Dear Mr. Belmore:
The purpose of this letter is to inform you that permit 20180250 was issued in error and is hereby revoked pursuant to Section R105.6 of the 2015 International Residential Code, which
states:
Suspension or revocation. The Building Official is authorized to suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the
basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code.
The rear set back of 25 feet from the property line established at Section 18.32.040 Yelm Municipal Code is not met by your proposed construction,
You have the option to apply for a variance from the minimum required rear yard setback. A setback reduction to 21.25 feet would be an administrative variance processed pursuant to Section
18.13.060 YMC. A setback reduction greater than this would require a public hearing before the City’s Hearing Examiner pursuant to Section 18.14.100 YMC.
In either case, you would have to show that the requested setback reduction meets the following criteria:
1. Literal interpretation and application of provisions of this code would deprive the applicant of the rights commonly enjoyed by other properties in the same district;
2. A variance is necessary for the preservation and enjoyment of a property right possessed by other properties in the same vicinity or district, but which is denied to the property
in question because of special circumstances on that property;
3. That the hardship described under this subsection is specifically related to the property and is the result of unique conditions such as irregular lot shape, size, or natural features,
and the application of this code, and not, for example, from deed restrictions or the applicant’s own actions;
4. The granting of the variance will not be materially detrimental to the public welfare or injurious to the right of other property owners in the vicinity; and
5. The variance will not permit a use prohibited by the Unified Development Code in the district in which the subject property is located.
You may appeal this decision to the Yelm Hearing Examiner. The appeal must be in writing and accompanied by the appeal fee of $1,250 within 21 days of this letter and must include the
following information:
1. Appellant’s name, address, and phone number;
2. A statement describing the appellant’s standing to bring the appeal;
3. Identification of the decision that is the subject of the appeal, including the date of the decision being appealed;
4. A specific statement on the grounds for the appeal and the facts upon which the appeal is based;
5. The relief sought; and
6. A statement that the applicant has read the appeal and believes the content to be true and correct; signed by the appellant.
