11. Building or maintaining any structure in such condition as to be
dangerous to the health of the citizens of the city;
I. Obstructing or encroaching upon or rendering unsafe for passage any
public highway, private way, street, alley, park, square, driveway,
lake, or stream in the city;
J. Carrying on, within the city limits, a business of manufacturing
gunpowder, nitroglycerin, or other highly explosive substance, or mixing
or grinding the materials therefor, in any place within two hundred
fifty yards of any building in existence at the time such business may
be commenced.

6.08.080 Offenses relatin to cruelt and /or abandon-
ment. The prow sions of RCW 16. and RCW . 4, as now or
hereafter amended, are by this reference adopted as though
here fully set forth. (Ord. 356 S8, 1989).
6.08.090 /Offenses relating to safety and sanitation.
It is unl for an owner to:
A. Allow the accumulation of cat or dog feces in any
open area, run, cage or yard wherein dogs and /or cats are
kept and to fail to remove or dispose of feces at least oncd
every twenty -four hours;.
B. Fail to remove the fecal matter deposited by his /her
animal on public property or private property of another
before the owner leaves the immediate area where the fecal
matter was deposited;
C. Fail to have in his /her possession the equipment
necessary to remove his /her animal's fecal matter when ac-
companied by said animal on public property or public ease-
ment;
D. Have possession or control of any animal sick or
afflicted with any infectious or contagious disease and fail
to provide treatment for such infection or disease, or suffer
or permit such diseased or infected animal to run at large,
or come in contact with other animals, or drink at any public
or common watering trough or stream accessible to other
animals.
Owners of duly licensed guide dogs shall be exempted
from subsections B and C of this section. (Ord. 356 S9,
1989).
It is unlawful to own a vicious animal with knowledge that
the animal is vicious, or with reckless disregard of the fact
that the animal is vicious; provided, however, that this pro-
hibition shall not apply to guard dogs which are to protect
innocent third parties, controllable by their owners /han-
dlers, and adequately confined. (Ord. 356 510, 1989).
6.08.110 Additional offenses relating to control. It
is unlawful for the owner or custodian of any pet animal to:
A. Permit any such domestic animal except cats and
pigeons to be at large or trespass upon the property of
another, including public property, except as expressly per-
mitted herein; provided, that pets may be removed by the

Dear Mr. Weaver
This is a follow up letter to our conversation this afternoon regarding the bags of cans located on
the front porch of your residence. It is the City of Yelm's understanding that your friend will
have picked up and sold the cans within 30 days.
While visiting you we received another complaint expressing concern the cans may present a
health hazard to the neighborhood. The City of Yelm will be reviewing this next week and if
necessary will reopen your file as this may be a public health issue in addition to a neighborhood
eyesore.

Any putrid, unsound or unwholesome bones, meat, hides, skins, or the whole or any part of any dead
animal, fish or fowl,
2. Privies, vaults, cesspools, sumps, pits or like places which are not securely protected from flies or
rats, or which are foul or malodorous,
I s. Filthy or littered trash - covered cellars, house yards, factory yards, vacant areas in rear of stores,
vacant lots, houses, buildings or premises,
4. Animal manure in any quantity which is not securely protected from flies and the elements, or which
is kept or handled in violation of any ordinances of the city,

in or upon any street, avenue, park, parkway or public or private place in the city any one or more of the
following conditions, places or things:
1. Any putrid, unsound or unwholesome bones, meat, hides, skins, or the whole or any pan of any dead
animal, fish or fowl,
2. Privies, vaults, cesspools, sumps, pits or like places which are not securely protected from flies or
rats, or which are foul or malodorous,
3. Filthy or littered trash - covered cellars, house yards, factory yards, vacant areas in rear of stores,
vacant lots, houses, buildings or premises,
4. Animal manure in any quantity which is not securely protected from flies and the elements, or which
is kept or handled in violation of any ordinances of the city,
5. Poison oak or poison ivy (whether growing or otherwise), liquid household wastes, human excreta,
garbage, butcher's trimmings and offal, parts of fish, or any other vegetable or animal matter in any
quantity; provided nothing in this chapter shall prevent the temporary retention of waste in
receptacles in the manner approved by the health officer of the city or the dumping of nonputriying
waste in a place an manner approved by the health officer,
6. Tin cans, bottle, glass cans, small pieces of scrap iron, wire, material, bric- a -brac, broken crockery,
broken glass, broken plaster, scrap building materials, and all such trash or abandoned material
unless the same be kept in covered bins or galvanized iron receptacles approved by the health

7. Trash, litter, weeds or grass, rags, accumulations of empty barrels, boxes, crates, packing cases,
mattresses, lumber not piled, scrap iron, abandoned stoves, kitchen appliances, tin and other metal
not neatly piled, or anything whatsoever in which flies or rats may breed or multiply or which may be
a fire danger,
8. Any abandoned unattended or discarded icebox, refrigerator, freezer or other container having an
air -tight door or lid and a snap lock or other locking device which may not be easily released from
the inside when such lid or door is in a dosed position.
9. laying out, exposing or leaving exposed, in an unenclosed place known to be accessible to domestic
animals or children, any substance or combination of substances known to be a poison or poisonous
if consumed by a human, animal, or fowl;
10. The emitting of loud and raucous noise, from whatever the source or location, in a manner which,
under the circumstances, unreasonably disturbs others.
Causing or allowing any other nuisance as defined in section 9.44. 010 or other provision of the Yelm
Municipal Code.

6.08.080 Offenses relatin to cruelt and /or abandon-
ment. The provisions o RCW 1 and RCW 16.54, as now or

here fully set forth. (Ord. 356 58, 1989).
6.08.090 Offenses relating to safety and sanitation.
It is unlawful for an owner to:
A. Allow the accumulation of cat or dog feces in any
open area, run, cage or yard wherein dogs and /or cats are
kept and to fail to remove or dispose of feces at least once
every twenty -four hours;
B. Fail to remove the fecal matter deposited by his /her
animal on public property or private property of another
before the owner leaves the immediate area where the fecal
matter was deposited;
C. Fail to have in his /her possession the equipment
necessary to remove his /her animal's fecal matter when ac-
companied by said animal on public property or public ease-
ment;
D. Have possession or control of any animal sick or
afflicted with any infectious or contagious disease and fail
to provide treatment for such infection or disease, or suffer
or permit such diseased or infected animal to run at large,
or come in contact with other animals, or drink at any public
or common watering trough or stream accessible to other
animals.
Owners of duly licensed guide dogs shall be exempted
from subsections B and C of this section. (Ord. 356 S9,
1989).
It is unlawful to own a vicious animal with knowledge that
the animal is vicious, or with reckless disregard of the fact
that the animal is vicious; provided, however, that this pro-
hibition shall not apply to guard dogs which are to protect
innocent third parties, controllable by their owners /han-
dlers, and adequately confined. (Ord. 356 510, 1989).
6.08.110 Additional offenses relatin to control. It
is unlawful forthe owner or custodian of any pet animal to:
A. Permit any such domestic animal except cats and
pigeons to be at large or trespass upon the property of
another, including public property, except as expressly per-
mitted herein; provided, that pets may be removed by the

Notice of Civil Infraction for Failure to
Abate Nuisance

You are hereby notified that your failure to comply with the notice to Abate Unsafe or Unlawful
Condition (Nuisance) is a violation of Section 9.44.015 of the Yelm Municipal Code, and
constitutes a civil infraction. As provided in Section 9.48.040 of the Yelm Municipal Code, a
civil penalty has been assessed against you in the amount of 5350.00 , and a separate civil
penalty in that amount may be assessed against you for each day or part of day that this violation
continues, commencing August 16, 1999 , and until the condition specified in the said notice
has been corrected to the city's satisfaction.
Civil Penalties must be paid within thirty days after they have been incurred. Your failure to pay
the assessed penalties when due may result in a civil suit against you for the amount of those
penalties in addition to court costs and abatement costs incurred by the city in correction the
condition in question.
You have the right to appeal this notice to the Yelm Municipal Court as provided in Section
9.489.040 D, Yelm Municipal Code, within ten (10) days, as evidenced by the postmark on said
notice.
