8301 DRAFT approval letter September 17, 2001 Mr. Erling Birkland Yelm School District PO Box 476 Yelm, WA 98597 Re: Yelm School District Alternative High School, CUP-01-8286-YL - Notice of Final Decision Dear Mr. Birkland: On September 12, 2001, the Yelm City Council considered your application for the above referenced project. After review of the Planning Commission=s recommendation, public hearing comments and the staff report dated August 13, 2001, the City Council finds that the project, as conditioned below, to be consistent with the Yelm Comprehensive Plan and all applicable City policy and development standards. Pursuant to Chapter 15.49, Integrated Project Review Process, a Conditional Use Permit is a Type IV Permit and can be appealed in Superior Court as set forth in RCW 36.70C JUDICIAL REVIEW OF LAND USE DECISION. As a result of the approved land use for the parcel, the affected property owners may request a change in property tax valuation from the Thurston County Tax Assessor=s Office. Conditions of Approval. The project is approved for all customary school activities for a maximum of 181 full time students and 19 staff members. Enclosed is the approved site plan. The project is subject to the following conditions of approval: Sewer The applicant shall submit sewer usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. These calculations shall be submitted with the civil engineering plans to the Community Development Department for review and approval. Currently this site has an existing connection of 240 gallons a day. If your use is greater than the current use the applicant will have to pay an additional sewer connection fee. Sewer connection fees are charged at the current rate of $4,850 per connection, (fee subject to change) payable at building permit issuance. Each connection is considered 240 gallons The applicant shall submit a storm water operation and maintenance plan to the Community Development Department for approval prior to final plat approval. The stormwater system shall be maintained by the building owner. The Agreement shall include provisions for the assessment of fees against the owner for the maintenance and repair of the stormwater facilities. Transportation The applicant shall be responsible for full-street improvements along Jefferson Street, between First Street and Second Street and half-street improvements along Second Street. The frontage improvements shall be consistent with a Neighborhood Commercial Collector. School District financing and budget cycle may prohibit the completed road improvements prior to occupancy. If this should occur the school district shall bond for said improvements. The applicant shall establish a schedule with the City for the 3-year phased completion of improvements for streets, parking, stormwater facilities and associated landscaping with these improvements. This schedule shall be submitted to City Council for approval prior to October 23, 2001. The vacant lots on the northwest corner of Jefferson Street and Second Street will be utilized as the above ground stormwater facilities. The City will not require full frontage improvements along this area, but will require the construction of adequate shoulders. The applicant shall be responsible for the Transportation Facility Charge of $5,430.00, payable at time of building permit. If the future, the School District provides bus service to the site, they shall submit plans for approval by the City. Said plans may include but are not limited to, circulation, drop off and pick up areas, access and parking. Parking The applicant shall improve the existing parking areas to include access control, landscaping and stormwater management. The applicant shall agree to offer public parking in those areas not needed for school operation. Design Review Any remodeling to the exterior will require design review by the City. Fire The applicant shall submit fire flow calculations for existing hydrants. All hydrants must meet minimum City standards. The applicant shall submit a fire hydrant plan to the Community Development Department for review and approval. Landscaping The applicant shall provide a Type II landscape buffer along the northern property line adjacent to both parking areas. Pursuant to Chapter 17.80, landscaping shall be included in all parking areas and the stormwater facilities. These improvements will occur concurrently with the street and parking improvements as scheduled per Condition of Approval, Transportation #10. The applicant shall submit a final landscaping and irrigation plan for review and approval.. General Public Works The applicant shall submit a grading plan to the Community Development Department for review and approval prior to any on-site grading. Per the City of Yelm=s Development Guidelines street lighting and parking lot lighting will be required. All lighting design will be submitted to the City for review and approval. Other The applicant shall enter into an agreement with the City of Yelm where the Yelm School District agrees not to oppose the issuance of a liquor license for any location in the surrounding commercial districts.
