ORDINANCE NO. 596
AN ORDINANCE REPEALING AND REPLACING CITY OF YELM
ORDINANCE 255 AND YELM MUNICIPAL CODE CHAPTER 5.36 AND
ESTABLISHING REGULATIONS FOR THE CONDUCT OF GARAGE SALES
WITHIN THE CITY OF YELM; PROVIDING FOR THE ISSUANCE OF
PERMITS AND ADVERTISING OF SUCH SALES AND PROVIDING
PENALTY FOR VIOLATIONS OF THE PROVISIONS HEREOF.
Section 1. Definitions. As used in this ordinance, the term
"garage sale" shall mean any event, other than a sales activities
operated in conjunction with a regularly licensed commercial or
retail operation, which is advertised by any means whatsoever as a
place or location at which members of the public may purchase
identifiable or tangible personal property. Included in the
definition of garage sales are yard sales, patio sales, rummage
sales and other similar sales.
Section 2. License Required. No person shall conduct a
garage sale as defined in Section 1 of this ordinance without first
obtaining a permit from the City. Application for such permit
shall be made to the Yelm Police Department by telephone.
Information shall include the name and address of the applicant,
the address or other adequate description of the location of the
proposed sale, a general description of the type of items to be
sold and the date or dates of such sale. A garage sale permit
issued pursuant to this ordinance shall be the only permit required
for such sale notwithstanding the provisions of any other ordinance
of the City to the contrary.
Section 3. Restrictions. No individual seller,
household, home address, group or family shall be permitted to have
more than two garage sales each calendar year. The length of time
for each garage sale shall not exceed six combined days and shall
be held at least four months apart. Garage sales shall be
conducted only between the hours of 8 o'clock a.m. and 8 o'clock
p.m. Goods displayed in any garage sale may not be displayed in
the public right-of way. No sign permit is required, however,
signs advertising a garage sale may be posted only on the property
where the sale is being held (YMC CHAPTER 15.24.090 ~ F, 4/96) and
only during the duration of the sale. All merchandise offered for
sale shall be arranged so that fire, police, health or other
officials may have access for inspection at all times during the
sale.
Section 5. Violations and Penalties. Any violation of this
ordinance is punishable as follows:

A. For the first offense, by a written warning with no
criminal sanction attached thereto;
B. Upon conviction of a second and subsequent offense by
fine not exceeding One Hundred Dollars ($100.00).
Section 6. Effective Date. This ordinance shall take effect
February 26, 1997, being a date not less than five days following
publication.
