607 Assessment Method ULID WWTP CITY OF YELM ORDINANCE NO. 607 AN ORDINANCE of the City of Yelm, Washington, approving and confirming the method of assessment, base assessment and supplemental assessments for a Utility Local Improvement District (ULID) for the City's Wastewater Reuse Project. WHEREAS, the Notice of Intent to form a Utility Local Improvement District was published and approved on September 24, 1997 under Resolution No. 367 (copy attached as Exhibit I); and WHEREAS, Yelm's Wastewater Reuse Project is substantiallyfunded in the amount of $7.1 million, with the remaining $2 million still needing funding; and WHEREAS, benefits of the ULID to the identified properties within the Special Benefit Districts include an ability to process new developments and permit joint extension of infrastructure, roads, and other facilities necessary to development. NOW, THEREFORE, the City Council of the City of Yelm does ordain as follows: Section 1. The $2 million of remaining needed funding for the Wastewater Reuse Project shall be allocated to six Special Benefit Districts: 5 Corners, Canal Road, Killion Road North, Killion Road South, Mill Pond, and West Road, all of which benefit by the subject ULID (see Exhibit II hereto which identifies the Special Benefit Districts). Section 2. The purpose of the ULID is to provide funds for payment of revenue bonds designed to pay the ULID share. The assessments authorized hereunder shall be for the sole purpose of payment into a bond fund to defray a portion of the costs connected with building or financing the Wastewater Reuse Project. Any cost over runs of the Wastewater Reuse Project shall not be a cost of the ULID. Section 3. The method of assessment to the Special Benefit Districts for the ULID shall be based upon land use designation and other factors reflecting the special benefits which may be available from the Wastewater Reuse Project. Section 4. Such assessment method shall use a base assessment of 1 ERU per acre of property, or fraction thereof. (An ERU is an Equivalent Residential Unit and reflects approximately 900 cubic feet of wastewater discharge monthly.) The base assessment shall not include properties exempt because they are already hooked to sewer or are impacted by critical areas, such as wetlands and floodplains. Section 5. Supplemental assessments may also be requested by a property owner within a Special Benefit District. Such supplemental assessment shall be the number of additional units, not to exceed zoning limits, which the owner desires for development purposes. Section 6. The estimated cost for the ULID is $2,000 per ERU and may vary from estimates, but shall not exceed the true and fair market value of the improvement and the estimated benefits of the particular property, and shall not cumulatively exceed $2 million. (See Exhibit III for specific properties and assessment amounts.) Section 7. Purchasers of ERUs shall be given the right to relocate the unused ERUs, one parcel to another, or to transfer the ERU back to the City after a reasonable period of time (10 years) if unused. Section 8. The City engineer has prepared a statement of costs and assessments which has been mailed to all benefited properties. Section 9. WHEREAS, the City has identified substantial funds to construct a major upgrade in City sewer facil'~ies to eliminate a current development moratorium, but not enough to commit to construction; and WHEREAS, a significant number of property owners have indicated support for a Utility Local Improvement District to fund the final costs which will permit commencement of construction of the plant. NOW THEREFORE, be it resolved by the City of Council of the City of Yelm, Washington: The City of Yetm proposes to form a Utility Local Improvement District to pay for a portion of the City sewer treatment plant and to permit the City to complete its sewer treatment plant and incxease the treatment capacity of the plant ftom approximately 1,000 ERU' to approximately 4,000 ERU. A. NOTICE OF HEARING i hearin n h D' The City Council shall hold a publ c g o t e formation of the istnct October 22, 1997 at 6:00 p.m. at the UCBO offices at 624 Crystal Springs Road, Yelm, Washington. Alt persons who desire to object to the formation of the ULID may appear personally or in writing received not later than the close of the hearing and may state their objections thereto. B. PUBLICATION OF NOTICE The notice for same shall be published on October 2, 1997 and October 9, 1997. Notice shall be mailed to all properties owners of record October 3, 1997. C. PURPOSE OF HEARING At the public hearing the City Council shall take testimony on the formation of the ULID, the costs, benefits, assessments, exemptions, special benefit districts, and all other issues pertaining to the formation, size, or material elements of the District or any objection to the formation thereof. ~An ERU is an Equivalent Residential Unit and reflects approximately 900 cubic feet of wastewater discharge monthly. THE PROJECT AND BENEFIT DISTRICT The project to be constructed is a waste water treatment upgrade which will ~ -1 permit the City of Yelm to lift a current development moratorium due to a capacity - limitation at the treatment plant. The upgrade will occur at the City sewer treatment plant, located at Yelm, Washington. The City has assigned the costs of the first 1,044 ERU to special benefit areas for a ULID which reflect the units likely to be used within five to ten years. The City has funded $7.1 of the $9.1 million treatment plant cost through general public funds and the facility has general public benefit to that extent. The City has allocated $2 million of the treatment plant costs to six special benefit districts: e e e is 5 Comers ~ 61 Canal Road ~ 166 EGtlion Road North 191 tGl(ion Road South 317 Mill Pond 148 - West Road ~ 161 _ Total _ 1044 Maps of the proposed districts are attached.- The benefit districts were drawn through a public process to identify where nodes of properties with development potential exist with demonstrated desire for present development. E. ALTERNATE METHOD OF ASSESSMENT The City proposes to use an. attemate base for assessment authorized at . Chapter 35.51 RCW to permit assessment based upon land use'designation and other factors reflecting the special benefits which may be available from the planned facility. The property included in special benefit districts shall include property in each of the City zoning .codes and within each of the City's four planning quadrants: Industrial Commercial Residential High Density (R10) _ Residential Medium Density (R6) Residential Low Density (R4) The allocations will permit a wide variety of improvements to take advantage of the new sewer, to locate in logical benefit districts which will facilitate the extension of associated infrastructure to a variety of logical improvement areas within the City. ~ C:153~YeIm~Resolution.UD.wpd 2 F. Supplemental Assessment The supplemental assessment shall be a number of additional units, not to exceed zoning limits, which the owner desires for development purposes. Supplemental assessments shall be at property owner's request only. 3. Exempt Property-Within all zones base assessment shall not be imposed against: . (a) Property which is improved by a single family residence or commercial facility or church which is presently hooked to sewer or on septic or any school. The exemption would apply to the property on which the use is located plus one acre, if the parcel is in excess of one acre. (b) Properties impacted ~by critical areas-wetlands and flood plains~o the • extent of the encroachment. G. BENEFITS TO PROPERTIES WITHIN THEASSESSMENT DISTRICT . The City has identified a number of benefits to assessed properties. 1. An ability to process new developments within all zones of the City. A sewer moratorium currently prevents any material development. 2. Significant benefits of developing in compact areas where interest has been expressed to permit joint extension of infrastructure, roads, and other facilities also necessary for development purposes. 3. The City has no alternative source of funding and lacking a local source of funds, local property development plans would be delayed due to lack of sewer. 4. The City finds a city wide Utility Local Improvement District impractical due to: (a) The number of properties already developed (b) The number of properties for which owners have no current development plans. The 3,000 ERU available at the plant constitutes a 20-year supply. f 2For calculation purposes on residential property, any fractional acre below 0.5 acres ~ shall be rounded to the next lower whole number; any fractional acre 0.5 acres or greater shall be rounded up to the nearest whole number. On undeveloped commeraal and industrial property, any fraction of an acre shalt be rounded to the next highest whole number. C:~53~YeImV2esolution.UD.wpd 3 The 1,000 units in the ULID represent one third of that number and a number reasonably expected to develop in the short term. 5. Purchasers of ERUs shall be given the right to relocate unused ERUs, one parcel to another, or to transfer the ERU back to the City after a reasonable period of time (10 years) if unused. 6. The ULID costs shall pay for $2,000,000 of the costs connected with building or financing the treatment plant, freeing grant funds for reclamation and recycling improvements. ULID participants shall be given credit for reuse and recycling costs to the extent grant funds in excess of treatment plant costs are-used for recycling improvements. Cost over tuns on the facility shall not be a cost of the Utility Local Improvement District. H. USE OF FUNDS The purpose of the Utility Local Improvement District is to provide funds for payment of revenue bonds designed to pay the ULID share. The assessments authorized hereunder shall be for the sole purpose of payment into a bond fund to defray the costs of such portion of the facilities as identified above. - . I. NOTICE OF COSTS AND PRELIMINARY ASSESSMENT ROLL The City engineer shall prepare a statement of costs and assessment which shall be mailed to all benefitted properties. The estimated cost of the Utility Local Improvement District is $2,000 per ERU - and may.vary from estimates, but shall not exceed a figure equal to the true and fair market value of the improvement and the estimated benefits of the particular lot, tract, or parcel and, in aggregate, shall not exceed $2,000,000. J. OPPORTUNITY TO PROTEST If Council approves the Utility Local Improvement District Ordinance, the City may be. divested of the right to proceed with the improvement if within 30 days of the adoption of the ordinance, a protest or protests are filed with the City, signed by property owners within the district subject to 60% or more of the cost of the local improvement as provided in RCW 35.43.180.
