1110 E Yelm Ave Tim Cronk Sign Fines 07132018 City of Yelm 105 Yelm Avenue West Yelm, WA 98597 (360) 458-3835   July 17, 2018 Tim Cronk 1110 E Yelm Ave #C Yelm, WA 98597 NOTICE IS HEREBY GIVEN pursuant to Yelm Municipal Code Section 18.62.040 that your temporary signage is in violation of the Unified Development Code and a civil penalty of $250 is hereby imposed. ALLEGATIONS OF FACT 1. Tim Cronk controls commercial property within the City of Yelm, identified as Assessor’s Tax Parcel Number 99002148392 and located at 1110 East Yelm Avenue. 2. The City of Yelm has sent letters on March 27, 2018, May 16, 2018, and June 8, 2018 requesting permanent signage be attached to the building after removal of your current banner signs. 3. As discussed during numerous prior site visits, banners may only be used during special events per YMC Section 18.62.040 Temporary Signs. Banners must be removed and permanent signage options may be discussed with the City of Yelm. ALLEGATIONS OF LAW A. The property is within the corporate limits of the City of Yelm. B. The use of temporary banners is intended for special events 14 days at a time, four times a year. C. Tim Cronk or agents acting on his behalf failed to comply with the provisions of the Yelm Municipal Code relating to required permanent signage and the use of temporary banners. IT IS HEREBY ORDERED THAT Tim Cronk shall remit $250 to the City of Yelm Community Development Department as a civil penalty for violation of the Yelm Municipal Code. The penalty herein described is due and payable within thirty (30) days of the receipt of this notice. The penalty fee should be remitted to: Community Development Department City of Yelm, Washington 105 Yelm Avenue West Yelm, WA 98597 IT IS FURTHER ORDERED THAT permanent signage and application plan be submitted to the City of Yelm by July 31, 2018. Failure to comply with the terms of this notice of violation may result in further actions by the City of Yelm, including, but not limited to the additional civil penalties of up to $250 per day. Upon receipt of the application, the hearing examiner shall hold a closed record hearing pursuant to Chapter 18.10 YMC. If the examiner determines that a violation occurred, the penalty may be remitted or mitigated for good cause, upon whatever terms the examiner finds acceptable. The written appeal must include the name and mailing address of the petitioner, a separate and concise statement of each error alleged to have been committed, and a concise statement of facts upon which the petitioner relies to sustain the statement of error.
