The Building Official is authorized to suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code. The rear set back of 25 feet from the property line established at Section 18.32.040 Yelm Municipal Code is not met by your proposed construction, You have the option to apply for a variance from the minimum required rear yard seback. A setback reduction to 21.25 feet would be an administrative variance processed pursuant to Section 18.13.060 YMC. A setback reduction greater than this would require a public hearing before the City’s Hearing Examiner pursuant to Section 18.14.100 YMC. In either case, you would have to show that the requested setback reduction meets the following criteria: 1. Literal interpretation and application of provisions of this code would deprive the applicant of the rights commonly enjoyed by other properties in the same district; 2. A variance is necessary for the preservation and enjoyment of a property right possessed by other properties in the same vicinity or district, but which is denied to the property in question because of special circumstances on that property; 3.
