Subdivision Alteration of the Palisades West Subdivision
Whereas, Andrew and Cynthia Smith submitted an application for subdivision alteration to amend two conditions of the final subdivision of Palisades West, recorded under Auditors File
Number 3988607; and
Whereas, the proposed amendments would except lot 15, owned by the Smith’s from the requirements for a water booster pump station and sewer pressure sustaining valve (roll seal) established
by the two conditions proposed to be amended; and
Whereas, the two conditions proposed to be amended were established by the Yelm City Council on December 11, 2007, at the time of the Council’s approval of the final subdivision; and
Whereas, the final subdivision, including those conditions attached to the final subdivision approval by the Yelm City Council, was recorded with the Thurston County Auditor’s Office
on February 12, 2008, and
Whereas, no appeal of the final subdivision, including the conditions of approval, was filed; and
Whereas, the subdivision alteration seeking exception for lot 15 from the requirements of the two conditions does not constitute a fundamentally different kind of land use application
as the physical final subdivision would not change at all due to the proposed alteration; and
Whereas, the alteration merely attempts to avoid requirements of the final subdivision for lot 15 of Palisades West; and
Whereas, the proposed subdivision alteration would allow the occupancy of a single family dwelling on Lot 15 of Palisades West without the construction of a water booster pump station
needed to provide fire flows as required by International Fire Code and domestic water pressures as required by Section 246-290-230 (5) WAC; and
Whereas, subsequent to the public hearing on the proposed subdivision alteration, the applicants submitted a proposal for an interim booster pump as
authorized by Section 246-290-230 (8) WAC; which would provide 30 psi of water pressure to the house, but would not provide for adequate fire flow; and
Whereas, the applicant’s proposal does not specify a manner to avoid the cost to City ratepayers of installing a booster pump station should the Washington Department of Health deem
the proposed interim booster pump to no longer be authorized pursuant to Section 246-290-230 (8) WAC; and
Whereas, the applicant has not submitted a proposal to the City to provide minimum fire flows but rather submitted a release which does not provide for additional insurance coverage
should the City be exposed to liability due to knowingly allowing a residence to be occupied without required fire flows; and
Whereas, the proposed subdivision alteration would allow the occupancy of a single family dwelling on Lot 15 of Palisades West without the construction of a pressure sustaining valve
(roll seal) need to provide for a safe and efficient sewage collection; and
Whereas, subsequent to the public hearing on the proposed subdivision alteration, the applicant’s submitted a proposal for a filter pack to be installed at a sewer end of line cleanout
which would provide odor control sufficient for a single family dwelling to connect to the City’s STEP sewer system.
Whereas, the applicant’s have filed a claim against the City which, in part, indicates it is their expectation that the City would install the interim booster pump and interim odor
control filter; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the subdivision alteration for the Palisades West subdivision, as recorded under Auditor’s File Number 3988607,
is hereby denied.
