06-12-07 Minutes YELM CITY COUNCIL REGULAR MEETING TUESDAY, JUNE 12, 2007 MINUTES 1. Call to Order— Mayor Harding called the Meeting to Order at 7:30 pm. 2. Roll Call — Present: Don Miller, Joe Baker, Mike McGowan, Pat Fetterly, John Thompson and Russ Hendrickson. Excused: Bob Isom 3. Agenda Approval 07-47 MOTION BY DON MILLER APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations-Yelm Prairie Days Proclamation. Mayor Harding read and signed the Proclamation declaring June 28th , 2007 to July 1St 2007 as Prairie Days, continuing a tradition of over 60 years celebrating with the Lion's Club sponsorship this social, cultural and fundraising event that is a signature event for our community. 5 Public Comment. Payroll May 2007 Final, Checks 12040 — 12157, Totaling $291,943.94 07-48 MOTION BY PAT FETTERLY APPROVING CONSENT AGENDA ITEMS AS PRESENTED. CARRIED. 7. Public Hearings-Annexation of 13.25 acres North of Coates Rd between Yelm Creek and Cullens Road. Public Hearings-Amendment to Chapters 15.16 and 15.22 Yelm Municipal Code, Washington State Plumbing and Energy Code. Annexation Hearing. Mayor Harding opened the Public Hearing at 7:30 pm stating the purpose of the Annexation Hearing. Grant Beck reviewed the staff report indicating that the petition was approved for circulation in 2004 and the requirements were met in 2007. These parcels are zoned Low Density Residential (R-4). Steve Klein. Yelm, asked why this particular parcel was exempt from Resolution No. 472 passed in May 2007 that does not allow any petitions for annexation to circulate within the Urban Growth Area. Grant Beck re-stated that this does not conflict with the Resolution because this annexation was already in process prior to passage. Mayor Harding closed the Public Hearing at 7:40 pm. Amendment to Chapters 15.16 and 15.22 Yelm Municipal Code. Mayor Harding opened the Public Hearing at 7:41 pm stating the purpose of the Building Code hearing. Gary Carlson reviewed the staff report provided, stating that these were modifications needed to our Yelm Municipal Code to be consistent with the State Building Codes as adopted by the Washington State Building Code Council, effective July 2007. ORDINANCE NO. 872, Annexation 13.25 Acres North of Coates Road between Yelm Creek and Cullens Road. 07-49 MOTION BY PAT FETTERLY ADOPTING ORDINANCE NO. 872 ANNEXING PROPERTY NORTH OF COATES ROAD BETWEEN YELM CREEK AND CULLENS ROAD INTO THE CITY LIMITS. CARRIED. b. ORDINANCE NO. 873, Amendment Chapter 15.16 and 15.22 of the Yelm Municipal Code. 07-50 MOTION BY JOHN THOMPSON ADOPTING ORDINANCE No. 873 AMENDMENT TO CHAPTERS 15.16 AND 15.22 OF THE YMC FOR CONSISTENCY WITH THE STATE BUILDING CODES. CARRIED. 9. Old Business a. RESOLUTION NO.474 Thurston County Emergency Management Inter-Local Agreement. Police Chief Todd Stancil presented the agreement stating that it has been thoroughly reviewed and there are no financial obligations tied to the agreement at this time. The agreement outlines and defines the participants and their commitment to preparation and action during and after an emergency under this agreement. 07-51 MOTION BY PAT FETTERLY APPROVING RESOLUTION NO.474,THURSTON COUNTY EMERGENCY MANAGEMENT INTER-LOCAL AGREEMENT. CARRIED b. ORDINANCE NO. 875, Budget Amendment Increasing Longmire Park Fund from Community Development Block Grant Fund. Tanya Robacker proposed an amendment to the 2007 Budget to appropriate an additional $152,800 funding to complete the Longmire Park construction. She stated that$102,800 was not reported as appropriated as beginning cash for 2007 when it was not expended in 2006 from this fund. The addition funds could be appropriated from eligible CDBG 2006 funds of$50,000, also not expended in 2006 and not carried over as beginning cash for 2007. 07-52 MOTION BY MIKE MCGOWAN ADOPTING ORDINANCE NO. 875 AMENDING THE 2007 BUDGET BY INCREASING THE CONSTRUCTION APPROPRIATION IN THE LONGMIRE PARK FUND. C. Longmire Park, Phase 3 Contract with W.E. &B for$143,424.04 Tim Peterson reported that this contract will allow Phase 3 to continue to complete construction work at Longmire Park. 07-53 MOTION BY PAT FETTERLY AUTHORIZING MAYOR HARDING TO SIGN A CONTRACT WITH W.E.&B., LTD. IN THE AMOUNT OF $143,424.04 PHASE 3 CONSTRUCTION. CARRIED. 10. Mayor and City Council Reports Councilmember Miller attended Chamber of Commerce breakfast meeting and Fire District meeting where they opened bids for new fire engine due in one year. Councilmember McGowan continues to meet with HOME Consortium to bring social services for the homeless to this area. Councilmember Fetterly attended the Fire District meeting. She is unable to attend the Nisqually River Council meeting but requested that the Mayor send another city representative. Councilmember Thompson met with the Yelm Transportation Committee. js/city council/2007 Page 2 of 3 Councilmember Hendrickson clarified the Fire District bid award going to the highest bid because the entire project would be manufactured in the same location. Mayor Harding attended Yelm Transportation Committee where they reviewed the formula for the transportation facility charge. Also reported speaking at the Chamber breakfast meeting to reach out to the business owners to discuss the sign code update. 11. Executive Sessions — no scheduled 12.
