1201 Crystal Ct NW CC Submittal PKG        To:   Mayor JW Foster         Yelm City Council    From:   Chris Vaccaro    Date:   September 27, 2018 (for October 23, 2018 City Council Meeting)    Subj:      Declare nuisance on the following property.   Recommendation      Authorize  Mayor  Foster  to  sign  Resolution  No.  592  allowing  the Community  Development  Department to declare public nuisance on the following property and if so required deem the  property unlivable.            Background      The property listed below has been without water service for 5 years. Such a condition causes a  property to be considered a danger to the occupants as well as the general public.             Current Situation      The subject property is listed below by the address and type of violation.      1201 Crystal Court‐ The residence has been without water service since September of 2013 and  the front and side yard is being used as an auto repair facility. Excessive amounts of household  items and inoperable vehicles are currently being stored on the property.             City of Yelm  STAFF REPORT    CITY OF YELM  RESOLUTION NUMBER 592  DECLARING A CERTAIN PROPERTY IN THE CITY OF YELM AS A PUBLIC NUISANCE    WHEREAS, the Yelm Municipal Code at Section 9.44.015 states it is a violation for any person  to permit, create, maintain, or allow, upon any premises, acts declared to be a public nuisance,  or to fail to abate such a nuisance; and  WHEREAS, Section 9.44.020 YMC describes the conditions that are declared to be public  nuisances, which include trash, litter, filth, unsafe structures, and improper storage of inoperable  and/or unlicensed vehicles ; and  WHEREAS, the Building Official for the City of Yelm has documented, through site visits,  photographs, and conversations with members of the community, the property at 1201 Crystal  Ct NW meets the definition of public nuisance; and  WHEREAS, the property owner has been contacted by US mail notifying them that the  property could be declared a public nuisance; and  WHEREAS, the Planning & Economic Development Department staff will continue to work  with  property  owner  in  a  collaborative  manner  if  progress  towards  abateing  the  nuisience  proceeds; and  WHEREAS, the City Council has reviewed the property at 1201 Crystal Ct. NW and has  determined that it meets the definition of public nuisance as defined by Section 9.44.020 YMC.  NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the property at  1201 Crystal Ct NW in the City of Yelm is a public nuisance pursuant to Chapter 9.44 YMC and the  Planning & Economic Development Department is authorized to abate the nuisance.   APPROVED on this, 23rd  day of October 2018.        JW Foster, Mayor    ATTEST:      Lori Mossman, City Clerk  (360) 458-3835 (360) 458-3144 FAX www.ci.yelm.wa.us City of Yelm 105 Yelm Avenue West Yelm, WA 98597 (360) 458-3835 May 25, 2018 Steve Uribe 1201 Crystal Ct NW Yelm, WA 98597 It has come to the attention of the City of Yelm that the residence located at 1201 Crystal Ct. NW has been without water service for an unreasonable amount of time. The current state of the residence places it in an unlivable condition that is not fit for human occupancy. A) Per 2015 International Residential R306.3 Sewage Disposal. Plumbing fixtures shall be connected to a sanitary sewer or to an approved private sewage disposal system. B) Per 2015 International Residential Code R306.4 Water supply to fixtures. Plumbing fixtures shall be connected to an approved water supply. Kitchen sinks, lavatories, bathtubs, showers, bidets, laundry tubs and washing machine outlets shall be provided with hot and cold water.   It is vital that you contact the City of Yelm within 10 days of receiving this letter to establish a plan to bring the residence into a livable condition. The lack of water places the residence in an unlivable condition not fit for human occupancy, as well as creating a debt to the city for your use of a sewer system that you are not paying for. In the city of Yelm residences are not designed for the repair of automobiles, especially not to the scale and frequency these repairs have been taking place on your property. A plan by you the homeowner (and/or resident,) must be submitted to the city that outlines how water services will be returned and maintained, which brings the residence into a habitable state.
