NW Dear Mr. Belmore: I regret to inform you that permit number 20180250 was in fact issued in error and the City of Yelm must revoke the issued permit pursuant to Section R105.6 of the 2015 International Residential Code. Suspension or revocation. The Building Official is authorized to suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code. During the plan review process, it was found that the rear set back was encroached upon in violation of Section 18.30.010 (G) Yelm Municipal Code, which states: . “Decks and patio covers may be permitted to encroach into all residential district rear yard setbacks, provided a minimum setback of 10 feet is retained, and provided such deck be not more than 16 inches above existing natural grade measured at the deck floor from the highest point; and provided, that such patio cover is not enclosed in any manner. In no case can a deck or patio be constructed in a required side yard. The City of Yelm has looked into possible alternatives to make this proposed project possible in its current intent but unfortunately has found none and must revoke the permit. You have the option to apply for a variance if you believe that this project meets the criteria for a variance. The criteria includes circumstances such as that the literal interpretation and application would deprive the applicant of the rights commonly enjoyed by other properties in the same district, necessary for the preservation and enjoyment of a property rights possessed by other properties in the same district, but denied to the property in question because of special circumstances on that property, or that the hardship is specifically related to the property and is the result of unique conditions. A variance request is a quasi-judicial review that is heard by the Yelm Hearing Examiner. The process to apply for a variance is found at Section 18.14.100. The application is available online at http://www.ci.yelm.wa.us/uploads/library/forms/PermitApplicationFillOutable.pdf and includes a fee of $2,000. You may appeal this decision to the Yelm Hearing Examiner. The appeal must be in writing and accompanied by the appeal fee of $1,250 within 21 days of this notice. The appeal must include: Appellant’s name, address, and phone number; A statement describing the appellant’s standing to bring the appeal; Identification of the decision that is the subject of the appeal, including the date of the decision being appealed; A specific statement on the grounds for the appeal and the facts upon which the appeal is based; The relief sought; and A statement that the applicant has read the appeal and believes the content to be true and correct; signed by the appellant.
