RE: Appeal of Decision in regard to Removal of Storage Container
Mayor Foster and Mr. Vacaro,
I am submitting this letter as an official Appeal of the decision made by Mr. Vacaro regarding a storage container located
on my property at 208 Rice St. SW, in Yelm, WA. Mr. Vacaro has informed me that this container must be removed from
my property by March 15, 2019.
I am requesting that this timeframe be extended to allow me to have the container moved. I have located and negotiated
a new space for the container outside the city limits of Yelm. I have contacted several companies regarding the physical
move of the container. After numerous phone calls to companies that provide such services, I have been told that because
the container has household items in it that I am unable to move out at this time, I must utilize the services of a moving
company out of Portland, Oregon.
I have been in contact with Container Lifters NW regarding moving this container. Their cost to move the container to the
location I have secured outside the city limits of Yelm is $1,100.00
I am a widow living on social security of $1,063.00 per month. I have been able to negotiate a $100.00 reduction of the
quoted price to move the container, leaving the cost at $1,000.00. 1 have also negotiated with them to allow me to make
payments of $200.00 per month for five months to pay for this moving cost. Given my health issues and my financial
constraints, this is absolutely all I can afford each month to pay. Paying this amount monthly will leave me in financial
difficulty, but I will simply have to do it. The company will not move the container until I have paid in full the negotiated
moving fees.
I am requesting until August 31, 2019 (or before if at all possible) to have the container moved off my property. I am
requesting that no "civil penalties or further enforcement through court of competent jurisdiction" be levied against me
during this time that I am acting in good faith and to the fullest extent of my financial capabilities to ensure that the
container is moved.
Additionally, Mr. Vacaro states in his February 2, 2019 letter the references from the Yelm Municipal Code regulating
accessory structures in a "residential' zone. When I spoke with Mr. Vacaro on the phone prior to receiving this letter, I
asked him why similar storage containers were allowed on the property on Longmire Street (a couple of blocks from my
location) behind the golf course. Mr. Vacaro told me that they were allowed to have such storage containers because
they are zoned commercial. Upon investigation, I have found that my property is actually zoned "Central Business District,
Residential OR Commercial." I had also asked Mr. Vacaro if I could move the container to the back of my property and he
said, "No." I feel I should have that option since my property is zoned "Central Business District, Residential OR
Commercial' given what I was told by Mr. Vacaro regarding the acceptance of such storage containers on commercially
zoned land. However, as I stated previously, I have made arrangements to have the storage container moved to a different
location off my property. I simply need the additional time requested —without incurring any fines, fees or penalties — to
be able to do this.
I look forward to your reply concerning this Appeal. I fervently hope that a compassionate response will be favorable to
my request and I will do my utmost to comply and fulfill the stated terms of this letter.
