Resolution Number
declaring certain property in the City of Yelm as public nuisances
WHEREAS, the Yelm Municipal Code at Section 9.44.015 states it is a violation for any person to permit, create, maintain, or allow, upon any premises, acts declared to be a public nuisance,
or to fail to abate such a nuisance.
WHEREAS, the code at Section 9.44.020 YMC describes conditions that are declared to be public nuisances including trash, litter, filth, unsafe structures, and improper storage of inoperable
and/or unlicensed vehicles ; and
WHEREAS, the Building Official for the City of Yelm has through site visits, photographs, and conversations with the bank owning the property and members of the community, meet the definition
of public nuisance as described above; and
WHEREAS, the bank owning the property has been contacted via phone conversations that their property could be declared a public nuisance; and
WHEREAS, the property owner Sandra Tritt passed away four years ago and no next of kin are interested in the cleanup of the property
WHEREAS, the Planning and Economic Department is requesting the City Council to declare the property identified below as a public nuisance; and
WHEREAS, the Department will continue to work with the bank owning the property in a collaborative manner if progress on abatement is being made; and
WHEREAS, the City Council has reviewed the property in question and has determined that they meet the definition of public nuisance as defined by Section 9.44.020 YMC.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the following property in the City of Yelm is a public nuisance pursuant to Chapter 9.44 YMC and the Planning
& Economic Development Department is authorized to abate the nuisance.
