This letter is a follow -up to our telephone conversation today regarding your property at
309 Yelm Avenue West.
Your concern was that a letter sent to you on November 7, 2004, regarding an on -going
land use violation on the property that had been first brought to your attention in August
of 2004 and was as yet unresolved.
In that letter from Larry Hanson, the City's Code Enforcement Officer, he mistakenly
indicated that the outbuilding in question had been used as a garage in the past. In
fact, there is no indication that the outbuilding was ever used as a garage.
I strongly believe that I had addressed your concerns in my letter to you dated February
11, 2005, in which I noted that the purpose of the letter was to address your concerns
regarding the use of the outbuilding and in which I further indicated that the historic use
of the outbuilding was not a factor in the on -going violation or the requirements for a site
plan review approval in order to bring the property into conformance with the provisions
of the Zoning Code.

Dear Ms. Longmire:
This letter is to follow up on the pre- sumbission meeting that was held with the Community
Development Department on September 1, 2004.
Linda Clemetson, Gina Goldschmidt, and you met with us regarding the conversion of the existing
garage to retail /commercial office space for Linda's One Stop Lo -Garb Shop on September 1,
2004. At that time we discussed several items that would be needed for this site to be converted
for use as commercial or retail office space.
Ms Clemetson moved her operation into this building pre - maturely without inquiring what
regulations the City may have had to approve her business license. Roberta Longmire came into
our office approximately one week after this meeting and informed Gary Carlson and myself that
it would not be economically beneficial for her to do the required improvements to this site.
To date, none of the items outlined to bring this site into compliance have been completed,
therefore we need to request the all business cease in this building, and that you give notification
to your tenants.

Mayor Rivas asked that I respond to your comments raised at the City Council meeting
of January 12, 2005. Specifically, you questioned whether the information provided
during the pre- submission meeting held with the Community Development Department
on September 1, 2004, was correct as it relates to the use of the smaller outbuilding on
your property at 309 Yelm Avenue West.
I remember clearly that at the pre- submission meeting we discussed in quite some
detail the historic use of the smaller outbuilding and, in the end, it was noted that the
historic use was not material to the question of whether a site plan review approval was
needed, as the building had stood empty for over 18 months and any 'grandfathering'
had expired pursuant to the Yelm Zoning Code.
After the pre- submission meeting, I met with your Brian Baker, your attorney, and
reviewed in detail the speck City code sections and why a site plan review approval
was required in order to utilize the structure for any retail or business use other than
storage at this time. As I never heard anything further from Mr. Baker, 1 assumed that
both your questions regarding this matter had been answered.
If you have any other questions regarding the property, please don't hesitate to contact
me at the Community Development Department.

Dear Ms. Clemetson:
The Community Development Department has received your application for a business
license to operate a Low Carb Shop at 309 Yelm Ave West. A part of the license
approval process is to review the land use of the site to assure compliance with City
Code.
Section 17.84.010 Yelm Municipal Code slates that Site Plan Approval is required for
any commercial use or activity. Exemptions from Site Plan Review are granted when
there is no addition of square feet or no additional tenant; the proposed use is similar as
classified by the Standard Industrial Code Classification Manual, and the building has
been occupied within the previous 18 months.
The building that you are occupying has been vacant for many years, and your business
is considered a new tenant. Site Plan Review consists of a review of the site, and
usually an approval with conditions of site plans that conform to the standards,
provisions, and policies of the City.

to arrange a Presubmission meeting to discuss this matter. Presubmission meetings
are held on Wednesday afternoons, between 1 p.m. — 3 p.m.
