Subj: Declare nuisance on the following property.
Recommendation
Authorize Mayor Foster to sign Resolution No. ____ allowing the Community Development
Department to declare public nuisance on the following property and if so required deem the
property unlivable.
Background
The city of Yelm was unfortunately without means to pursue full time Code Enforcement, which
has contributed to the unsafe occupancy of a residence that has been without water service for
over 5 years. With the recent addition of a Building Official, problematic properties may be
identified and brought up to code.
The 2015 International Building and Plumbing Codes require a residence to maintain connection
to a safe and sanitary water supply and sewer system. This connection aids in preventing illness
and living conditions from becoming unsanitary. Such a state places the residence in an unlivable
condition that is dangerous to the public as well as its occupants, thereby creating a nuisance.
The city sent Notice of Violation letters to the current property owner via US mail on May 23,
2018, and June 6, 2018 notifying them of their code violations and what will be required to bring
said property up to code. A third letter was sent on ________________informing the property
owner of the City Council meeting regarding the possibility that the property may be declared a
nuisance, the meeting place and time, and the property owners right to attend said council
meeting.

Current Situation
The address and type of violation identifies the property in question.
1201 Crystal Court‐ The residence has been without water service since September of 2013. The
illegal use of the residences front and side yards for automobile repair is taking place. Excessive
amounts of household items and inoperable, unlicensed vehicles are currently being stored on
the property.

DECLARING A CERTAIN PROPERTY IN THE CITY OF YELM AS A PUBLIC NUISANCE
WHEREAS, the Yelm Municipal Code at Section 9.44.015 states it is a violation for any person
to permit, create, maintain, or allow, upon any premises, acts declared to be a public nuisance,
or to fail to abate such a nuisance; and
WHEREAS, Section 9.44.020 YMC describes the conditions that are declared to be public
nuisances, which include trash, litter, filth, unsafe structures, and improper storage of inoperable
and/or unlicensed vehicles; and
WHEREAS, the Building Official for the City of Yelm has documented, through site visits,
photographs, and conversations with members of the community, the property at 1201 Crystal
Ct NW meets the definition of public nuisance; and
WHEREAS, the property owner has been contacted by US mail notifying them that the
property could be declared a public nuisance; and
WHEREAS, the Planning & Economic Development Department staff will continue to work
with property owner in a collaborative manner if progress towards abating the nuisance
proceeds; and
WHEREAS, the City Council has reviewed the property at 1201 Crystal Ct. NW and has
determined that it meets the definition of public nuisance as defined by Section 9.44.020 YMC.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the property at
1201 Crystal Ct NW in the City of Yelm is a public nuisance pursuant to Chapter 9.44 YMC and the
Planning & Economic Development Department is authorized to abate the nuisance. APPROVED
on this, 26th day of November 2019.

It has come to the attention of the City of Yelm that the residence located at 1201
Crystal Ct. NW has been without water service for an
unreasonableamount of time. The current state of the
residence places it in an unlivable condition that is not
fit for humanoccupancy.

days of receiving this letter to establish a plan to bring
the residence into a livablecondition.

Per 2015 International Residential R306.3 Sewage Disposal. Plumbing fixtures shall be
connected to a sanitary sewer or to an approved private sewage disposal system.
Per 2015 International Residential Code R306.4 Water supply to fixtures. Plumbing fixtures
shall be connected to an approved water supply. Kitchen sinks, lavatories, bathtubs, showers,
bidets, laundry tubs and washing machine outlets shall be provided with hot and cold water.

The City of Yelm has been in touch with you on matters
concerning the lack of water, and the consistent repair of
automobiles on various locations on the property.
The lack of water places the residence in an unlivable
condition not fit for humanoccupancy, as well as creating
a debt to the city for your use of a sewer system
that you are not payingfor.
In the city of Yelm residences are not designed for the
repair of automobiles, especially not to the scale and frequency
these repairs have been taking place on your property.
A plan by you the homeowner (and/or resident,) must be
submitted to the city that outlines how water services will
be returned and maintained, which brings the residence into a
habitable state.

Council on Tuesday October 23rd at 6 PM at The
Yelm Public Safety Building located at 206 McKenzie St in
Yelm WA. You have the right to attend this meeting and
represent yourself before City Council.
The City of Yelm has been in touch with you on matters
concerning the lack of water, and hopes a resolution can be
met that brings the residence into a habitable state.
