8342 storm variance 092303September 23, 2003 Mike McKinnon 7310 Huckleberry Road NW Olympia, WA 98502 Re: Approval Process for Stormwater Variance – Storm Filter System City of Yelm Project No. SPR-03-8342-YL Dear Mr. McKinnon: This letter is to follow up on our September 16, 2003 meeting. At this meeting, you approached the City wanting to use a Storm Filter System in lieu of the approved stormwater treatments currently allowed by the City of Yelm code. To proceed with this request the City will need a written statement outlining your proposal request. To approve a stormwater variance the request will need to state why the “approved” list of stormwater treatments cannot be utilized and also what you are proposing for the project. Listed below are the criteria for approval of a variance application. 1. The strict application of the standards set forth in the applicable Stormwater Manual precludes or significantly interferes with a reasonable use of the property not otherwise prohibited by the Zoning Code.   2. The hardship described above, is specifically related to the property and is the result of unique conditions such as irregular lot shape, size, or natural features, and the application of the Stormwater Manual, and not, for example, from deed restrictions or the applicant's own actions;    3. The requested variance does not constitute a grant of special privilege not enjoyed by the other properties in the area, and is the minimum necessary to afford relief; and   4. That the public interest will suffer no substantial detrimental effect. The next step should be to have you or your engineer submit the appropriate information if you choose to apply for the stormwater variance.
