2 1. This action involves title to real progeny located In Thurston County,

4 2. Plaintiff CREST BUILDERS, INC. commenced this lawsuit for the

purpose of quieting title to certain real property legally described as fellows:
6 that portion of Tract 42, Solberg's Garden Tracts, an
7 unrecorded plat, as shown on the map of Yelm and on file
with Pioneer Tide Company, lying east of the West line of
_ s the Southeast Quarter of the Northwest Quarter of the
I Southeast Quarter of 3eclion 24, Township 17 North,
9 Renga 1 East, Willamette Mertdian, Thurston County
in Washington.

Garden Tracts and of Tract 42 within the Tract Trad 42 of Solberg's Garden Tracts
extendetl easterly beyond the West line of the Southeast Quader of the Northwest
Quarter of the Southeast Quarter of Section 24. However, when the south half of
Tact 42 was short subdivided (Short Subdivision 55-0175 recorded on September
11, 1975 under number 946434 In Thurston County) the legal description of the plat
inadvertently excluded the Sirlp of Property that extendetl easterly beyon4 the west
line of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of
Section 24.

Based on a search of the chain of title, no other subsequent conveyances ware made
by Ole Solberg of the Strip of Property.
Based upon the foregoing, the Court makes the following:
CONCLUSIONS OF LAW
1. The Court has jurisdiction over the parties and the subject matter in th7s
lawsuit.
2. Defendants have no interest in or claim to the Property, either
individually or cGllectively.
Now, therefore, R is hereby
ORDERED, ADJUDGED, AND DECREED that all defendants matle a party to
this lawsuit have no dght, title, estate, or interest in such property.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that judgment be
had against defendants, adjudicating that they have no Interest in such property.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that plaintiff have
judgment quieting title to the real property legally described as: .
that portion aF Tract 42, Solberg's Gallen Tracts, an
unrecorded plat, as shown on the map of Yelm and on file
with Pioneer Title Company, lying east of the West line of
the Southeast Quarter of the Northwest Quarter of the
