Dear Ms. Littlejohn,
Thank you for your prompt response to my letter. A search of our records produced a
letter, dated December 5, 2001, from the City Administrator to you regarding the donated
Right of Way and the City paving a parking lot (attached).
This letter does not indicate an allowance of parking for your business in the gravel area.
The size and use of your building would require eight (8) parking stalls. This is the
number of stalls supplied by the City under the agreement. It is the City of Yelm's
position that if you provide additional parking, it is to meet current City standards.

Re: Sale of Vehicles and Customer/Employee Parking
Dear Ms. Littlejohn,
On September 18, 2003, the City of Yelm contacted you via mail regarding a violation of
Yelm Municipal Code, specifically, that the east side of your business on Yelm Ave. East
has become a parking lot for either the sale of used vehicles or parking for the business.
Since this time with no response we have noted that the vehicles with for sale signs have
been removed, and assume that you are not pursuing the use of your property as a used
car lot.
However, the issue of the gravel parking lot for customers or employees seems not to be
resolved. If you would like to review the standard for parking lots, you may make an
appointment with us on Wednesday afternoons to a pre- submission conference.
If pavement expansion is not part of your plans the City of Yelm requests that you find a
solution to this problem, which includes not utilizing the new gravel parking lot.
Please respond to us with your plans within 10 days of receipt of this letter.

RE: Right -of -way donation for Yelm Ave. E. improvement project, Parcel #552
Dear Bonnie:
This letter serves to document our telephone conversation of Tuesday, December 4, 2001
regarding the conditions related to the donation of the necessary right-of-way for the
Yelm Ave. E. improvement project. In that discussion, I, as responsible staff for this
project, agreed to compensate you for the following improvements conditioned upon your
signature of the right -of -way donation paperwork:
1. A paved parking area on the west side of the Bon Jon's building to replace the 8
stalls that you will lose in the front when the street project is completed. This
area will meet the City's development guidelines, including provision of the
necessary parking lot landscaping.
2. A paved approach from the new westerly access (see 91 below) to the parking
area.
3. A sidewalk from the new parking lot to the front entry of Bon Jon's.
4. Grass in the front of Bon Jon's where the front parking currently is to meet up
with the new sidewalk that will be constructed with the street project.
5. If the existing sign needs to be moved upon final project staking, we will include
compensation for it to be relocated
After we receive the signed right-of-way donation, we can work together on a design of
the above improvements so you can obtain a bid to have the work done in conjunction
with the road project next summer. Once we have agreed upon a price, the City of Yelm
will compensate you and you will be responsible for hiring the above work to be
completed.
In addition, the following items were agreed upon that would be part of the Yelm Ave. E.
improvement project and constructed as part of the city's project at no cost to you:
1. A full (in- out/right -left tums) access on the westerly end of your property that
would lead to your new parking area described above. This access will be
approximately 36' wide.
2. Sidewalks and planter strip across the full frontage of your property, except for
the access points.
3. One access point at the easterly end of your property that would be narrower
(approximately 24' -28' wide) and allow for right-in/right-out access only. This
would be constructed and match up to with the existing gravel area now in place.
I hope this addresses all the items that we covered in our telephone conversation. By
copy of this letter, l am requesting that Shelley Kobza, DOT Right -of -Way Agent,
provide you with the necessary right -of -way donation documents for your signature. I
have also discussed the above improvements with our Community Development
Department to assure city code compliance and with DOT Project Engineer
representatives.
In closing, I would like to thank you for working with the City of Yelm on this very
important project. It is by working together on right -of -way issues, that we are able to
make Yelm Avenue safer and more aesthetically pleasing.
