An unscreened swimming pool, the accumulation of garbage and household items on the property, as well as the accumulation of garbage in the garage which is an unsafe structure. Enclosed you will find the Yelm Municipal Code cited in reference to the overall cleanliness of the property and the garbage service required for a residence in the City of Yelm. The property is in violation of Yelm Municipal Code 9.44.020 ‐ 7. Trash, litter, weeds or grass, rags, accumulation of empty barrels, boxes, crates, packing cases, mattresses, bedding, excelsior, packing straw, or other packing materials, lumber not piled, scrap iron, abandoned stoves, kitchen appliances, tin and other metal not neatly piled, or anything whatsoever in which flies or rats may breed or multiply or which may be a fire danger. 8.12.020 Authorization of collection. The maintenance of the public health and sanitation requires, and it is the intention hereof to make, the collection, disposal and removal of waste materials within the city universal and compulsory under the supervision of the city, and to provide that such collection, removal and disposal of waste materials be performed by the city or such entity as the city may from time to time authorize and designate. (Ord. 173 § 3, 1974). With regard to the swimming pool Per 2015 International Building Code: 3109.4 Residential Swimming Pools ‐ Residential swimming pools shall be completely enclosed by a barrier complying with Sections 3109.4.1 through 3109.4.3. 3109.4.1 Barrier height and clearances ‐ The top of the barrier shall be not less than 48 inches above grade measured on the side of the barrier that faces away from the swimming pool. The vertical clearance between grade and the bottom of the barrier shall not be greater than 2 inches measured from the side of the barrier that faces away from the swimming pool. 3109.4.1.1 Openings ‐ Openings in the barrier shall not allow the passage of a 4‐inch diameter sphere. The City of Yelm has also taken note of the garage located on the property, which is structurally unsafe and is considered an extreme fire hazard. The garage is required to be repaired or demolished within 30 days of the date on this notice. Failing to comply with this letter within the 30 day timeframe given may result in further actions by the City of Yelm, including, but not limited to the issuance of civil penalties of up to $250.00 per violation, per day the violations continue or further enforcement action through court of competent jurisdiction.
