1. Call to Order— Mayor Harding called the Meeting to Order at 7:30 pm.
2. Roll Call — Present: Don Miller, Mike McGowan, Pat Fetterly, and Russ
Hendrickson, John Thompson arrived just after roll call. Excused: Joe Baker
and Bob Isom.

7. Public Hearings-Assessment Reimbursement Contract (Latecomer Agreement)
Sewer Improvements Portion of 100th Ave SE/Grove Rd and SR 507 Wal-Mart.
Mayor Harding opened the Public Hearing at 7:32 pm announcing the time and
purpose of the Hearing. Grant Beck explained that Wal-Mart installed a sewer
line connection from 100th Way by Prairie Elementary, down Grove Rd to the
Wal-Mart's site at their expense. The Latecomer's Agreement would provide
some reimbursement to that expense if other property owners along that route
decided to develop their property and tap into the sewer line that would run by
their property for a period of 15 years. If no development takes place, no
payment is due. The only exception would be, if an existing septic was
condemned a new sewer line hook-up would be required.
Richard Russell, Pres. Bldg Association for Veterans Hall addressed the
Council with concerns about the heavy cost burden to hook in to the sewer after
the ditches were closed. Why were they not allowed to stub in a hook-up while
the lines were open? He reasoned that it did not make sense to dig up new
asphalt paving after the fact.

Annette Ivey, Thurston County expressed her concerns that there was not
sufficient time given to property owners that this was taking place and further,
why did the sewer line go down Grove Rd and not SR507?
Discussion continued with Council and Staff to explain the process for
assessment and notification. The City of Yelm does not do stub outs at the time
the new line is constructed and even though the assessment seems high, it
would be much higher if any property were to bear the cost of installing the line
from the last hookup. Any expansion or development requires a Site Plan
review and would determine if the hook up would be required.
Steve Klein asked Council to table the item until an official response could be
heard from the Sewer department regarding the use of stub outs.
The Mayor and Council felt that staff had addressed that issue. Council agreed
that public education could be expanded and they will add this topic to a future
Study Session. The Public Hearing was closed at 8:13 pm and the regular
meeting resumed.
8. New Business
a. Ordinance No. 870 Assessment Reimbursement Contract, Sewer Improvement
Portion of 100th Ave SE/Grove Rd/SR507, Wal-Mart was brought forward to the
Council.

AUTHORIZING MAYOR HARDING TO ENTER INTO AN ASSESSMENT
REIMBURSEMENT CONTRACT, SEWER IMPROVEMENT FOR A PORTION
OF 100TH WAY AVE SE/GROVE RD/SR507 WITH WALMART. CARRIED
b. Ordinance No. 871, Budget Amendment for Short Line Railroad. Tanya
Robacker reviewed the staff report indicating that the need for additional funds
was identified since the adoption of the 2007 Budget. Funding for professional
services and safety improvements to the trestle would be appropriated from the
Cumulative Reserve.
07-44 MOTION BY PAT FETTERLY ADOPTING ORDINANCE No. 871 AMENDING
2007 BUDGET BY INCREASING THE PROFESSIONAL SERVICES AND
CAPITAL IMPROVEMENTS APPROPRIATION IN THE SHORTLINE
RAILROAD FUND. CARRIED.
C. Planning Commission Appointment. Grant Beck announced that Tami
Merriman advertised this vacancy notification in the NVN, posted it in public
places and mailed letters to citizens who had previously expressed interest in
serving on other boards. The City received 3 applications that were reviewed by
the Mayor. The applicant that was chosen for consideration for appointment is
Peggy Wolf Kennedy.
07-45 MOTION BY DON MILLER TO CONFIRM THE APPOINTMENT OF PEGGY
WOLF KENNEDY BY THE MAYOR TO FILL THE VACANCY ON THE YELM
PLANNING COMMISSION. CARRIED.

9. Old Business
a. Resolution No. 473, Purchase and Sales Agreement Confirmation. Janine
Schnepf reported that approval by Council is needed to enter into a Real Estate
Contract. Council had agreed previously by consensus to move forward if such
an opportunity was presented.
07-46 MOTION BY MIKE MC GOWAN APPROVING RESOLUTION NO. 473
AUTHORIZING MAYOR HARDING TO SIGN A PURCHASE AND SALES
AGREEMENT DATED MAY 10, 2007 WITH THE HOBSON FAMILY FOR
PROPERTY DESCRIBED AS LOT 2 OF SHORT PLAT NO. SHS 97-8134 YL.
CARRIED.
10. Mayor and City Council Reports
Councilmember McGowan attended HOME Consortium meeting at the Yelm
Library to study funding for affordable housing in the outlying areas.
Councilmember Fetterly attended Nisqually River Council meeting.
Councilmember Thompson attended Transportation Policy Board meeting.
Councilmember reported attending the Fire District meeting with
Councilmember Miller where discussion included bids for new fire truck.
Mayor Harding announced that the Yelm area benefited by the Nisqually Tribe
Two Percent Committee Awards including; $ 25,000 to the Yelm Police
Department, $10,000 to the Yelm Senior Multipurpose Center and $14,000 to
Yelm Community Services.

12. Correspondence provided for review included information on the upcoming June
Wastemobile.
