Dear Mr. Birkland: This letter is in response to your request for clarification of the bonding requirements. In a letter dated November 19, 2001 it was stated that two bonds would be required for the above referenced project. Bond number 1 is to be for all improvements needed prior to certificate of occupancy being awarded for the larger building. The City of Yelm Development Guidelines page 3-22 states “Prior to commencement of the work under a permit granted pursuant to this chapter, the permittee or the contractor for the permittee shall post with the city a bond with surety qualified to do a bonding business in this state…”. It is staff’s interpretation of the city councils phasing decision that we will not require bond number 1 to be posted at this time. However all work will need to be completed for this phase prior to the Certificate of Occupancy being awarded for the use of the larger building. The second bond will be required to be posted before the Certificate of Occupancy will be awarded. This bond will be for the remainder of the deferral agreement and phasing plan as approved by the city council.
