Subj: Stevens Street Garmann
Ken Garmann requested clarification of the impact the acquisition of Stevens Street
right-of-way would have on a parcel of land he owns, identified as Assessor's parcel
number 64423400000.
The proposed right-of-way acquisition would bisect this parcel, creating two legal lots of
record pursuant to Section 58.17.0 RCW, which exempts right-of-way rom the
requirements of the State Subdivision Act. Parcel numbers are assigned by the County
Assessor's office for tax purposes only and have no bearing on whether a parcel of land
has been legally created or is a legal lot of record. In effect, however, the right-of-way
acquisition is legally subdividing Mr. Garmann's property into two legal lots of record.
The two legal lots of record which will be created through the acquisition of right-of-way
do meet the standards of the Zoning Code in the General Commercial zone relating to
lot size, width, and depth. There is nothing relating to land use regulations which would
preclude development of the properties, although any proposed use of the lots would be
required to meet all City standards, including those for parking, landscaping, setbacks,
and stormwater. The size and shape of the parcels will obviously be the limiting factor
for the ultimate build-out of the properties.
