First of all, I still occupy the structure and I believe its use is still consistent as permitted. Please define and or cite the City code that you believe I am violating and indicate why or what evidence that you have that supports your claim. Second, your 'observed fniming', is a freestanding panel system that acts as a 'shelf backing. I must say, had you taken the time, to get out of your car, and come up and introduce yourself I would have been happy to show you around. But instead, you sat in your car, out in the street taking 'long distant' photos like some kind of KGB operative. Where has our town gone? Where is the 'community'? In the past, if Wah or Gene had a question, they were forthright. I'm not seeing that here. Since you brought up Mr. Beck's letter of February 22, 2005, please explain to me why he has faded to respond. My response to his letter specifically requested information on the applicable codes. I have no intern to violate the codes, but you now have so many, I specifically asked for a reference so that I may research the codes so I would not violate the local rules. He never wrote back even after 1 prompted him in an e-mail. I will await yo nse before taking additional action. I called on October 2, 2006 to speak with you regarding this matter and left a message with the woman that answered the phone. I again called on October 4, 2006 and left another message. Per Yelm Municipal City Code 17 -70 -030 A -1 "Contractor's offices, equipment storage sheds and storage yards, and portable lavatories on the site of a permitted, active construction project, for a duration not exceeding one year." Since there are no active permits at this address you are not eligible to have this portable lavatory remain on the premises and we need to have H removed. As previously noted on your building permit and through a letter from Grant Beck dated February 22, 2005, the use of the building as commercial storage requires a site plan review approval. In addition, the framing work currently being undertaken requires a building permit. As you have previously been made aware of the violation, you need to make application for a site plan review approval to the Community Development Department no later than August 10, 2005, to avoid further enforcement action. At the time the building permit was issued in 2003, 1 thought it was clear to you that site plan review approval was required prior to any commercial use of the structure, and that the site would have to be brought up to present development standards before a site plan review permit would become effective. This was even memorialized in a developer agreement you signed before building permit issuance. Because you are knowingly violating the Zoning Code and the provisions of the building permit for the structure, and it is probable that you will continue to use the building in violation of land use regulations regardless of whether they are advertised as rental units, you need to take the following steps immediately to avoid enforcement action. • A complete site plan review application, including applicable fees, must be submitted to the Community Development Department no later than March 11, 2005. Please note that the Zoning Code prohibits commercial storage within 500 feet of an urban arterial. The property in question is located within this restrictive zone. • The rental of bays within the structure for storage other than yourself must cease immediately. Further, you need to contact Larry Hanson, the City's Code Enforcement Officer, no later than February 24, 2005, to schedule an inspection of the facility for compliance with this requirement. The plan showed a 3,024 square foot building, 7,500 square feet of gravel surface and 3 catchbasins with 8" perforated pipe. After reviewing the plan and referring to the current stormwater manual, I have determined this plan does not meet the requirements of the stormwater manual. Section 1.2.4.1 of the 1992 DOE Stormwater Management Manual second paragraph states, "All new development that Includes the creation of addition of 5,000 square feet, or greater, of new impervious surface area, and land disturbing activity of less than one acre, shall comply with Minimum Requirements #2 through #11 in Section 1.2.6 through 1.2.15 and the Small Parcel Requirement found in Section 1.2.2. Prior to Certificate of Occupancy, these Minimum Requirements will need to be met or the impervious surface must be reduced to less then 5,000 square feet. If this option is pursued, the stormwater may not be discharged directly to groundwater without treatment per the manual. Please submit a stormwater plan and report showing how these requirements have been addressed. What are your facts based upon? Is it very `convnunity -like' for you to jump to the connchtsion that I am it code violation? Flat out, I am not krnowingty violating any codes. The 'community' that I have been a member of for nearly 30 years know, has grown. and I understand that many new codes have been written, more 04 1 have been able to keep up with. Please eke what code we are talking about so that I may reference it. In addition, please cite which code gives you authority to demand that I provide access to the City's code enforcemem officer and what specific code allows you to demand a response time of km then 24 hours? (Your letter states that I must contact Mr. Hanson no later that 2124/05, yet the letter wasn't even postmarked until 2/23/05 and received late this afternoon. How reasonable or 'community' orientated is that dcma nd?) Mr. Beck, if you feel that there are issues, lets work them out, don't just shoot and ask questions later.
