Letter to Linda Hull City of Yelm Community Development Department 105 Yelm Avenue West P.O. Box 479 Yelm, WA 98597   January 3, 2005 Linda Hull Del’s Farm Supply 16533 Hwy 507 SE Yelm, WA 98597 Dear Ms. Hull: This letter is regarding the expansion of Del’s Farm Supply and the pending annexation of the property into the City of Yelm. Over the last year or so, we have spoken several times regarding your expansion of Del’s Farm Supply onto the 5 acre parcel south of Del’s and north of Bald Hills Road. In the past, we have focused on what would be required in order for the City to provide water service (fire flow) to the property, as the land use issues were under the jurisdiction of Thurston County. Because of the pending annexation, however, I wanted to review the history of the project as I understand it and clarify the City’s position if the property is annexed. I understand that: The building on the 5 acre parcel was permitted by Thurston County as an non-commercial agricultural building. There has been no land use permit or building permit issued by Thurston County for the use of the building for commercial purposes. There has been no land use permit issued by Thurston County for the use of the 5 acre parcel as parking and storage for Del’s Farm Supply. The 5 acre parcel currently does meet the requirements for a commercial land use within the City of Yelm, including paved parking and drive aisle’s, landscaping, frontage improvements to Bald Hills Road, extension of City sewer and water, compliance with design guidelines, and stormwater management. If you would like to schedule a pre-submission request, the Community Development Department will be happy to sit down and review the development requirements which would be required upon annexation of the property. I have enclosed a pre-submission request form for your use. It is the City’s position that the use of the 5 acre parcel for commercial purposes is not a pre-existing, non-conforming use as it was not legally permitted. The City would expect you to apply for a site plan review approval, a building permit to convert the structure to a commercial use, and compliance with all City development standards. After annexation, if you did not proceed expiditiously to bring the property into compliance, the City would proceed with enforcement actions. Violation of the Zoning Code is a misdemeanor (Chapter 17.102 YMC) and each day the violation continues is consdered a separate violation. The City Council will hold a public hearing on the annexation on January 26, 2005, starting at 7:30 PM and public comment will be welcomed at that time.
