Box 682 Roy, WA 98580 Re: Outside Storage and Off Site Parking Dear Mr. Franczyk: It has come to my attention that you are storing your used tires in a trailer outside of your building. As you may remember in our meeting, we told you that it was very important that you contain your business within the confines of the existing building. Yelm Municipal Code, Chapter 17.57.060 Storage states: "in the conduct of any business, the storage of merchandise, raw materials, equipment, fixtures, scraps or solid wastes shall comply with the following requirements: A. Every reasonable effort shall be made by persons operating a business to store all such materials within an enclosed building, with the following exceptions: 1. Where such inside storage is not practical or desirable for reasons related to health, fire or safety codes; 2. Where the outside storage of merchandise, manufactured products or raw materials is normal and standard practice, such as in the sale of automotive equipment, mobile homes, lumber, gardening materials, nursery stock and the like, or on the site on construction projects; 3. When materials or products are temporarily stored outside incidental to shipping, delivery, loading or unloading thereof.., B. Outside storage shall be maintained in an orderly manner consistent with good housekeeping practices and shall be: 1. Effectively fenced and screened from all residential areas and public rights -of -way (an eight -foot solid fence is presumed to effectively screen outside storage, not all outside storage requires an eight -foot solid fence); 2. Consistent with fire, safety, health and sanitary codes and industry practices. The Cit y of Yelm is an Equal Opporhmity Provider The storage of the used tires must comply with 17.57.060(8)(1) above. Refuse storage is regulated by Yelm Municipal Code Chapter 17.26.130(C), which states; 1. Refuse container screening shall be required and be of a material and design compatible with the overall architectural theme of the associated structure, shall be at least as high as the refuse container, and shall in no case be less than six feet high. 2. No refuse container shall be permitted between a street and the front of a building. 3. Refuse collection areas shall be designed to contain all refuse generated on -site and deposited between collections. Deposited refuse shall not be visible from outside the refuse enclosure. (Ord. 561 § 3,1995; Ord. 555 § 14, 1995). Storage of your refuse container on the lot adjacent to your business is not allowed. It must be kept on your site, and screened from view. Parking on the adjacent lot is also in code violation. To use the vacant lot for parking, you must have an agreement with the property owner, and the parking area must meet the requirements of the Yelm Development guidelines for parking lots. This entails ingress and egress, surfacing, landscaping, lighting, and stormwater retention and treatment. To avoid further action by the City, please resolve these items by July 15, 2002.
