ALLEGATIONS OF FACT 1. During May 10, 2006 Pre - Application Meeting it was outlined that a review and approval of a site plan in accordance with Chapter 17.84 YMC. To date we have not received the site plan. Following are the other communications and facts that have occurred: a. May 10, 2006 — The above referenced Pre - Application meeting was held providing Teresa Mendes with 30 days from that date to hire a planner or engineer to assist in her site plan application. b. June 13, 2006 Teresa Mendes spoke with Tami Merriman of the Community Development Office stating that she was out of town on an emergency and was working with Dennis Baker to get her site plan. Tami granted her an extension to June 26, 2006 to get the site plan filed. c. June 26, 2006 Tami Merriman received an email from Teresa Mendes stating that she had now retained "Design by Others" out of Lacey to work with Dennis Baker on completing her site plan. There were no dates referenced in this email as to when she intended to have a site plan filed. d. Teresa Mendes has continued to display UHaul trucks and trailers on the property at 109 93rtl Ave SE in Yelm and has continued to operate business there in violation of the YMC. 2. Per the YMC and the Pre - Application Meeting on May 10, 2006 a Site plan review and approval shall be required prior to the use of land or building for the location of any commercial, industrial or public building or activity. To date these requirement and approvals have not been MET. 3. As of the date of this notice the property owners have not complied with the Pre - Application meeting and have not filed their Site Plan for review and approval. IT IS ORDERED THAT Teresa Mendes, UHaul, must cease all business activity at the above mentioned property by August 9, 2006. Failure to comply with the terms of this notice of may result in further actions by the City of Yelm, including, but not limited to the issuance of a citation by the Yelm Police Department for a misdemeanor. Proponent: Teresa Mendes Project Proposal: Display and rental of UHaul trucks & Trailers Project Location: 109 93' Ave. SE, Yelm Zoning and Setbacks The property is zoned Commercial (C1), Chapter 17.26 YMC. Applications to develop, remodel or improve properties and structures within this zone shall require review and approval of a site plan in accordance with Chapter 17.84 YMC. Site plan review and approval shall be required prior to the use of land or building for the location of any commercial, industrial or public building or activity, including environmental checklist review, and for the location of any building in which more than two dwelling units would be contained. Exemptions from site plan review shall be granted if: 1. There is no addition of square feet, or no additional tenant, or the expansion is for storage only. 2. The proposed use is similar as classified by the Standard Industrial Code Classification manual; 3. The building has been occupied with the previous 18 months. Parking The requirements for off - street parking and their design shall be regarded as the minimum; however, the owner, developer, or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises even though such space is in excess of the minimum set forth. Chapter 17.72 does not list an auto repair, or vehicle rental as a specific use, however the most similar use listed is industrial use. Minimum parking requirements are one stall per employee based on the greatest number of employees on a single shift, plus landscaping area. No parking stall shall be located more than 50 feet from a tree. Type V landscaping is required in storm water retention areas, if required. The floor and slopes of any stormwater retention /detention area shall be planted in vegetation that is suitable and will thrive in hydric soils. The landscaping of the stormwater facility shall be incorporated with all on -site landscaping. A conceptual landscaping plan is required with the application for site plan review. Final landscaping and irrigation plan is required as element of civil construction drawings, with installation prior to occupancy. The refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be screened with an enclosure of a material and design compatible with the overall architectural theme. A six foot wall or fence shall enclose any outdoor refuse collection point. The fence shall be a solid material such as wood or masonry. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. The code does not list a vehicle rental use, so a similar use is used for trip generation. The warehousing /storage use is most similar, and creates .74 new.trips per 1,000 sq. ft. To determine the projects impact and fee, use the following formula for the use proposed: ((Peak PM Trip Rate Gross Floor AreaY1,000)' $750.00 = TFC Example:.74 x 3,000 = Z200 + 1,000 = 2.2 x $750.00 = $1,665.00 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist is required when the proposal creates 4,000 sq. ft. or 20 or more parking stalls. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 14 to 16 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of land use approval, the applicant can submit building plans for approval. Proponent: Millenium RV — Cheryl Goff Project: Expansion of existing commercial use Project Location: 109 93rd Ave SE Yelm, WA 98597 Water The proposed site would need to connect to the City's water system. There is an existing 10" water line located on SR 510. This project will have to extend the waterline down 93rd Ave SE and be 10" in size. This project will need to install water meter(s) and fire suppression to support this type of project. Residential water connections are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,500 per a residential connection (fee subject to change) inside city limits. Each commercial unit would be charged for its estimated use. This fee is payable at building permit issuance. Irrigation Meter: An irrigation meter shall be installed for the purpose of irrigation. An approved backflow prevention device will be required for all landscape irrigation connections. Cross Connection Control: Washington State Department of Health, in WAC 246 - 290 -490 states that all group A water systems with 1000 or more connections are required by the department of health to develop and implement a cross control connection program. This program requires all commercial buildings and irrigation systems to have a back flow prevention device installed on the water services. A list of approved devices can be located at the above referenced Washington Administrative Code. Sewer The proposed site will be required to connect to the City's sewer system. There is a 4" sewer line available on SR 510. Your project will be required to extend a sewer main to your proposed development. The sewer main extension shall be 4" in diameter. The STEP system shall be designed and installed per the City of Yelm Development Guidelines. The building will be required to install a step sewer tank (1500 gall min.) The tank will be required to have a duplex pumping system. A civil engineer licensed in the state of Washington shall submit this design. Commercial sewer connections are based on a consumption rate of 240 gallons per day and are charged at a rate of $5,269 per a connection (fee subject to change) inside city limits. An inspection fee of $145.00 per a STEP sewer system will also be required. These fees are payable a building permit issuance. Fire All projects need to have fire protection for the buildings. When reviewing proposals or projects for compliance with the International Fire Code (IFC) the following need to be addressed: Does the proposal have fire hydrant coverage or how is this project meeting the IFC requirements for fire coverage. Stormwater Developments with over 5,000 square feet of impervious surface are required to provide stormwater facilities pursuant to the 1992 DOE Stormwater Manual. If stormwater mitigation is required the types of stormwater mitigation may be wet ponds, bioswales and filter strips. The stormwater disposal is 100% infiltration. There are 2 ways to accomplish this: open ponds and underground galleries. The open ponds are depressions that store stormwater and allow it to perk back into the underground aquifer. Street Improvements Frontage improvements shall be consistent with Yelm's Development Guidelines. Your project will be required to improve the your frontage alone 93`d Ave SE. The required improvements shall be consistent with the "neighborhood collector" roadway section per the city's development guidelines. These improvements will be widening the asphalt, concrete curb and gutter, sidewalk, planter strip and street lighting The interior drive aisles and parking shall be consistent with the city's parking details and the development guidelines. Street improvements may not be limited to above references. If a Traffic Impact Analysis is required this may also outline additional improvements to the adjacent roadways and intersections ADA Requirements The American Disabilities Act required that facilities are ADA accessible. Facility improvements will have to meet current code. Review of these improvements will be determined upon further review of the civil and architectural plans. Parking The requirements for off - street parking and their design shall be regarded as the minimum; however, the owner, developer, or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises even though such space is in excess of the minimum set forth. Chapter 17.72 does not specifically list an auto facility, so the nearest use is used to determine the minimum number of required stalls. The auto service facility will require one space per employee, based on the greatest number of employees on a single shift, plus one sq. ft. of parking per sq. ft. of display or retail area, and one space for each vehicle owned, leased, or operated by the company. All parking areas must be paved, striped, and landscaped. A parking plan shall be submitted to the Community Development Department for review and approval at the time of application for site plan review. Ingress /Egress Ingress and egress at the site shall be consistent with the Yelm Development Guidelines, section 413.140. One vehicular access to Yelm Avenue will be allowed. Landscaping: Chapter 17.80, Type 11, III, IV, V, & VII • Type II landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas, and building elevation. This landscaping is used around the perimeter of a site, and adjacent to buildings. Type II landscaping is characterized by an 8 foot landscape strip between uses and a 5 foot strip around buildings of any combination of evergreen and deciduous trees (with no more than 50 percent being deciduous), shrubs, earthen berms and related plant materials or design features may be selected; provided, that the resultant effect is to provide partial screening and buffering between uses and of softening the appearance of streets, parking and structures. Type III landscaping is intended to provide visual relief where clear sight is desired. This landscaping is utilized along pedestrian corridors and walks for separation of pedestrians from streets and parking areas. Type III landscaping would be required along Yelm Avenue. Type III landscaping is typified by a six foot landscaping strip with street trees for a large overstory canopy along streets and pedestrian corridors and grass or other approved vegetation for groundcover. Earthen berms with grass or other vegetative groundcover and other design features may be worked into landscaping provided the resultant effect of providing a pedestrian - friendly environment and visual relief where clear site is required can be achieved. • Type IV landscaping is intended to provide visual relief and shade in parking areas. At least 24 square feet of landscape development for each parking stall proposed. Each area of landscaping must contain at least 100 square feet of area and must be at least six feet in any direction. Each planting area must contain at least one tree. Live groundcover shall be provided throughout each landscaping area. No parking stall shall be located more than 50 feet from a tree. • Type V landscaping is required in storm water retention areas, if required. The floor and slopes of any stormwater retention /detention area shall be planted in vegetation that is suitable and will thrive in hydric soils. The landscaping of the stormwater facility shall be incorporated with all on -site landscaping. A conceptual landscaping plan is required with the application for site plan review. Final landscaping and irrigation plan is required as element of civil construction drawings, with installation prior to occupancy. The refuse area must be large enough to accommodate a dumpster and recycle bin. Refuse areas must be screened with an enclosure of a material and design compatible with the overall architectural theme. A six foot wall or fence shall enclose any outdoor refuse collection point. The fence shall be a solid material such as wood or masonry. Traffic The City has adopted a Transportation Facility Charge (TFC) of $750.00 per PM peak trip. The Code provides a default table that the applicant can use to determine new PM trips generated. The ordinance does not list a Transmission facility, so the ITE manual is used. The most similar use for a Transmission facility would be an Auto Care Facility(ITE Code 840). The trip generation rate is 1.43 per 1,000 square feet. To determine the projects impact and fee, use the following formula for the use proposed: ((Peak PM Trip Rate' Gross Floor Area) /1,000)' $750.00 = TFC Example:1.43 x 3200 = 4576 + 1,000 = 4.58 x $750.00 = S3,432.00 If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance, and analysis prepared by a Washington State Licensed Engineer can be submitted to the City for review and consideration. SEPA An environmental checklist is not required provided the proposal does not create 4,000 sq. ft. or 20 or more parking stalls. Application and Process Site Plan Review, Chapter 17.84, is an administrative process. Minimum application requirements are located in Section 17.84.060 and are listed on the application form. A project of this size can expect completed review in approximately 12 to 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Upon satisfactory completion of all conditions of land use approval, the applicant can submit building plans for approval. An existing 6° diameter water main is located in the Yelm Ave West right of way. This C e ` project will be required to connect to City water services. Commercial water connections are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,500 per a residential connection (fee subject to change) inside city limits. y� Irrigation Meter: V An irrigation meter shall be installed for the purpose of irrigation. An approved backflow O= prevention device will be required for all landscape irrigation connections. Cross Connection Control: Washington State Department of Health, in WAC 246 - 290 -490 states that all group A water systems with 1000 or more connections are required by the department of health to develop and implement a cross control connection program. This program requires all commercial buildings and irrigation systems to have a back flow prevention device installed on the water services.
