Recommendation
Approve the final subdivision for John’s Meadows SUB-04-0175-YL and authorize Mayor Ron Harding to sign the final subdivision.
Background
The Yelm Hearing Examiner approved, with conditions, a preliminary subdivision for the above referenced project on June 24, 2005. The project has finished construction, and the applicant
has filed a complete application for final subdivision.
Pursuant to the State Subdivision Act at Section 58.17.110 RCW, the Hearing Examiner found that the public use and interest will be served by the proposed preliminary subdivision and
that appropriate provisions were made for the public health, safety, and general welfare and for such open spaces, drainage ways, streets or roads, alleys, other public ways, transit
stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds and all other relevant facts, including sidewalks and other planning features
that assure safe walking conditions for students who only walk to and from school.
Many of these conditions are required to be met prior to approving a final subdivision, including the dedication of open spaces, drainage ways, the construction of streets, and the construction
of water and sewer pipes and lines. Provisions for other areas of the public use and interest, such as water supplies, sanitary sewer capacity, and school mitigation fees are addressed
at the time a building permit is issued.
Pursuant to the State Subdivision Act at Section 58.17.150 RCW, final subdivisions are required to be accompanied by a recommendation for approval by the agency furnishing sewage disposal
and supplying water as to the adequacy of the proposed means of sewage disposal and water supply.
Each preliminary plat submitted for final approval of the legislative body shall be accompanied by the following agencies' recommendations for approval or disapproval:
(1) Local health department or other agency furnishing sewage disposal and supplying water as to the adequacy of the proposed means of sewage disposal and water supply;
(2) Local planning agency or commission, charged with the responsibility of reviewing plats and subdivisions, as to compliance with all terms of the preliminary approval of the proposed
plat subdivision or dedication;
(3) City, town or county engineer. [Section 58.17.150 RCW]
The proposed means of water supply, connecting to the City's water system, is adequate and it is expected that water rights to serve homes within the subdivision will be available at
the time of building permit issuance pursuant to Section 19.27.097 RCW.
The City has applied to the Washington Department of Ecology through the Thurston County Conservation Board for the transfer of approximately 150 acre feet of water that the City currently
controls through a lease agreement. The City expects this transfer to be accomplished in 2009.
This amount of water would serve just under 500 homes, which is enough to accommodate over two year’s building growth even at the highest rate of the past several years. At present
building growth rates, almost five years worth of growth would be accommodated.
The City has also submitted to the Washington Department of Ecology mitigation plans for new water rights. The Department is currently processing these applications and the City expects
approval of the first 554 acre feet between 2010 and 2012.
The following note has been placed on the face of the final subdivision:
Issuance of a building permit constitutes the City of Yelm’s determination that evidence of an adequate water supply for the intended use of the building has been provided pursuant to
Section 19.27.097 RCW.
The City currently does not hold sufficient water rights to serve all undeveloped lots within its water service area, but has determined that the proposed means of water supply for this
final subdivision is adequate pursuant to Section 58.17.150 RCW.
If the City is unable to provide potable water at the time a building permit application is submitted for any structure within this subdivision, the permit will not be issued until such
time as evidence of an adequate water supply can be made pursuant to Section 19.27.097 RCW.
The proposed means of sewage disposal, connecting to the Yelm Wastewater Treatment Facility, is adequate.
Improvements associated with the subdivision, including streets, sidewalks, stormwater treatment and disposal, sewer lines, water lines, street lighting, and open spaces, have been constructed
pursuant to Yelm Development Guidelines and have been approved and accepted by City staff. All conditions of the Hearing Examiner’s approval have been met by the developer.
Current Situation
Staff has reviewed the subdivision for compliance with the conditions of approval placed on the preliminary subdivision and is satisfied that the final subdivision meets all conditions
of the preliminary approval.
