This is a follow -up to our conversation on June 28,2006 During which I informed you
that it has come to the attention of the Yelm Community Department that the use of your
property may be in violation of provisions of the Yelm Municipal code.
This letter shall serve as official notice of violation of Chapters 17.57 and 17.24.130 #3
of the City of Yelm Municipal Code. Chapter 17.57 outside storage of merchandise
17.24.130 #3 Refuse container .I have enclosed copies. I have also enclosed a copy of
the letter to Mr. Paigen . This letter has the approved conditions for the property.
I would ask you to correct the violations.
Failure to comply with the terms of this notice of violation may result in further actions by
the City of Yelm, including, but not limited to the Issuance of civil penalties of up to
$250.00 per day of violation or further enforcement action through a court of
compentent jurisdiction.

Dear Mr. Longnecker:
This letter is a follow -up to the letter sent to you last week by Larry Hanson, Code
Enforcement Officer for the Community Development Department. Specifically, Larry
requested that the site plan review committee review the conditions of approval of the
land use permit issued to Randy Paigen for the improvement of the site now occupied
by J & I Power Equipment as they relate to on -site parking and outdoor display of
merchandise.
After visiting the site regarding your display of merchandise in required landscape and
parking areas, Larry noticed that your use of the building differs from the approved
plans in a manner that may allow you to take advantage of additional outdoor display
area. The parking requirements outlined in the land use approval did not take into
consideration the portion of the building dedicated to equipment repair and service,
which may reduce the number of required parking spaces for the business. If this is the
case, then it may be possible to utilize any spaces which are not required to meet
minimum parking standards for outdoor display, provided it meets the standards of
Section 17.24.130 (3) YMC.
One parking space is required for every 250 square feet of gross floor area for retail
establishments. The retail area for this calculation would include all sales floor area,
offices, and ancillary facilities such as restrooms, but may exclude the equipment repair
area. Additionally, the parts storage area can be calculated at one space for every 400
square feet.
If you would like to explore this possibility further, you should submit a site plan to the
Community Development Department that shows the building and parking lot (I have
included the approved plans for your use in this regard) with the following notations:
✓ The gross floor area of the building (that not used for equipment service and
repair or parts storage).
✓ The gross floor area of the parts storage area.

✓ The parking stalls proposed to be used for outdoor display.
• A plan for screening the outdoor display area that is consistent with the overall
landscaping plan.
• A plan for use of the parking stalls if the ratio of equipment service and repair to
gross retail area changes in the future.
Finally, the Community Development Department works hard to find ways for a site plan
to work, while pointing out potential future issues to the developer. In this case, the site
upon which J & I is located is very small for the size of building that was constructed,
and the City worked through many site planning issues with Mr. Paigen, the developer.
The Department noted a number of times to Mr. Paigen that outdoor display of
merchandise was not allowed except under the conditions found in Section 17.14.130
(3) YMC, which does not allow landscape areas, required sidewalks, or required parking
stalls to be used as display areas. While I understand that this concern may not have
been passed along to you as the business owner by the developer, the City has been
consistent in raising the concern as part of the site review process.

This letter is a request to use J & I Power Equipments parking lot in a`- di�ffeAt
manner than what was originally defined. We have recently been informed that we
cannot use any outside area for display of equipment. This is due to city codes that will
not allow parking of our equipment on landscape, parking stalls, and or required walk
ways. After talking with Larry Hanson, and Tami Merriman we have developed a
proposal to meet the cities needs and some of our own.
After going over the codes it seems that we really aren't required to have 28 stalls
due to our store being split into sales, parts and service. The parts and service stall
requirements, based on square footage, we less than that required for sales. The required
spaces are 1 per every 250 square feet of gross floor area for retail, and I per every 400
square feet for parts storage. Our stores square footage are roughly 3500' show room =
14 stalls; parts 1500' = 4 stalls; service/ w/h 2000' = 0 stalls. We would like to use
spaces 1 -7 for customers; 8 -14 for display, 15 -21 for customers, 22 -27 for employee
parking and temporary holding area for customer equipment over flow during business
hours. We would like to increase the size of the trash fence to enclose our recycle and
trash bin using stall 28. We would also like to note that outside displays are seasonal and
weather related and that for the most part these units are stored in doors during non -
business hours.
Our plan for the use of parking stalls would change if there were a change in our
shop or parts departments converting to retail. If this occurs there will be a reduction in
display stalls and increased parking stalls. This would only occur if were to change other
departments to retail. Our outdoor display should not require screening so the only
change there would be to increase the size of our trash screening if we decide to do that.
Finally, we at J & I are proud to be part of the Yelm community and would really
like to maintain the highest level of relations with the city and its community. We have
been discouraged by not being able to display our merchandise out side. Since we have
been displaying strictly inside we have found our business has greatly decreased. Like a
nursery, auto or motorcycle dealership it is customary to set up outside displays during
business hours, and being in a seasonal business like ours it plays a key role in our
success. We are hoping this proposal will meet the standards that have been set forth for
all businesses with in the city limits.

supports, and electrical components of the proposed sign.
• ALL SIGNS ARE SUBJECT TO CHAPTER 15.24, YELM MUNICIPAL CODE. To aid in applicants'
understanding of typelsize of allowable sign(s), excerpts are printed below.
15.24.080 Prohibited signs.
Prohibited signs are subject to removal (except legal nonconforming signs as defined by this chapter) by
the city at the owners or user's expense. The following signs or displays are prohibited:
A. Roof signs;
B. Animated signs;
C. Flashing signs;
D. Portable signs, except as provided under temporary signs;
E. Advertising vehicles;
F. Signs which purport to be, or are, an imitation of, or resemble an official traffic sign or signal, or which
bear the words "stop," "caution; 'danger; 'blaming," or similar words;
G. Signs which, by reason of their size, location, movement, content, coloring or manner of illumination
may be confused with or construed as a traffic control sign, signal or device, or the light of an

15.24.120 Illumination.
Illumination from or upon any sign shall be shaded, shielded, directed or reduced so as to avoid undue
brightness, glare or reflection of light on private or public property in the surrounding area, and so as to
avoid unreasonable distracting pedestrians or motorists. "Undue brightness' is illumination in excess of
• that which is reasonably necessary to make the sign reasonably visible to the average person on an
adjacent street. (Ord. 576 § 1, 1996).
15.24.140 Landscaping for freestanding and monument signs.
All freestanding and monument signs shall include as part of their design landscaping about their base so
as to improve the overall appearance of the installation. Landscaping areas shall consist of the following:
50 percent of the sign area of which 50 percent shrubs (minimum 50 percent flowering decorative
shrubs), 50 percent groundcover, or cultivated flower beds (grass not allowed). (Ord. 576 § 1, 1996).
