Re: Yelm School District Alternative High School, CUP-01-8286-YL – Phasing Plan - Notice of Final Decision
Dear Mr. Birkland:
On October 24, 2001, the Yelm City Council considered your phasing plan for the infrastructure improvements required as conditions of approval for the Alternative High School, Case #
CUP-01-8285-YL. The City Council approved the following phasing plan:
The School District can use the smaller of the two existing buildings prior to any infrastructure improvements required in the Conditional Use Permit. This approval does not exempt you
from any other City permits required prior to occupancy.
Prior to the use of the larger building for the extension school the School District is required to construct the parking area behind (west) of the smaller building and the parking area
on the northwest corner of Jefferson Street and First Street. These improvements will require the construction of associated storm water facilities and landscaping and any street improvements
necessary to utilize the two parking areas. The number of parking spaces to be constructed is to be determined by the actual occupancy of the buildings.
All remaining infrastructure improvements required as conditions of the Conditional Use Permit shall be completed prior to October 1, 2004.
All improvements not completed must be bonded to quarantee the performance of the work. The City of Yelm Development Guidelines, Chapter 3.100, Bonding states that “No building permit
shall be issued until all public improvements are completed or, with the approval of the Director of Public Works, a performance bond with a surety qualified to do business in this state,
a cash deposit, assigned savings account or other security acceptable to the city, in an amount equal to one hundred fifty
percent of the cost of the public works improvements is posted with the City.”
Pursuant to Chapter 15.49, Integrated Project Review Process, a Conditional Use Permit is a Type IV Permit and can be appealed in Superior Court as set forth in RCW 36.70C JUDICIAL REVIEW
OF LAND USE DECISION.
Please contact Jim Gibson, City Engineer, to establish an acceptable bond amount. Building permits will be issued upon the City’s receipt of an acceptable bond.
