Our office represents Mountain Lumber and Hardware, Inc., owner of the
property located at 10430 Creek Street SE, Yelm Washington. My client has forwarded
to me your letter of March 30, 2006 regarding your request that my client remove some
manufactured buildings on its property.
Let me first say that my client and I appreciate your communication regarding this
matter. However, l am a little unclear as to the City's authority in requesting that my
client remove the storage sheds. Accordingly, I am writing to request that the City clarify
its position.
As you are probably aware, my client does not use the storage sheds to house any
"merchandise, mw materials, equipment, fixtures, scraps or solid wastes," thus it would
appear as if 17.57.060 of the Yelm Municipal Code is inapplicable. The provision itself
does not prohibit my client from placing retail merchandise in its parking lot.
Please contact me at your convenience to discuss the City's rationale so that I may
properly advise my client. I look forward to hearing from you.
