expansion of this business at this site.
