Box 479 Yelm, WA 98597 June 26, 2007 Hal Wolfe Washington Department of Transportation Olympic Region PO Box 47440 Olympia, WA 98504-7440 Dear Hal: This is a follow-up to our telephone conversation on June 25, 2007, regarding the Mountain Shadow Development. Specifically, you asked about the rear yard setbacks for the properties along Wilkensen Road (lots 41 through 48), as the SR 510 Yelm Loop will require an additional strip of right-of-way beyond what was known at the time of the subdivision approval. The City would consider the rear yard setback required by the Yelm Zoning Code to be measured from the platted property line for a period of five years after final plat approval, regardless of any additional right-of-way . purchased by the State of Washington for the SR 510 Yelm Loop. While this does not apply to building code setbacks, my understanding is that the required right'of=way does not impact required building code setbacks.
