Home occupations are permitted as a matter of right in any residential district; provided, that: A. No merchandise or stock in trade is sold or displayed on any exterior portion of the premises; B. No equipment or material is stored, altered or repaired on any exterior portion of the premises. (Ord. 561 § 3, 1995; Ord. 555 § 14, 1995). 17.69.050 Development and performance standards. A. Home occupations shall emit no noise, air pollutants, waste products or other effects detrimental to the environment or the neighborhood beyond those normally emanating from residential use. B. Home occupations shall comply with the following conditions: 1. Exterior structural alterations or additions or the use of accessory buildings for home occupations shall be so designed and built as to maintain or preserve the residential character of the premises. In no event shall such structural alterations or additions exceed the development guidelines permitted for structures in the zoning district in which the premises are situated; 2. Traffic generated by home occupations shall not exceed three commercial vehicles per week. All parking of customers' or clients' vehicles shall be off street; 3. Off - street parking spaces shall not be reduced in size or number below the minimum required in the district, nor used for any purpose other than parking; 4. When merchandise, material or equipment is stored, altered, repaired or displayed, such storage, alterations, repairs or displays shall be entirely within the residential structure or in an accessory building which meets the criteria of subsection (B)(1) of this section, except as provided in YMC 17,57.060. (Ord. 561 § 3, 1995; Ord. 555 § 14, 1995). 17.69.060 Permit — Application — Fee. All applications for a home occupation permit shall be made to the city clerk/treasurer on such forms as may be described from time to time by the city and shall contain all information relevant to the conditions set forth in YMC 5.44.010. Every such application shall be accompanied by a filing fee as set by resolution of the city council. (Ord. 561 § 3, 1995; Ord. 555 § 14, 1995). 17.69.070 Permit — Notice of application — Procedure. Within 10 days after receipt of an application for a home occupation permit, the city clerk/treasurer shall cause notice thereof to be published in the official newspaper of the city. Such notice shall include the name and address of the applicant, identification of the premises where the proposed home occupation will be conducted, and a description of the nature of the proposed home occupation. No public hearing shall be required; however, the city will entertain written and oral comment from the public regarding the proposed home occupation. If no adverse comments are submitted to the city clerk/treasurer within 10 days following publication of the notice provided in this section, the city clerk/treasurer may issue the home occupation permit; provided, that all other conditions of this chapter are met. In the event adverse comments are submitted within the 10-day period prescribed in the preceding sentence, or in the event the city clerk/treasurer finds that the proposed occupation does not otherwise meet the conditions of this 02005 Cone Publishing. Box 479 Yelm, WA 98597 Dear Tami 440p1pnf�0 Back on 7/06105 Fiona and I had a Pre - Application Meeting with you about the possibility of converting the residence at 701 Yelm Ave. E. into a commercial office. We said then that we would do our homework to look at the feasibility of this conversion and get back to you by the end of the month. We have decided not to convert the residence into a commercial office for the following reasons, 1. The owner of the property will not grant us a long term lease to justify the cost investment. 2. The owner will not sell the property to us. 3. The owner will not participate in the costs of the upgrades. Since I am on a month to month rental basis here I can not justify an investment that could disappear at the first of any month. Our choice is then to remain a residence with a business not to exceed 25% of the square footage of the house. In our meeting you suggested that should we choose to go this routewe would still be allowed to put up a small sign. Could you refresh my memory on the exact limits of the signage allowed? Until a complete application is made, the Community Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre - submission. Proponent: Apple Construction Project Proposal: Convert residence into commercial office Project Location: 701 Yelm Avenue West Zoning and Setbacks The property is zoned Commercial (C -1), Chapter 17.26 YMC. This district allows a professional office as a permitted use subject to site plan review. Applications to develop, remodel or improve properties and structures within this zone shall require review and approval of a site plan in accordance with Chapter 17.84 YMC. Parking The requirements for off - street parking and their design shall be regarded as the minimum; however, the owner, developer, or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises even though such space is in excess of the minimum set forth. Chapter 17.72 Business and professional offices require one (1) space per 300 square feet of gross floor area. The building is approximately 1100 square feet which requires 4 parking stalls. Yelm Development Guidelines 4G.110 states; "in all commercial and industrial developments, parking areas shall be so arranged as to make it unnecessary for a vehicle to back out into any street or public right -of -way. A parking plan shall be submitted to the Community Development Department for review and approval a the time of application for site plan review. All required parking areas must be paved, striped and landscaped. Ingress /Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 46.140. Existing vehicular access to the site is located on Yelm Avenue. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. For a professional office, the trip generation rate is 3.68 per 1,000 square feet. A residence creates 1.01 new pm peak hour trips. This buildings previous use was a single - family residence. A credit should be issued for the existing traffic generation. To determine the projects impact and fee, use the following formula for the use proposed: ((Peak PM Trip Rate' Gross Floor Area) /1,000)' $750.00 = TFC Example: 3.68x 1,080 = 3,974.40 - 1,000 = 3.97x $750.00 = $2,980.80 Credit one residence. New residence: 1.01 x $750.00 = $757.50 Total: $2,223.30 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist is not required provided the proposal does not create 4,000 sq. ft. or 20 or more parking stalls. Application and Process: Site Plan Review, Chapter 17.84 is an administrative process Minimum application requirements for Site Plan Review are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 10 - 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Other Design Guidelines - the attached checklist must be submitted at time of application, with written responses on how each guideline requirement is proposed to be met. Change of Use from Residential to Commercial Project Location: 701 Yelm Ave E Yelm, WA 98597 Water The proposed site is currently connected to the City of Yelm's water system. When a change of use is proposed it is a applicants responsibility to provide the City water usage calculations that show if the water usage will increase or decrease with the new proposed use If additional water connections are needed, commercial water connections are based on a consumption rate of 900 cubic feet a month and are charged at a rate of $1,500 per a connection (fee subject to change) inside city limits. Water fees are payable at building permit or tenant permit issuance. Irrigation Meter: An irrigation meter may be installed for the purpose of irrigation. An approved backflow prevention device will be required for all landscape irrigation connections. Cross Connection Control: Washington State Department of Health, in WAC 246- 290 -490 states that all group A water systems with 1000 or more connections are required by the department of health to develop and implement a cross control connection program. This program requires all commercial buildings and irrigation systems to have a back flow prevention device installed on the water services. A list of approved devices can be located at the above referenced Washington Administrative Code. At the conference the staff will make available information relating to the proposed development. The intent is to identify and eliminate as many potential problems as possible in order for the project to be processed without delay. The conference should take place prior to detailed work by an engineer or surveyor, however a site drawing must be submitted that has sufficient information to allow for evaluation. Discussion topics will include such things as Yelm's Comprehensive Plan, street design, storm runoff and retention, Shoreline Master Program, zoning, availability of sewer and water, development concepts, other requirements and permits, and the environmental impact. Staff noes are prepared and available to review. There is no charge for this meeting. Meetings are held each Wednesday.
