RE: Notice of Violation
NOTICE IS HEREBY GIVEN per Yelm Municipal Code Section 18.18.050 a Stop Work Order was issued on January 9, 2019 due to a lack of a Grading Permit per YMC 18.12.050, SEPA report per
YMC Section 18.20.020, or a Critical Area Report per YMC Section 18.21.080(D)(1). The Stop Work Order issued was violated shortly after its issuance by continuing to perform work on
said property.
ALLEGATIONS OF FACT
Eric and Case Peterson own C & E Development and have performed, or caused to be performed, work on the property located at 507/509 Rhoton Rd without a grading permit, Critical Areas
Report, or a SEPA report which resulted in a Stop Work Order being issued on January 9, 2019. After the issuance of the Stop Work Order work continued to be performed at the address
mentioned.
Section 18.18.060 Penalties. A. Civil Penalties Any person violating or failing to comply with any of the provisions of the codes to which the enforcement provisions of this chapter
apply may be subject to a cumulative civil penalty of up to $250.00 per day for each active occurrence of violation.
As of this date, Eric or Casey Peterson has not contacted the city via the contact phone numbers on the Stop Work Order.
ALLEGATIONS OF LAW
The above described real property is within the City of Yelm.
The above described development is in violation of the Yelm Municipal Code.
The owner failed to apply for a Grading Permit and approval prior to causing the work to be performed, which violates YMC Section 18.12.050.
The property owner did not provide the required SEPA checklist prior to performing work which is a violation of YMC 18.20.020
Prior to any clearing or grading the City of Yelm requires a Critical Area Report approval which was not submitted resulting in a violation of YMC 18.21.080(D)(1).
The owner or controller of the property failed to comply with the necessary requirements of a Stop Work Order issued in regards to grading and filling the property located at 507/509
Rhoton Rd.
IT IS ORDERED THAT Casey or Eric Peterson shall contact the City of Yelm Community Development Department within 21 days of receiving this notice with a plan on how they intend to correct
these violations.
Failure to comply with the terms of this notice of violation may result in further actions by the City of Yelm, including, but not limited to the additional civil penalties of up to
$250.00 per day, per violation, through a court of competent jurisdiction.
