AN ORL'INANCE provzding for the annexaticn of certain
contigncus property tc the Town of Yel.m, Washington.
WHEREAS, heretofore on cr before October 1.3, 1976, there was filed
with the Town Ccuncil and the Mayor of the Town of Yelr:, a ~Votice of Intent to
Cammence tlnnexation Proceedings to affect annexation by ~he Town of ~he real
property more particularly described hereinbelow pursuant tc the Qetition method
provided by Chapter 35.13 of the Revised Code of '~Jashington (RC4J), which notice
was signed by the owners of more than 10~ in value, aceoraing to the assessed
valuation fcr general taxation purposes, cf said real property; and
SJHE.REAS, pursuant to such Notice of Intent to Commence Annexation Pro-
ceedings the Mayor and Tcwn Council of the Town of Yelm held a meeting with repre- `
s entatives of the parties signatory to said P~otice for the purpose of considering
and determining the matters set forth in RCW 3~.13.125, and at such meeting the Town
Council determined that the property to be annexed should be 'sugected to the exist-
ing indebtness of the Town, and that such property, not being cov~red by the existing
Comgrehensive Plan of the Town, be zoned pursuant tc a plan therefore prepared
by the Town Planning Cammissicn and attached to the Petition for annexaticn; and
in'H~REAS, pursuant to the determinations made at the said meeting with
the propcnents of the annexaticn, the Yelm Planning Commissicn prepared a zoning
plan for the property to be annexad and the same was attached to a Petition .for
Annexation which was circulated for signature by the owners of the property with -
in the area to be annexed; and
~FREAS, on or about rebruary 1977, a Petition eearing the signatures
of parties reputed to he co~lectively the ownPrs af not less than 75,~ in vaZue accord-
ing to assessed valuation for ,~eneral taxation purposes of the property described
hereznoelow, was .filed with the Town Council of the Town of Y~1.m and at its regular
meeting held February 9, 19?7, the Town Council determined that said Petition compiled
with the provisions of RCW 35•13.130, and directed the Town Clerk to give notice in
the farm and manner required oy law fixing the 9th day of ~Iarch~ Z977 at 8:00 P.M.
at the Yelm City Hall in Yslm, Washington, as the time and place fcr a public hsar-
ing on said Peti~ion for .~nnexation; and
~wHER~AS, notice of a hearin~ on the said Yetition far Annexatian which
invited al2 interested parties to appear and voice their app~oval or disapproval of
the same, was published and posted in the form and manner requ.ired oy law and a
hearing was regularly held at the time and place fixed in said notice and all interested
parties were given proper opportunity to be heard with respect to the proposed annex-

SECTSON 2. That.the said real property shall be and become a part
of the Town ef
Yelm effective on the date set forth in Section 6 hereof, and
that said area shall i~e sub~ect to the existing indebtness af the Tawn of
Yelm, shall be assessed and taxed at the same rate and on the same basis as
other property within the corporate limits of the Town of Yelm is assessed
and taxed, and shall be subject tc all. laws and ordinances of the Tr~wn of
Yelm then and thereafter in force.
SWCTICJN 3. That the portion cf the said described r~ai groperty
lying wester~y of the road known as plaza L'~rive be, and the same is hereby
zoned as a C-1 Commsrcial Service Zone pursuant ta Chapter 17.32 af the
Yelm Municipal Code, and that portion of the said described real praperty
lying easterly of the road known as Plaza Drive be, and the same is hereby
zoned as a R-2 _~iul~iple Family Residential Zone pursuant to Chapter 17.2~
of the Yel.m ~Iunic ipal Cocle.
SECTIGN That the Clerk af the Town of Yelm be, and he is hereby
directed te record
a capy of this Ordinance in the office of the Auditor of
Thurstcn County, Washington, and to file a certified copy hereof with the
Board cf County Cc~.•nmissioners of '&~urstcn Caunty, Washington pursuant to the
provi.sions of R~i 35•13.15a.
SECTIOi3 That the Mayor of the fiown of ~el.zn be, and she is hereby
directed to convene a Revisw Board pursuant to the prc~visions of RCW 3~.13.171
for the purpose of reviewing the annexation hereby marie and approved.
SECTZa~J 6. That the annexation made and a;;proved herein shall be and
become effective on the ciate the report of the review board to be convened pursuant
ta this ~Jrdinance is filed in the affice of the Yelm Town Clerk, or on the ninetieth
' day followin~ the date oi adoption of this ~rdinance, which ever date shall occur
