908 Park Rules City of Yelm
Ordinance No. 908
AN ORDINANCE amending Yelm Municipal Code Title 9, related to Public
Peace, Morals and Welfare and specifically Chapter 9.68, Park Rules.
WHEREAS, it is necessary to periodically review provisions within the city's municipal
code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM,
WASHINGTON DO ORDAIN AS FOLLOWS:
SECTION 1. Section 9.68.030 Animals in Park of The Yelm Municipal Code is
amended as follows:
9.68.030 Animals in parks.
A. Longmire Community Park - all animals are prohibited.
B. Yelm City Park and Cochrane Memorial Park - it is unlawful to permit any animal
to run at large, without a restraining device or allowing entrance to any pond, fountain or
stream therein. Animals are not to be left unattended, and any animal feces must be
removed by owners.
SECTION 2. Section 9.68.040, Weapons and fireworks restricted of The Yelm
Municipal Code is amended as follows:
9.68.040 Weapons and fireworks restricted.
It is unlawful to shoot, fire or explode any firearm, fireworks, firecracker, torpedo or
explosive of any kind or to carry any firearm or shoot ar fire any air gun, bow and arrow,
BB gun or use any slingshot in any park without the written consent of the city council.
SECTION 3. Section 9.68.050, Molesting and feeding of animals of The Yelm
Municipal Code is amended as follows:
9.68.050 Molesting and feeding animals.
A. It is unlawful, in any manner, to purposely tease, annoy, disturb, molest, catch,
injure or kill or to throw any stone or article of any kind at or strike with any stick or
weapon any animal, bird, fowl or fish within a park;
B. It is unlawful to feed any fowl, fish or animal within any park, other than
Cochrane Memorial Park.
SECTION 4. Section 9.68.060, Solicitation and peddling prohibited of The Yelm
Municipal Code is amended as follows:
9.68.060 Solicitation and peddling prohibited.
It is unlawFul to take up collections, or to act as or apply the vocation of solicitor, agent,
peddler, fakir, mendicant, beggar or bootblack within a park. It is unlawful to sell food,
refreshments or merchandise within any park without obtaining written consent from the
city council and the appropriate state/county agency.
SECTION 5. Section 9.68.070, Circus, carnival and traveling exhibition - Permit
required of The Yelm Municipal Code is repealed in its entirety and replaced with a new
section 9.68.070 Use of Parks:
9.68.070 Use of Parks.
City of Yelm Parks are open to the public, and for all events not requiring the approval of
the City Council, are available on a"first come first served basis". The City will
establish criteria for the use of each park. Such criteria will be available at the City
Clerk's office.
SECTION 6. Section 9.68.080, Assemblies - Permit required - Conditions of The Yelm
Municipal Code is amended as follows:
9.68.080 Assemblies/Events - City Council Approval - Required - Conditions.
The following events require City Council approval:
A. Circus, carnival and traveling exhibition.
B. Any religious or political meeting.
C. Any community-wide event.
Such approval shall be issued upon application but may be conditioned as to the time and
place of holding such meeting or assembly so as not to unreasonably interfere with other
lawful activities within the park.
SECTION 7. Section 9.68.090, Vehicles and equestrian restrictions of The Yelm
Municipal Code is amended as follows:
9.68.090 Vehicle and equestrian restrictions.
It is unlawful to ride a horse or pony and any bicycle, motor scooter, either electric or gas
propelled, motorcycle, or any other motor vehicle unless for purposes of transporting
disabled persons in compliance with the American Disabilities Act, within any paxk.
Exceptions to this are designated bicycle paths, drives, parkways and boulevards.
Vehicles must not travel at a speed in excess of fifteen miles per hour on the designated
bicycle paths, drives, parkways and boulevards.
SECTION 8. Section 9.68.160, Remaining After Closing Time Prohibited, of The Yelm
Municipal Code is amended as follows:
9.68.160 Remaining after closing time prohibited.
It is unlawful to remain in any park after the posted closing time. City of Yelm parks will
have visibly posted hours of public accessible use times. Remaining in any park outside
of the posted public accessible use times is unlawful. Hours of park accessibility at all
parks is as follows:
Winter hours: 6:00 a.m. to 8:00 p.m. (October 1 St to March 31 St),
Summer hours: 6:00 a.m. to 11:00 p.m. (April lst to September 30`n).
SECTION 9. Section 9.68.170, Acts Constituting Disorderly Conduct, of The Yelm
Municipal Code is amended as follows:
9.68.170 Acts constituting disorderly conduct.
A person is guilty of disorderly conduct in a City of Yelm park if without lawful
authority he/she knowingly:
A. Is involved in conduct and/or uses offensive language, causes the clear and
imminent danger of assault, riot or other public disorders which could endanger the safety
of others;
B. Intentionally disrupts any lawful assembly or meeting of persons without lawful
authority;
C. Obstructs pedestrian or vehicular traffic without lawful authority;
D. Engages in any use of illegal substances.
E. Consumes any intoxicating liquor, unless the appropriate paperwork is filed with
the state of Washington and the City of Yelm.
SECTION 10. A New section to Chapter 9.68 Titled Smoking tobacco products
prohibited is added to The Yelm Municipal Code as follows:
9.68.175 Smoking tobacco products prohibited.
Smoking tobacco products by use of cigarette, cigar, pipe or any other smoking device
inside the boundaries of any park is unlawfuL
SECTION 11.
Effective date. The ordinance shall take effect August 19, 2009.
SECTION 12.
Savings Clause. Ordinances repealed and amended by this ordinance, shall remain in
force and effect until the effective date of this ordinance.
SECTION 13.
Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this
ordinance is declared unconstitutional ar invalid for any reason, such decision shall not
affect the validity of the remaining portion of this ordinance.
