This is in response to your voice mail and letter dated July 19, 2006, regarding the Yelm
City Market and your client, Mr. Richard Kim.
Specifically, you ask whether the land use violation noted in the City's April 6, 2006,
letter to your client had been resolved at this time. As you know, your client changed
the approved configuration of a joint use parking lot used by the Yelm City Market and
Cascade Mini -golf, part of which was to paint 'no-parking' on some of the approved joint
use stalls and to change stall locations.
The City of Yelm, and specifically Larry Hanson, the City's Code Enforcement Officer,
has attempted to work with your client and Frankie Davis, owner of Cascade Mini -golf to
resolve the violation in a manner which satisfied both parties. Towards this end, Mr.
Hanson worked with both parties which resulted in, on May 16, 2006, an agreement that
Mr. Davis would complete the work by June 16, 2006, and that Mr. Kim would be
notified in advance of the work to be completed.
Since the agreement has been in place, the City has not pursued any further action, as
the original complainant had agreed return the parking lot to it's approved configuration.
The City's interest is to maintain a parking lot that meets City standards as well as
serves the needs of both businesses, as required by the land use approval and
implemented through the joint use parking agreement.
If you have any further questions regarding the status of the violation, please contact
Larry Hanson, Code Enforcement Officer, as I will be out of the office the remainder of
this week.

This is a follow -up to my letter dated March 8, 2006, and your discussion with Larry Hanson, the
City's Code Enforcement Officer, regarding the changes you have made to the parking lot
serving Yelm City Market and Cascade Mini Golf.
As you have been previously informed, the current parking lot configuration is not what was
approved as part of the land use approval for the Mini Goff facility and is not consistent with the
standards for parking lots found in the City's Development Guidelines. The lot needs to be
returned to its approved configuration.
I have attached a copy of the approved packing lot layout for your use. If this violation is not
resolved by April 20, 2006, 1 will refer it to Larry Hanson for further action.

The Community Development Department has been informed that you have or are in the
process of re- striping the joint use parking lot serving the Yelm City Market and the mini -goN
course at 1506 Yelm Avenue West.
A condition of the land use approval required a joint use parking agreement and shared parking
between the two facilities. As a condition of land use approval, and changes to the striping or
signing of the parking spaces requires approval from the Community Development Department.
The number of spaces available to both the Market and mini -golf facility may not be reduced
through signing or re- striping. Any signs restricting parking for one or both of the businesses
must be removed immediately and the parking lot returned to it's original striping condition.

Please be advised that our office represents Richard Kim and the his wife, as owners of
the Yelm City Market.
My clients have provided to me a copy of your letter of April 6 regarding alleged
'.changes' made by them to the parking lot configuration. I have seen the lot myself, and it
appears that all they did was to repaint the existing strips that had faded in front of' their store.
This was done, in part, to the blockage of the entry of their store by their landlord (see attached
photo showing Mr. Davis' truck parked across the parking stalls).
Please call me to discuss whether there is still a problem and if so, what if anything you
specifically want my clients to do. As long as they have access to their store, they are more than
willing to do what the City wants them to do. I am sure, however, that you can appreciate why a
small business owner can not have his store entrance blocked from customers' access to it.
I would like to get a letter back — you can fax it to me at 206. 292 -9736 — that
acknowledges receipt of this letter and explaining to me what if anything, specifically, you want
my clients to now do to resolve the City's concerts. This is urgently needed as there is a Court
hearing on Friday morning on a dispute between the Kims and their landlord, Mr. Davis.
Also, our office would like to get by fax from you a copy of the attachment referenced in
your April 6 letter.

In the recent past, Larry Hanson, the Community Development Department's Code
Enforcement Officer, has spoken to you about a complaint the City received regarding your use
of the Yelm City Market building at 1506 Yelm Avenue West for residential purposes.
At that time, you indicated to Mr. Hanson that you were not sleeping in the building and
understood that doing so would be in violation of building codes as the facility does not meet the
requirements for an accessory dwelling unit within a commercial building.
Since your discussion with Mr. Hanson, the Community Development has been provided a copy
of letter from your attorney, Mr. Steve Crane, in which Mr. Crane states that the property is both
your home and business. The City has also received a copy of a food inspection establishment
inspection report conducted by the Thurston County Environmental Health Division which
indicates that there is an office with a bed and closet, with a solid door, and that "wife &
husband do sleep here ".
In order to legally convert a portion of the structure for living purposes, a building permit will be
required from the City of Yelm and all residential requirements must be met. Until such time as
the living unit within the structure is legally converted, residential occupancy must cease.
As you have illegally occupied a portion of the building after discussing this matter with the
City's Code Enforcement Officer, it appears to be a willful violation of the building codes, and
the Community Development Department will take action if the violation continues.

SUBJECT: Patching, re- surfacing and re- striping of the community parking lot
between Cascade Mini Golf and Yelm City Market.
Reference: Picture of joint parking lot before Mr. Kim decided to illegally re -stripe it.
Picture taken Fall of 2005.
1. I propose to patch the area of the parking lot where repairs to a drainage system have
been completed. 2. Re- surface the entire parking lot between both businesses with an
asphalt compound. 3. Re -stripe the entire parking lot as it was originally done when
Cascade Mini Golf was built. Original design (faded) in the picture approved by the city
and has been in place for 5 years.
This whole project to be completed within 30 days of the date of this letter.
To complete this project the entire parking lot will have to be closed down for one (1) full
day (24 hours).
This project will be carried out on a week day (Monday thru Thursday).
I will give Mr. Kim 3 day's written notice of the date the project will be started.
Request that Mr. Kim be given official notification that he cannot make any changes in
striping of the parking lot without prior approval of the city and the owner of the
property.

WA and Lot # 21713340406 with the address of 1504 Yelm Ave W, Yelm, WA.

Please be advised that our office represents Richard Kim and the his wife, as owners of
the Yelm City Market.
My clients have provided to me a copy of you letter of April 6 regarding alleged
.,changes" made by them to the parking lot configuration. I have seen the lot myself, and it
appears that all they did was to repaint the existing strips that had faded in front of their store.
This was done, in part, to the blockage of the entry of their store by their landlord (see attached
photo showing Mr. Davis' truck parked across the parking stalls).
Please call me to discuss whether there is still a problem and if so, what if anything you
specifically want my clients to do. As long as they have access to their store, they are more than
willing to do what the City wants them to do. 1 am sure, however, that you can appreciate why a
small business owner can not have his store entrance blocked from customers' access to it.
I would like to get a letter back — you can fax it to me at 206. 292 -9736 — that
acknowledges receipt of this letter and explaining to me what if anything, specifically, you want
my clients to now do to resolve the City's concems. This is urgently needed as there is a Court
hearing on Friday morning on a dispute between the Kims and their landlord, Mr. Davis.
Also, our office would like to get by fax from you a copy of the attachment referenced in
your April 6 letter.
